From the travel ban injunctions to Youngstown v. Sawyer, judicial precedent backs intervention in foreign policy if laws are disregarded and citizens face harm. 4️⃣ Foreseeable & Immediate Harm Legal grounds strengthen when there’s clear evidence of direct harm to U.S. citizens. If government actions contribute to imminent risks to citizens’ lives in conflict zones, courts can issue injunctions to prevent foreseeable harm, aligning with their role in safeguarding rights. 5️⃣ Ethical Responsibility & International Human Rights Standards Beyond statutes, the U.S. has an ethical and legal commitment to avoid complicity in human rights abuses. Courts have upheld accountability, even internationally, under the Torture Victim Protection Act and other human rights statutes. Courts could argue that preventing arms exports to violators aligns with the U.S. stance against enabling atrocities.
