But in what circumstances will rights in rem capable of affecting third parties actually affect these third parties? We need to look at the further conditions the law has to determine when rights in rem actually are enforceable against third parties
In terms of our current context: In what circumstances will rights in rem over an unregistered freehold estate in land bind a transferee (purchaser/donee) of the freehold?
