You know, that "You can steal our videos" is great for new guys wanting a bit of B roll to make up a video. There are a few guys in the gardening area (including myself) that have a similar outlook. I usually reach out before using any content just to be safe. But seriously, some people are just too precious about their videos. The fair use thing is so skewed. People can just play your whole video and go ooh, Ahh, No way! and it's ok? But others get pinged for a few seconds of attributed footage.

I found most of my favorite channels via mentions in other channels, including attribution for clips. Sucks because I really wanted to watch that video, but didn't have time. I got into 3D printing specifically for prototyping and fixturing machined parts, but ended up with a small print farm, and now I sell plastic parts, too. Unfortunately, you don't offer ASA or nylon through teleport yet...

I found the video in question, i didn't realize they performed so poorly on this platform. Having been involved in the 3d printing industry as a professional and hobby user I'm familiar with their work which is good but i can't image all of their effor even comes close to paying for what it cost them based on how many views they get. I very much agree with the concept that collaboration will get you much further than protectionism and isolation.

I just use m4 bolts personally. Just because they are a decent size to handle and dont get lost everywhere. Also if you thread holes in the plastic an m4 can hold up to at least some degree. Even m3 often just strips.

26:20 Most youtube content creators I follow would have preferred someone reaching out about the problem before claiming a copy right issue or strike. I agree that their request was short sighted and should have been a “thanks for the shout out but can you ask us first”. I think most creators would prefer the email requesting clips be removed compared to a copy right claim or worse strike

I agree with most of your general sentiment, but I have a couple issues. First of all, if what you did is fair use, you didn't need to ask permission. Therefore, you didn't do anything wrong by not asking for permission. So you have to pick which side of this you are on. Was it fair use and you didn't need to ask for permission, or should you have asked for permission because it's not fair use? Further, just because they requested you to take down the video, if it was fair use, you didn't have to. Doing so was essentially a gesture of good will. Basically, you have to pick a position here and stand on it rather than trying to both sides. Fair use means no permission is necessary. If it's not fair use permission is technically required. So which one was it? That's all. The second issue I have is using the argument that just because you are a larger channel that brought them a lot of eyeballs means what you did is okay. I'm not saying you are 100% justifying it using that logic, but you were saying that they should have done what you would have preferred simply because you are larger and helping them out. Again here it's kind of a both sides argument. It's about the principle of the thing. If it wasn't fair use, they have the right to ask you to take it down for any reason and it doesn't matter how large you are and we should all support the fact that even a small channel should be able to remove their content from a large channel. If it was fair use, it doesn't matter how big either creator was, it was fine to use their content. So again while I generally agree with you and it sounds like what you did is fair use and you did not have to take it down and they should have let you keep it up, I do think you need to figure out exactly which side of this you are on when you make a video like this and speak so passionately. Edit: Lastly, I don't think you are correct on how most creators view content. I'm a creator and I know quite literally hundreds of others. None of us want people to use our content constantly without permission if it is not fair use. For example having an entire short form video stolen and posted with credit does almost nothing for us even if the page posting it is far larger. That's stealing our work. Stealing our labor. Fair use, as outlined above, is fine. If someone wants to use a clip from my videos or even do a full reaction, sure. That's why fair use matters. Which leads me back to the original issue. Was your usage fair use or not? Stand on that. Acting like the end product has no value ignores all of the labor that went into the end product. The issue is not someone taking a digital file, it is their profiting from our work. If it's not fair use, yes I expect them to ask for permission and yes I will determine if their usage that isn't fair use is alright or not and if I want to request a takedown. You're speaking for too many people with your own situation here. The collaborative mindset absolutely matters, but there are major boundaries between collaboration, promotion, fair use, and content theft. Content is our work. It's not okay to steal it for your own profit.
@j.f.christ84219 күн бұрын
Fair use is a bit rubbery. Suppose you did a product review, and I took your video and simply added a few "yep, I agree" reactions in there - is that ok? But hey, I paid you in exposure 'cause my channel is bigger, right? Go do your own review. This dude should have done his story at the factory. Other channel should have been asked, and they responded nicely by not filing a copyright claim. Dude's a dick, check the Glassdoor reviews.

@@j.f.christ8421 Totally agree with your opening sentiments. It can unfortunately be a big gray area. That's part of why I say he has to make up his mind. Either what he did was not fair use in his opinion and therefore his rant is not justified, or what he did was fair use in his opinion and that's why he is ranting. He can hate the concept of fair use in general, but then the rant should be about that. Is what he did right or wrong? He waffles far too much for me to even know his opinion. The rest of the tirade is justification and minimization for doing something that could be wrong.

In my opinion, if an original author/company told you not to use their content, you should not vent for ~20 min, especially when you agree that you've made a mistake and did not ask their permission in the first place. I think you've done everything alright (you deleted your video once you had received the email from their company) until the renting part. In my opinion (be free to disagree if you want), it'd have been better if you'd calmly informed your viewers that you removed your video, because some company had told you to not use their content; and also provided *a list of lessons* of what you've learned. Because in your chanel you teach people, and this is a great opportunity to show people how to improve (instead of yelling). Because it does not matter if: * your actions helped them, * you have more viewers, * your goal is to spread knowledge about 3D printing, * ect. If they do not want you to use their content, that's their right. Maybe they made a dumb mistake, maybe they are stupid and do not understand how to increase their viewership or maybe they have other reasons that only they know of.

@@802Garage He took the footage rather than go film his own. That's a bit dickish, fair use or not. Suppose you reviewed a product and I replaced your voiceover, is that fair use? @@802Garage The video was essentially "Here's how this company uses jigs!" and then took as much footage from the other video as possible rather then go film his own. He wasn't using the footage to critique what the other channel had said, but to make his own video. Like sampling in music, not cool. 20 seconds from the video, plus a few other channels plus his own? Yeah ok. Everything from the other video? Yeah nah. Ranting Speed, Mr. Sulu!! I agree that collaboration is more valuable than protectionism pretty much in any context. I also agree that in this recent situation, the other company has acted foolishly. I don't agree with your decision not to try and work with the first company, though. In that early situation, you f*cked up, and they slapped you for it. Holding a grudge about it is just being petty on your end. From their perspective, there's a lot of people out there who grab creative work and re-use it without ever acknowledging they didn't create this in the first place. And that just burns when it happens. So I think it's totally reasonably for the first company to have gone "oh, look, it's another small-time asshole, hunh. Well, here's a copyright strike, asshole, next time do better." And since you just finished ranting about how you don't have the time to waste chit-chatting about the "right" way to use clips from your videos, why are you assuming they did? Sending a strike is quick, easy, and takes almost no-time from the actual decision maker. Having a chat with every newbie on the block is none of those things. "blacklisting" them for treating you like an asshole when you were *being* an asshole is just sulking. But to repeat, in this recent case you weren't. You made sure everyone knew where the footage came from. Now, it does seem very possible to me that there's a quirk here because of the sponsorship and because the footage came from inside another company's facility. It's very possible that the terms of the sponsorship or the terms of access to the factory included a condition that the resulting footage wouldn't be shared around. If that's the case, then the smart thing for this video producer to do would have been to *tell* you that when they asked you for the takedown, because then all this bad blood wouldn't have arisen. So functionally, it doesn't matter if there was some such restriction in place. But still - it seems possible, and I at least feel better about bad situations when I can see why the other guy did it. And while I'm not a lawyer, I did work for most of a decade for the Alberta Department of Justice. I agree that, in this recent situation, any suit they'd try to bring likely would have failed because a civil suit can only recover the actual harm someone's action caused, and you would've been able to establish that no actual harm occurred. (Oh, and now I've learnt a thing about all those shorts I see here where someone seems to be just straight up ripping off another video. If TikTok automagically puts in the attribution, and then that gets lost in the cross-post, then that explains why there's so much apparent assholery in the shorts; it's a translation error, not malice.) Last thought: you've now just made it impossible for anyone to actually steal your videos, because you can't steal something if you have permission to take it. :D
