The plaintiff purchased a car from the defendant, but when he went to put gas in the vehicle, the plaintiff noticed there was a hole in the tank. The plaintiff brought the car into a shop, and they told him it was unsafe to drive, so the plaintiff is suing the seller for a refund. The defendant, a certified mechanic, insists the plaintiff knew what he was getting when he purchased the 17-year-old vehicle, and he denies owing anything.

That said, it doesn't matter.. If you buy a car you always need to check it over from front to back, inside and outside.. Let the buyer beware.. Take a mechanic with you if you must.. it is a great investment in the long run

I brought a As Is 2006 Ford Focus for $1,000 in 2018. It currently has 250k miles and starts up and runs excellent everyday! No major repairs yet.

I bought an older vehicle (2008) with only 30,000 miles. I thought that was great, however, had many issues. I was told by my mechanic that, though you would think that’s a good deal, it’s not. Older cars that do not have many miles means it’s parts are not being used as much and therefore are more likely to have problems. Never heard this before but it came from a trusted mechanic.

That can be true for sure. A car with low miles without being too low is probably better than a super low mileage car for that very reason. Seals dry out, metal rusts and even plastic can degrade from just setting. The worst thing is a low mileage car with a lot of engine run hours. Like a car that was putted around in the city without ever getting on the highway and getting fully warmed up. Almost no cars have hour meters though. A lot of newer trucks do. I work for utility company in the fleet department repairing the vehicles. They spend so much time idling that a 50k mile utility truck has the engine wear of a regular truck driven on the highway with 200k miles or more. We actually change the oil about 4 times as often as regular vehicles to try and keep them from having failures.

@@jennifermarlow. That's the truth and it's only getting worse. In the 90's manufacturing techniques became exceptional, oil quality increased and computer management of the engine meant it was always in top tune. As a result there was a surge in engine life. After working for the previous decade to assure cars weren't going to be any good more than about 150k miles they all of a sudden were going 300k and more. Anyone whose owned a 95 Buick car with a 3.8 engine or a Ford with a truck with a 4.9 can tell you that. So Ford discontinued the 4.9 and GM made sure to sabotage the 3.8 with faulty gaskets and plastic engine parts. Today it's rare to find engines that don't have some issue like bad lifters, defective timing chains and components or transmissions that barely make it out of warranty before leaving you on the side of the road. They want to make sure we have to replace our cars every few years. I drove a 1923 Model T a couple weeks ago. No frills and uncomfortable as hell but you can keep it running with a pair of pliers and some bailing wire.

Very gullible. We just had a case in my building where someone came in and knocked on doors, gave some poor sob story and got older people to give him cash, blank checks, AND credit card info!! The police came and this dude has every drug under the sun on his person, crazy cause had he not been caught you've just give this man all your banking info and he knows where you live. Crazy!!!

People don't want to spend a few bucks having a car checked out by a mechanic so they risk loosing thousands of dollars. I've done lots of pre-purchase inspections and I'm pretty sure that less than 50% of them were worth buying, including cars from dealerships.

Seems like IF you know there's damage in a gas tank, *you should disclose that* right away. If you're selling a home and *you KNOW* it has certain issues you HAVE TO disclose those in the seller's contract.

Actually, it does apply to cars as well. The judge was 100% wrong on this one. It is illegal to sell a car with a rusted out frame without disclosing it. It amazes me how this judge has been allowed to stay on air for so long after so many unlawful rulings.

It's hard to understand these plaintiffs sometimes. They can't find the time to get a mechanic to check a car before purchase but can find the time to file a lawsuit, gather evidence and show up for court? I reckon the lawsuit takes even more time. I guess they are reluctant to put in the effort till after a few thousands has been lost.

And he should've. The defendant claims to be the car guy, right? So the what car guy didn't know gasoline was leaking from the tank? The gasoline had to be leaking in his driveway.. he didn't let the plaintiff drive it on purpose. Most Laws have clauses .. the plaintiff did a bad job at presenting his case.

The judge’s job is to listen to the facts and apply the law. There are no warranties in these cases unless the seller makes a promise. This seller did no such thing. We can all speculate about what he actually knew as a mechanic or just as a previous owner of the car, but it is up to the buyer to get an independent mechanic to look at it before buying. There have been thousands of these cases throughout the decades of TPC. That is the law. Buyer beware. The Judge didn’t let the defendant get away with anything. You can argue that the law did. Not the Judge.

Defendant or “Car guy” is a total bull shitter and was fully aware of the car problems as he probably realized as he was getting car “fixed” what additional problems it had. He figured pass that problem off to someone else and say it has no issues. Plaintiff should have taken it to mechanic regardless but still selling it like there is no issues when you know there is issues is scummy

That car was definitely a lemon, but "as is" is final unless there's fraud. ESPECIALLY when you aren't buying it saftied, be very, very careful. Do all your checks BEFORE you buy it

Luminos actually really hold their value. They don't have a lot of issues the ones that they do have are easily fixable. The newest lumino you can find is still gonna Run You 2500 to 3 Grand if it's in any kind of decent shape. Even with over a 100000 miles.

I had a 1997 car that had a leak in the gas tank. It was dangerous, but I drove it regularly, and I never got it fixed. When I sold it, I specifically pointed it out to the buyer and noted it on the bill of sale. Never an issue.

People need to learn to pay the couple hundred bucks for a mechanic to look the car over. The problem with that is if you're buying something not worth alot...the you don't wanna. You should really consider the cost of a mechanic check to be part of the cost of buying a used car.

I believe the defendant might of known even though he was under oath he wasn’t going to be truthful bout knowing bout the gas leak because he didn’t want the car back or give him his money back. plaintive might’ve done better if he would’ve re-sold it just as the defendant did on most car deals they are as is . She's right.. The guy didn't even get down and look underneath the car.. He doesn't insist on test-driving the car himself. And he doesn't bring a mechanic to look over the car. After looking at those pictures and seeing how rusted it is underneath the car. It looks like two different cars. He's so busy looking at the shiny body of the car, he misses looking underneath the car. Just what did he expect? He didn't check it out... It's an as-is car .

That guy was a mechanic and admitted to working on the car, so he saw the filthy, rusty deteriorating underside before selling... and then comes on National TV and says "I thought I sold him a good car"... lol what a sneaky crook. The "As is" law can be overturned if the seller lies. The seller said he was a certified mechanic and told him it was a good car. That is fraudulent and misleading. Any other mechanic would have said that car was junky rusting piece of crap.

Plaintiff and defendant were both paid to appear, so with the sale of the vehicle to a junkyard and what he gets for the appearance plaintiff is probably only out $600 or $700 bucks!

If a family member is going to college I provide them with an 18 yr old car with a gas leak. No wonder the car was no longer needed by the family member. An internal coolant leak is an indicator that the car had a cracked head.

I’ve bought and sold cars person to person and have actually gone and driven a car by myself and the seller doesn’t even go with me, which I’ve actually been shocked when they don’t. I’ve also been the seller of vehicles and I do make sure to go when they’re driving my car. But you can’t expect someone to want to buy your car and you not let them test drive it personally.

@@hadley407 I’m not saying you cant expect that what I’m saying is the expectation that just because he had insurance he should be auto ok with anyone test driving the car is crazy it’s a private sell the person has no obligation to buy it especially if they crash it and it’s also a older car if it’s totaled he would get no where near what he is looking to sell it for from insurance …so yeah if you look a little sketchy or that I might have a issue if you mess up my car nah you not gonna drive it

Aren't there companies that offer a mechanic to accompany people to a private car sale for a small fee? Judging by this and similar shows that could be a terrific business opportunity.

The problem is even a mechanic may not be able to determine whether some part is going to give out in even in a week or 2 on a used car. Some buyers would not understand that and blame the mechanic for everything that goes wrong with the car from then on regardless of any disclaimer signed. That could be one big headache instead of a terrific business opportunity.

@@randys6220 The idea would be to point out the more obvious flaws with the car that a random person would not detect, not to OK a car. Obviously that can't be a thing unless you have a time machine and/or AI driven 3D scanner or something.

I’m only a minute in but let me just spell this out for anyone who is car shopping. If you buy a car that only cost $1800, IT’S GOING TO BE A PIECE OF CRAP WITH STUFF WRONG WITH IT. It’s just the way of the world. Stop thinking you can pay practically nothing for an old car and then expect it to run like a new car. Ain’t gonna happen.

Another case of an AS-IS sale. Buyers have to learn to spend the $100 to get it checked at a mechanic before or bring someone with you that knows about cars. It’s always BUYER BEWARE!

Judge must be sooooo tired of dealing with people that walk in with a lawsuit regarding a used car and as soon as she asks "did u have a mechanic look at it before u bought it" they ALWAYS say "no". Yet they complain the car cant be driven,too many issues,etc. Ya the one buying the damn used car without it being looked at first for "insert impatient reason here". And this plaintiff just comes off like a hot headed dumb ass with how he acting

Look up the law before you go on national tv and embarrass yourself. As is means just that, it doesn’t matter if she let you stand there for 30 mins explaining your case in 4 different languages. The law is the law and her hands are tied. bottom line…… you’re out of gas.
