My apologies for missing some Super Chats. Here's one that I received tonight: "I come ilegaly but never got cut from immigration,I own a business pay my tax have 3 american kids,has been 16 years im here,never had any problems with the law nothing like that,they can deported me,and when I entry i was 16." My response: The administration's focus is on individuals with a removal order, also those with a criminal record, and the recent arrivals. A legal pathway might be available for individuals in this scenario once one of their USC children turns 21 and can file for them. Depending on their marital status, a spouse could potentially file. A waiver will be needed in this situation and consular processing. Speak to an immigration lawyer to be screened for any humanitarian options (e.g. U visa).

@grace Morgan: the executive order on birthright citizenship says that it will be effective after 30 days. So any child born before Feb 20, 205 will be a U.S. citizen by law and constitution. However, Attorney Generals of many states (both western and eastern states) have challenged the executive order as unconstitutional and the courts may put a stay or the order in the least and strike down the order at best in which case the Govt will take it further up to Supreme court which will issue the final verdict. In all cases even if the order is upheld in SC, anyone born in U.S. (both legal or illegal parents) before Feb 20, 2025 will be a U.S. Citizen.

Morestuff do you feel that the approach that the Administration is pursuing is more a direct path to the Supreme Court by design? Meaning Trump knew and expected Attorney Gen's to challenge. Also do you feel this is the best path to achieve this goal? Whether we agree with the executive order or not (would this path work?) Also, if the Supreme Court supports/upholds Trumps executive order: wouldn't that mean from the day, he signed the executive order moving forward Birth right citizenship would no longer be available.

@@letushear7301 That is giving credit that he thinks that far ahead. Kidding... The appeal by the president to a district court will go to Supreme Court anyway. There is no other path. A district court already stayed the order pending full hearing. In the 30 minutes hearing the judge said that in his 40 years on the bench he has never seen such a blatantly unconstitutional order so I guess you know where it is going. As for the effective date I said Feb 20th because that is what the executive order says. The order says that any child born 30 days after the signing of this executive order (which we know is Jan 20th 2025) whose neither parent is permanent resident or Citizen will not be granted birthright citizenship. That is to say at least one of the parent has to be a permanent resident or a U.S. citizen to claim birthright Citizenship. Remember it is not just about illegal aliens. A visitor or a family/person on H1B (work visa) is legally here in U.S. but even though they may be here legally even for 1, 2 or more years, their child born in U.S. will not be entitled to birthright citizenship.

The 14th amendment applies to people lawfully in the country having children usually permanent residents or legal citizen. You have to have a 4th grade education not to understand that. Dredd Scott was lawfully in the country Wong Kim Ark was lawfully in country, much different than illegal immigrants

Different set of judges now, China and Russia have been doing birth tourism meaning the fly pregnant women over here with there doctors have their babies and fly back home with American Citizens babies, 18 years later the come back as citizen spies. The judges will stop that. That was not the original intent of the law neither was the original intent to sneak over here have a baby and now the can't kick you out. You are going to force them to kick you out any way and put the babies up for adoption.
