The plaintiff loaned his stepdaughter money for a new transmission for her car. The plaintiff claims his stepdaughter agreed to pay him back but went on vacation to Hawaii instead, so the plaintiff is suing. The defendant admits she didn’t pay back the loan in full, but that’s because the plaintiff added on illegal late fees.

My dad was abusive even went to jail, but when I got older I forgave him and continued the father daughter relationship I ask him for money in the past but that came with a price doesn’t erase the abuse my mother and I endorse! I’ll still be scared of sudden movement and my mother will never know what a healthy relationship is.

Dude isn’t even with her mom anymore and he still helps her. Wow. My fifth stepfather actually stuck around after divorce. He is a very involved grandfather. If I ever needed money he helped me out. As long as you keep paying the bank back the doors stay open!

The defendant plays the victim. He seemed to be a caring stepfather, otherwise he wouldn't have loaned her money or helped her to get a good job. Unfortunately, like so many today, she spent money on a vacation rather than pay him back. Then she takes it personally that he had to sue her to get it back.

I don’t agree. This was a father figure for her. 23 years is a long time to have someone in your life as a parent. I don’t think it’s unreasonable to believe that once she became an adult and out of the house, they tried to make amends, the step-father probably tried to apologize by helping financially, and the defendant got confused by that. Sometimes as adults we naively believe that our parent has “changed” and wants to do the right thing, only to find out that they’re the same abusive and manipulative person they were years ago - but now it’s financially, not physically.

The defendant is completely lying. If her step-father is such an awful person. Why does she keep going to him for money (as oppose to) her biological father, her mother or her boyfriend. Now that it's time to pay the money back. All of a sudden, her stepdad is a evil person ?

I don’t think you’ve ever had an abusive parent or step parent. It’s not easy to just “cut them out” from the beginning. It’s toxic and you become codependent. And sometimes you think you deserve it. You don’t know her situation of her bio dad and if her mom has the funds to help. But yes she asked him for help, because he would. But probably having a relationship/boyfriend helped her be less codependent and walk away when she heard things that was said to her boss. It doesn’t excuse her for not paying him back. But it doesn’t make her a complete liar about physical abuse that was done towards her and her sister. Not once did he say “no your honor, not true” he just stood there silent. That’s why JM didn’t drill her hard. She knew she was telling the truth about that. And it ended up being a simple case of pay him back. Not omg you used your step father how dare you.

If she was lying about him being abusive to her and her sister why didn’t he speak up? You can have a relationship with your abusive step father mother brother whoever and still take their money to help out, and pay back monthly payments until you find out things behind your back and just want to walk away from them. She owes him money. No doubt about it. She didn’t lie about that. She gave receipts from Jan-June of payments. She didn’t lie about that either. She said she had enough and didn’t want anything to do with him… she stopped paying for 1 month (august) and got the letter from the lawyer in September.. but it was for double the amount cause he’s claiming she only paid $600. Even though she had checks each month that amounted to over $1100. Soo… who’s lying?

Way to lose a father figure for a man you will not stay with for long. You definitely wanted a relationship when you needed the cash, yet are easy to walk away. You get what you give, and it looks like you're gonna end up with nothing.

I’m not sure I agree. She made all those payments right up until he tried to make her pay late fees. And she paid the previous loan back fully. She got some bad advice for sure, but I don’t think she’s ungrateful.

It was disheartening that JM didn’t allow the plaintiff to defend himself from those pretty hefty allegations. She didn’t ask him any questions about it, and I understand that the case wasn’t about that, but the dude is on national tv. Our society is notorious for “guilty until proven innocent” nowadays so it really sucks to be him in this episode.

The abuse was addressed as the judge clearly asked for more information about it and victims of abuse will often attempt to retain a relationship with their abuser, especially if the relationship was significant. He practically raised her so it’s not unrealistic for her to attempt to retain a relationship. It’s also not uncommon for abuse to “change” when they have lost control of their victim in order to lure them back into the toxic relationship. Any book, blog, or tweet from reputable victims advocate will tell you the same.

I'm not trying to hate too much on Judge Milian, but most judges in a real courtroom inside of a real courthouse, would not ask all these personal questions, but would much rather get to the point of why she hasn't paid the money back and then make a decision. I've noticed she's done this on many different cases throughout the years. I guess bringing in these people's personal business helps with the ratings.

People who owe money ALWAYS say 'I had every intention of paying it back', yet they didn't, and when the lender dares sue them, then they don't appreciate it, yet it never occurs to them that the lender doesn't appreciate it that they aren't being paid back. She doesn't know just how lucky she is to have a step-father that loves her, some biological fathers don't even stick around that long...

He’s clearly a manipulator! He wasn’t mad about the money, until she went to Hawaii, which she did WHILE actively paying back the loan. She stopped paying when he decided to unlawful require “late” fees that he wasn’t entitled to. He sued her because he could no longer control her. That’s not love, that’s manipulation. He won nothing, he only got what she was already willing to pay in the first place.

@@gprincess428 You sure have drew a lot of assumption from a 10 minute case. Didn't hear anything indicating control and manipulation on his part. If anything, the defendant could be seen as the manipulator. Also, he said she went to Hawaii a couple weeks after the loan. She didn't start repaying until two months after the loan. It often upsets me when I loan people money for an emergency and they make big purchases and/or are outliving it up yet haven't paid me back.

She did confirm it was a lone and still had to pay the money, she said she had intentions of paying it back yet said to the judge a lawyer told her she didn't. It does happen but it’s rare. The update would be provided by Harvey afterward. Sometimes a quick comment or a whole story, like the guy who sued a used car dealership and the dealer offered to provide him with another used car when he was in the hallway after the verdict.

Another thing that I found absolutely ridiculous was when the defendant said her relationship with her stepfather was over and that she had every intention on paying him but he brought her to court.... did she forget what she told the judge while she was in the courtroom? Because she said she consulted a lawyer and the lawyer said to stop paying because if she continued paying it would be an agreement on the late fees so she's a damn liar when she says she had every intention on continuing to pay him! And because she reneged on a loan that she agreed to now she's going to X off her stepfather and have no relationship with him! I guess it's true what they say no good deed goes unpunished!

She had every intention of paying just the amt that she owed, which is exactly what the judge ordered her to pay (plus his lawyer fees). Judge denied him any late fees, so she was somewhat right. She just got bad advice from the lawyer, who told her not to pay.

Maybe we wouldn’t have all of the problems that we have now with these disrespectful kids if we went back to spanking. My mom spanked us as kids and we turned out perfectly fine, as did my kids.

I have one rule with money. I never loan Amy amount of money unless I am willing to never see again. That way I never have to worry about taking people to court. If someone doesn't pay me back on loans I will never loan them anything again. Make life simpler by not putting yourself in these situations.

She'll regret it. And thats reason some men refuse to date single mothers they pour their money, resources and emotions on the children only be seen as less than. She'll ask him for help again snd he'll probably help her as he'll still consider her his daughter. Ps: dont take money from people you dislike, keep the same energy.

It amazes me the people who take thousands of dollars and don't pay back. I have a small family and we struggle from time to time and only have each other. She's not even his child. We all go through fighting with parents as kids. He was good enough to take the money from but now he's a abuser because she owes him.

Sigh. This only strengthens my resolve to never lend money to friends, family , coworkers or church members. If they need help, and I'm inclined to help them, then it becomes an outright gift. While I'm not defending the daughter in her position of refusing to pay anything based on bad advice, the step-father could have looked at which was more important - rebuilding relationship or the money. Since it was over the $600 annual limit, he could have written it off, and issued a 1099-C for cancellation of debt. It would become part of taxable income to her when she does her taxes, and while he wouldn't have gotten anything for it, it could have been a write off for his business. But in the end, especially when it comes to family or friends, sometimes writing it off and focus on the rebuilding of relationships, is worth more, especially if one made the stupid choice of giving a loan in hopes of leveraging gratitude.

People kill me frfr…how do you cut someone off after you fail to repay your debt back in a timely manner, & then in this specific case stop talking & communicating w/ ur stepdad & also decide to go on a vacation while you still owe him thousands if dollars? This didn’t look good for either litigants. Judge asks irrelevant questions to defendant about the case, where defendant states he was abusive , but she has no issues borrowing money from plaintiff? I wanted to here about the trip to Hawaii , that was more relevant than other question asked. I think she just got tired of hearing about the money owed and told him sue me and he called her bluff,and you can bet her boyfriend had everything to do with not paying him back.

Everyone commenting sarcastically that the defendant accused her stepdad of being abusive as a child AND asked him for money as a 33yr old adult, are extremely stupid and lack understanding of complex family situations. Just because money was exchanged, it doesn't erase the possible abuse. Sometimes victims feel they're owed a lot from their abusive parents so they keep taking to make up for past traumas. Sometimes parents who know they were abusive, try to make up for it with money or materialistic items. I believe the defendant here. The fact she cut him off and didn't want a relationship and still doesn't want one speaks volumes

That stepdaughter has a lot of nerves. On at least 2 different occasions, she came to him for a loan, BUT now all of a sudden, he was such a terrible step dad growing up.
