Subscribe to my personal channel for videos on how to study law effectively & efficiently: / @heygarethevans There are two parallel regimes of land law operating in England + Wales. The first (and more important) regime governs freehold and leasehold estates in land which are registered with the Land Registry. Land Registry lists all the freehold and leasehold estates over land in England and Wales along with the current owner of that estate. The second regime (and our focus for this video) governs estates in land which are not registered with the Land Registry.
In the present day, around 95% of estates in land are registered. This is why the registered regime is more important. This figure is gradually increasing due to voluntary (LRA 2002 s.3) and compulsory (LRA 2002 s.4) registration of title. Within the next few years every dealing with land will involve a registered estate and the unregistered regime will be redundant Compulsory registration of an unregistered estate in land can be triggered by a number of transactions listed in LRA 2002 s4. The most important of these transaction triggers is the transfer of an unregistered estate e.g. if I sell my unregistered house there is a legal obligation for the new owner of the freehold to register it or even if you simply give it away.
But for now there is a residual need to understand the unregistered regime!

Fantastic information, which has enlightened me. I am not in conveyancing or law, but find myself purchasing an unregistered property, where the Epitome of title is being transfered between solicitors. It is great to now actually understand what is happening :)

i found some interesting writings about "money" and the need for something that can be used as money. my summary, which off course there is much more in-depth parts to this writing but i think it is not suited for this comment or video, to the point it was stated in the 1800, that gold and silver can be money, but money itself cannot be gold or silver, it was said that since everything known or unknown originates in one way or another from the LAW which is available, that being, Land Air Water. it was said that this LAW is the source of the commercial commodities which generates the need for money to contract for commodities, but the LAW available and the commodities it can provide is no use unless there is a method to convert and transfer the LAW into commodities that can be contracted for Money. the LAW itself can not be used as money because there is no availability of movement per say. Therefore it is reasonable to conclude that the only reasonable money would come from the man who can control the LAW and extract the contractible commodities from it that generate the need for the money that is used for contract of the commodities. Therefore the money is man , man is a Credit to the LAW (being Land Air Water), and if man can be controlled or tricked or deceived then by his will the credit man has given to him as equity in the land can be funnelled into our crypt as gold and silver and all other commodities that can be produced. does this summary sound like this is what has happened in our commercial world ? do you know if we as men and women " birthed" into a register, that creates a legal entity that has ties with being registered as Land. Since legislation defines land as amongst other things, "estates" and using trusts and probate retains the credit owed to the man by Forms ? or is this sort of statement, bogus and on par with a conspiracy stuffs?

Hi Gareth I'm wondering if you can help me please, I've currently taken over a pice of land that is un registered ive made the relevant enquiries to the land registry and they have no information of anyone who owns or previously owned the land, i personally know of nothing happening with the land for around 30 years hence the taking over, what is the procedure to legally claiming the land as mine, i.e how long do I have to be on the land for etc etc thanks in advance.
