homr buyer is unsecured creditor. builder collects money, siphon off and goes to insolvency. home buyer pays but every asset land, tower in different stage of construction, inventory every brick, tile all are mortgaged. Funds so callected are siphoned off. then insolvency. If you want flat, never go for under construction. mortgage debt increases as it is based on market value. more delay means more market value and more debt. RBI guidelines on disclosure of mortgage is violated enmass by all banks including PSBs its organised white collar crime punishable 20 yrs jail in USA. FBI has cell to deal it. FBI has dedicaated hotline. Here no check balances. Regulator keeps eye closed. even RERA escrow fund going in construction has window of mortgage debt. Rera does not track mortgages. so every penny of home buyer is siphoned

Krish Ji, you are right, government should create/draft template agreement for all these, they can leave fillers for amenities promised, expected date of delivery or any project specific sections. Even if builder are getting creating these agreements then this should be run through and approved by government regulators

While you suggest to go for Resale deals instead of builder deals, please note that sellers often ask for HUGE Amount of Cash Payment. This is very difficult for a common working man to arrange such huge cash amounts. How should one deal with this problem ?

Another thing. Builders are now making housebuyers to sign affidavits, indemnity etc . Such documents, being legally known as "deed polls" , are binding only on one party i e the party signing it. So, the builder escapes from it's obligations which correspond to housebuyers rights, while housebuyers get permanently trapped in obligations without any recourse to the builder.

Hello, Can you please make a detailed video on risks in a scenario where a buyer buys a resale flat near to possession property from an investor but has to pay to the builder as well as the investor and it looks like a multi party deal. Because these days in most of the near completion projects, the only option for a common man is to buy from an investor because all inventory of builder is already sold. actually it is best to buy after it is built because you can see what is given and what is not. Only compromise is location of flat and size of flat if you are satisfied with less than most favorite floor or size. The price is less than others and you can find faults in flat and ask for discount. Moreover you can talk to existing residents and k ow the hidden problems. IT is the way to go.

MahaRera is pro builder not flat buyer. They are only helping builder the reason best known to them. I have seen a case where maharera given extension putting conditions. But the builder not fulfilling the condition. Maharera not doing anything for compliance. No work is going on the bldg.

Bank sold loan for a under-construction flat. Later flat is not made even after 6 years because some portion of the land is now found disputed. Will the bank still charge EMI. My friend told that it happened with one of his uncle. My question is how can bank give loan on disputed construction of flats ?

Normally bank doesn't not give loans to builder. They go in agreement that if the buyer buys a property they will give the loan from that bank first. Some good builder arr cash rich, they show assets and take loan but they won't take full loan. It's the customer only who takes most of the loan

Can buyer has option to change the agreement prepared and printed by the builder. They will say, if interested you buy else i already have another buyer in line. Only Govt. should bring laws in this regard to safeguard buyers. But builders have their own lobby protected by so called people's representatives voted by us. Thia is the sad reality. Don't be under the impression that RERA will fix everything. Builders don't care because RERA is another legal process, and customer can get justice, but it will take years. In the meantime you will lose your sleep and get BP , just to get your money back. Builders know that 97% people are not mentally in a position to fight it out, hence they continue their malpractices. In the worst case scenario they have to return the money with interest. Which is perfectly ok for them.

Some things are true but some are clearly exaggerated. Agreement to sale usually is linked to stage of construction. The payment becomes due only when building having your flat has reached a particular stage. Also, there are no escalation clauses that prevent rise in cost.

Buying a flat itself is not good idea Rather staying on rent is cheap and logical as there are lot of risks in holding a property where exit is not guaranteed or may take substantial time There may be mobile tower or mosque or beer shop or police station or bridge or metro station planned near building...on rent it is very easy to exit ...owner is slave nowadays of billionaire people
