You forgot to mention that the glove box, center console and carrying case has to have a latch(s) or zipper(soft case) that securely contains the firearm.

So from my understanding, it is legal to have the handgun in your vehicle as long as it is stored properly regardless of CWP. But... by carrying the gun to your vehicle without a CWP you are breaking the law? Makes no sense.

No, that is one of the exceptions in the law, you can carry the handgun to your vehicle. There are 16 exceptions, this is one of them.

This statute does not impact anyones ability or right to own a firearm but merely defines how a person in South Carolina must transport a firearm.

@@DaleSavageLaw it infringes upon a law abiding adult’s right to protect themselves outside of their dwelling place, place of business and motor vehicle. As a law abiding adult with no criminal history you should not be required to have the government’s permission to the right to bear arms, on their person for protection from deadly entities.

I don't understand not allowing open carry. It seems that not allowing concealed would be inforced first. You can hide and conceal a gun but your not allowed to openly carry so officers and everyone else is aware of the presence of a firearm.

Hey Dale Savage- I am a previously convicted felon in the state of SC, on 2nd degree Burglary (a non violent offense), and two counts of grand larceny, for which I served a sentence of 5 years in prison for. This was over 10 years ago. Am I lawfully able to keep a pistol (assuming I hypothetically already have acquired one) at my home for self defense? Have I lost ALL of my 2nd Amendment rights? How does one go about restoring those rights? I see that is an old video, hopefully you’re able to see this and give me some insight on the matter. Thank you in advance.

Although I don't talk about it in this video in your case you have to consider federal law as well b/c you might not be on violation of state law (unlawful possession of a gun by a person convicted of a violent crime) you would be prohibited under federal law. To restore you r rights you would need a pardon on your charges.

@@dframbo3544 A couple of issues with this. 1) In SC you must possess a CWP to conceal carry. 2) It depends on context, It is unlawful for a person to present or point at another person a loaded or unloaded firearm. 16-23-410. Printing is not a legal definition in regards to gun statutes so the term has no legal significance in SC.

There are toe legal issues involved here 1) is that a lawful place to transport a gun in a vehicle and 2) is the gun legal. Yes that is a lawful place to transport a gun in your vehicle. Ownership is irrelevant. Is the gun a lawful firearm? I don't know from these facts.

To take the gun back home after purchase on your bicycle is not unlawful as there is an exception to the unlawful carry statute: (10) a person carrying a handgun unloaded and in a secure wrapper from the place of purchase to his home or fixed place of business or while in the process of changing or moving one’s residence or changing or moving one’s fixed place of business; However, after you take the gun home from that point onwards you cannot lawfully carry the gun on your bicycle without a CWP as a bicycle is not a vehicle. So you have to have a CWP to carry the gun on your bike to be in compliance with the statute.

South Carolina is not an "open carry" state. That means you cannot open carry any firearm whether it is a pistol or a long gun such as a shotgun.

Yes, if you are in SC and have a SC CWP you can carry it on your person, under the seat, in between your seat and the center console.

Terry, I am a CDL A & CWP holder also. While it is true that CWP holder can carry in CMV truck, just be sure to review your company policy. I had friends who were ratted out by the DOT at a scale house. DOT man called the Carrier, told Carrier they were not doing anything illegal but I know it's against your policy. Carrier put them both out of the truck right then and there at the coop! Then sent them a bill for recovery of the truck. Makes no sense when you are hauling high-value loads especially and have all kinds of clearances. BE SAFE!!

In South Carolina under 16-23-20 Unlawful Carrying a firearm, there are 16 exceptions to this requirement and in particular exception (9) States: (9) a person in a vehicle if the handgun is: (a) secured in a closed glove compartment, closed console, closed trunk, or in a closed container secured by an integral fastener and transported in the luggage compartment of the vehicle; however, this item is not violated if the glove compartment, console, or trunk is opened in the presence of a law enforcement officer for the sole purpose of retrieving a driver's license, registration, or proof of insurance.

I don't know who this guy is but you cannot carry a loaded firearm in a storage container of you do not have a cwp it can only be in the trunk center console or glove box if your on a motorcycle it can be in the saddle bags WITH A thatch lock or luggage compartment

I appreciate your recognition of the unconstitutional "laws" passed that have in the past 100 years infringed on our rights. Namely those bestowed to us all by our creator. As stated in the LAW OF THE LAND aka the U.S. CONSTITUTION. and Bikk of Rights. It matters not what they jail you for for violating their illegal "laws". I hear you fully. We all hear them and see them doing crimes. It is time to stop it. Hold them accountable and demand future freedom of our Patriots unlawfully jailed or imprisoned for these unjust laws. When I was in the military we were not expected to follow unjust orders. Same with our police. Unfortunately many "americans" submit to government as the certainty.
