Uber - Official Policy Regarding Recording Passengers

I am getting a dashcam. I ensure riders fasten their seat belt before I drive and also now planning to inform passengers that I have a dashcam for mutual safety. It is part of a safety drive that I have a dashcam in my car. My job is to follow safety for self and riders as I cannot guarantee safety from other users on the road, a major issue these days.

I get the whole safety thing, anything happens, you have proof.. Also it serves as a deterrent. I agree with this... But putting them on KZbin or twitch or whatever... Is just wrong. Need permission there or at least let them know prior... And if the person says no they don't want to be on the internet, then u don't put them on... Keep the recording for yourself if you want... If you only want to record people to put them on the net... And they say no.. Then let them cancel the ride and refund them whatever fee they get charged for cancelling

They can't have a policy stating you can't record passengers. Recording and video taping anyone is completely legal and uber doesn't have the power to change your American rights its covered under your first amendment rights. So I'm not worried.

I had a rider steal a phone charging cable. It was in the car when he got in, it was gone when he left, but because their were several riders in the car at the time I could not prove he took it. If I had had a cam in place I would have been able to recover my cable and have that rider banned from Uber.

I am an independent contractor so I am liable for what happens in my vehicle I can record as much as I want to. If people don’t want to be recorded then get rid of your smart phones and don’t leave your house.

A bit terse, and over the top for my liking. Your car is not a "premises" (look up the definition). My sign says, "All activities in this vehicle are being recorded, both video and audio." That's all that needs said. It's not so much in-your-face. Right off the bat it sets a negative tone for the passenger. If I were a passenger, I'd complain to Uber suggesting you need to take the edge off and you'd be docked a star for the attitude suggested. You're not running a bar. You're in the customer service business, so back it down, just a bit.

I see both sides. Safety vs Privacy. This is a very dangerous/damaging situation. You hire a service to take you from A to B not to record you or be in a police car. This is what will be a downfall for these companies. Nobody wants big brother. carpools are best. Uber and left will be left with riders of less quality.

I reside in Connecticut. I have a dash cam i use for traffic but hey you never know. But people I picked up say they like it it makes them feel safer. So I would recommend to get it. Since i have gotten this camera I notice people are really careful what they say to me when they see it. So yes everyone should get one.To be honest I would not care if uber or lyft were against it. As a woman driving alone late at night, absolutely, yes. The riders see that I'm recording, and they respect me and my vehicle. I have signs posted for audio and video recording. I do think it may affect my ratings from a few passengers who are put off by it, but I do enough trips to offset those. My personal safety is paramount to someone giving me less than 5 stars. I had a creepy incident where two male passengers did not want to exit my vehicle at the destination. I kept telling them I needed to get going because I had another trip waiting for me. They got out of the car but proceeded to hold my car doors open hanging their heads inside trying to convince me to come inside with them for a night cap. OMG. Eventually, they gave up and let go of the doors. And, I got out of there. QUICKLY! I reported this behavior to uber and told them I had video. The investigated and deactivated those riders. Those riders gave me my ONLY 1 star rating that is still hanging on at almost 1000 trips with uber. Ugh. This is why I have a 4.95 and not a higher rating. I wonder if that 1 star will ever be gone. I enjoy what you post, even your older videos are relevant. And, you have a lot of videos, so I'm sure I haven't seen them all, but all that I have seen have been helpful. There were only two channels that interested me when I was just starting out driving Rideshare. (no offense to anyone else who does Rideshare videos of course), your channel and the simple driver. I had a US soldier recently who attempted to bribe me with a $25 tip to take him onto a military base after he had just purchased cannabis from a legal recreational dispensary. I told him multiple times that I wouldn't do it...but he didn't want to listen. I ended the trip in the app and had him exit my vehicle outside the gate. He's also not likely to ever be allowed to use the Uber platform again, and likely caught some sh[censored]t from his superiors. Without the recording of the trip, I'd have had nothing to protect myself with.

I record when I get an Eerie feeling. I don't record every ride because I don't have to. When I get an eerie or off-set vibe, it's personal AND I record. It's called Background Video Recorder. I press a button and my camera on my phone runs. I protect myself. They are on my private property (which is legal by constitutional right). No signs; Just don't act a fool.

Most riders freak when they know they're being recorded .. I recommend Autoboy Black box for your phone , it allows you to stealth record , meaning you can minumize it on your phone and it will still record in the background , so basically all the rider sees is Waze giving directions , and its still recording em .. Of course there's dash cams and so on , but I really don't want anything extra on my dash , that's just me

I would suggest buying 30 SD cards and using one for each day of the month. Let's say someone makes a complaint about you and the one SD card writs over itself every 24 hours you will then have no video evidence.

In "two party consent" states, even if you place signs it will still not be enough as the second party (the other individual) did not consent. Driving for Uber places your vehicle as a public place and if other parties feel that you violated their personal rights then you will probably be sued. Just because you have a sign doesn't make you right, it should but its not that easy. You have to verbally advise all parties that audio recording is in progress and they have to tell you that they consent. However, "single party consent" states you can do whatever you please.

Uber encourages that all Drivers/Partners use a dash camera only for safety purposes only and to also place a sign prior to entering your vehicle. However, you can’t upload or livestream a passenger or their audio without the passengers consent. You’re car isn’t a “Public Place”. It’s a private car! Read their TOS along with their “Improper Use” policy. Not only is it against Uber’s policy, it’s just morally incorrect to do shady stuff like that!! Plus here in CA, it’s a two party consent state!!

Here is a real issue I was dealt! I was “accused” of driving under the influence! I don’t drunk & drive. I can only suspect that I suggested to a client that in Las Vegas, they made Cannibus Legal. It just so happens My music choice was Pink Floyd. I was suspended for the day! With no way to defend myself! I immediately drive to the Uber office to take a Breathalyzer or even a drug test. I didn’t nor do I ever drink and drive! I’ve learn my lesson and am a responsible driver! So, not sure if a video would help my case, or yours? But, it’s always good to have protection! Lastly, I suggested that the Uber office use my location to call the police! If I’m “illegal” and a threat? I should be prosecuted. I had no issue because I didn’t have any drugs or alcohol in my system! Be aware, some people will just fuck with you for a opinion or a statement! I hope they improve this policy!

CAREFUL!! Video and/or audio recording laws vary from state-to-state. For example, California requires a two-party consent to record. Displaying a sign stating that you are recording does not itself imply consent on the part of the passenger, e.g., 'I didn't see the sign'. In today's digital age, recording laws are constantly changing and evolving so even if your state allows it now doesn't mean that it will next year. CAREFUL!!!

To ALL DRIVERS, STOP giving automatic 5 Star rating to Riders. Stop, Stop, Stop !!! All Riders Start at 4 Star Rating , then work up or down depending on the Quality of the rider. Just because a rider got in, got out and paid, Does NOT justify a 5 Star rating. Just like ALL Drivers have to work and strive for 5 Stars, so should ALL Riders. By properly rating a rider you are helping other drivers be safe and create a positive environment. Let me remind you, if a driver gets a 4.6 or lower rating You Get Deactivated. Bye bye. .. What happens when a rider gets a 4.6 or lower rating? ??? U hear those crickets yet....that's right, Absolutely Nothing happens to the rider. 4.3, 3.9, 3.1 rating. ..nope, sorry, nothing happens to the rider. And if for some Miracle the rider does get deactivated, they open another account in about 60 seconds. What can you do if you get deactivate. .....nothing. So, Use Your Power of rating and reviewing riders to keep the ride share community safe and positive. This is Ride Share, Not Ride Slave!!! Don't be afraid to rate riders 1 star. And if you think your going to give a rider a 3 or 2 star, just go ahead and hit the 1 star to be sure it actually has an affect on them. In my opinion, DON'T pick up riders below 4.6 star rating. This will send a message to riders to shape up and be thankful that they are Privileged to get such a fantastic service for their crappy and ridiculous $5.

Are you okay with that same 4-star rule being applied to your driver rating? Be fair. You know that a 4-star driver rating for a trip is not a good thing...so if everyone automatically gave you 4 stars unless there was something special about you, your overall rating would drop very low regardless of how awesome you think you are being. So be fair. The same rating system you use on your passengers is fair game for them to use on you. I give all riders a 5-star rating unless they do something that requires it. For instance, if a passenger acts entitled to anything other than a safe ride to their destination, such as phone charging cables, eating in my car, arguing with me about open alcoholic beverage container and legal cannabis possession laws, or vaping, or anything else...one tiny little complaint about me following the law...their rating goes down from there depending on the severity of their behavior. Failure to fasten the seatbelt on their own without being told to put it on: automatic 4 star. Refusal to fasten the seat belt or whining/scoffing when asked to fasten the seat belt: Automatic 1-star. Outright refusal and failure to wear the seat belt at all will get you kicked out of my car -- even friends and family. I made one exception to my "no eating in the car" rule: A US Solider in uniform who clearly looked worn out, tired, and almost ill, and had a bad day asked me if he could eat his McDonald's on the way back to the Army base. I said, "Of course." and let him eat...I'm not heartless and I gave him 5 stars. I rarely give less than a 5 star rating because, and thankfully, the overwhelming majority of my passengers are well-behaved.

like i said before, Keep your camera rolling but hide it. A good place would be behind the backseats on top of that area, make a little compartment for it and make sure a remote can access a signal so you can click record before passengers get in. I knew there would be a issue with your camera because some people simply don't like being filmed. Perfectly legal but people will still complain/many people don't know the laws regarding video recording. Uber on !

FOR FLORIDA TAXI/UBER/LYFT/RIDSHARE does not carry an expectation of privacy. The florida definition has only ever been applied to a very narrow range of situations. Lamens terms in Florida, "An expectation of privacy" applies to areas where there is enough privacy to drop their underpants and walk/sit around in their birthday suit. The recording in this situation falls under voyeurism. Doctors exam/procedure rooms, changing rooms, hotel rooms, bathrooms, bathroom stalls, fitting rooms, locker rooms... Every list involves these sorts of situations. Security Surveillance Systems It is lawful to indirectly record another person using a security or video surveillance system if notice of the system is conspicuously posted on the premises stating that a video surveillance system has been installed or if the video surveillance system is installed in such a manner that its presence is immediately obvious. However, it is unlawful for a merchant to directly observe or record customers without their permission in a dressing room or restroom stall that is intended to afford a customer privacy. So really what you need is it to be conspicuous AND OR post a notice that video recording is occurring.

I just bought the same camera (N2 Pro) and I'm in Los Angeles as well I contacted Uber, they said I must tell the passenger they are being recorded so I figured a sign would suffice? Either way that camera is a good idea especially for the night shift (Downtown and Hollywood). Also not to be a dick, but technically I'm not "recording" anyone since it's just overlapping lol? That depends on your state laws. Ultimately in most states your car is your property and you have the right to record without notification. But you can always check your local laws.

Yes, it's his responsibility for leaving his phone, but you should ALWAYS check your car IMMEDIATELY after a rider exits. For items left behind, damage, etc.

California is a two party state. You can't record audio of people without their knowledge for future use.

+Juan C Martinez Uber will terminate you for posting videos of PAX on KZbin. They are not OK with it. You need to check local laws before recording audio / video. Some states it's OK to record video, but if you record audio it becomes illegal. It's very important you know the law in your area. It would be very helpful to get the passenger(s) on video to consent to being recorded. You may want to consult legal council to make it all legit.

+Uber Man im from NYC and here you have to get a TLC license and there are a ton of rules and regulations... the law allows you to record video and audio but you have to let them know... But if i just record having regular conversations with passangers, and they consent... is uber still going to have a problem with that?

Uber man, you are contradicting your own statement. You highlight how important a dash cam is or how it's imperative that one should have one plus the approval from Uber yet you you also emphasize that it's ones own choice and that you may or may not be using one. Can you make your mind up? As far as I'm concerned, I'm definitely going with the dash cam. The benefits far far outweigh what a rider may or may not think about being recorded. So kindly be more assertive. We see your clips to get pointers, legit pointers not dilly dallying about it.

The problem is, drivers uploading video to social media with the intent of defaming pax, or blackmailing them. That video should remain confidential, and should be deleted unless there is a claim made, or an issue with the ride itself. A driver that uploads a video to youtube should be deactivated.
