Mt Kirk, what a nightmare it would be. I was unaware that we are not obligated to stay on the phone with 911 dispatch. In a high stress and emotional situation I can only imagine what we could say that may be construed in different ways. Thank you for another valuable lesson in our legal obligations.

Massad Ayoob says to point our witnesses, point out evidence.. but here's where you can tell he's not an attorney but trying to play one.. he says tell the police you're willing to sign a criminal complaint. In an emotionally charged situation, first off few people have the presence of mind to do all those things. Secondly, even if you did, you'll sound weird, maybe suspicious because normal people after just shooting someone aren't going to start spouting legal-ease about signing a complaint against the perp. Cops are good at finding witnesses and evidence on their own, and there's plenty of time later to ask if you want to press charges if the bad guy lives. I agree here, when in doubt, KEEP YOUR MOUTH SHUT. The worst thing you can do is tell the story of what happened because heaven forbid you then tell the story again later, WHEN (not if) you say something that doesn't perfectly match the story you originally told they will use that against you. Prosecutors love to say well he told the police X, now he's telling us Y, which is it? He can't be believed. Great advice as always Mr Kirk.

Just to add, should have Concealed Carry Insurance as well. Law Shield, USCCA, Right to Bear Insurance, CCW Safe. I know US/TX Law Shield has lawyers on-call. And they will answer on emergency/nonemergency and general questions. It's invaluable to have that because people are crazy and prosecutors sometimes ignore their own laws of self-defense.

Excellent after-the-fact info...as a retired USN I'm trained in the use of a firearm...and ready to take someone out if necessary...that is military...but this makes it clear exactly what is best practice in the civilian arena...with no "chain-of-command it is difficult to know what one should do when knowledge of who to ask is unavailable...so thank you for this info...

Awesome content! Extremely and potentially life changing information here. In a linguistics course I took in college my professor did a section on how our words can be misconstrued to mean something entirely different or be used against us. In this section he talked about Miranda rights and statements to police. He heavily drove in the point that anything you say “can and will be used AGAINST you” not that it can be used in your benefit.

The Police NEVER charge anyone, rather it is the Prosecutor who makes the charging decisions.

@@WashingtonGunLaw The prosecutor doesn't arrest suspects and relies on the police to begin the process. My statement is that innocent people are still arrested and needlessly tossed through the system in this state. In Texas if you have a CCW, the police would be on your side unless evidence shows otherwise. Additionally, you might be given a court date for a hearing you will need to show up to if the prosecutor to decides to go to trial.

I would think, that as a responsible gun owner, there is a moral and ethical duty to carry a trauma kit and attain some basic first aid training to stop bleeding. The basic idea of self defense is to stop a threat not to be a vigilant. However with out the ability to restrain somebody that just threatened you with serious bodily injury that could also be rather dangerous. And if you are carrying a trauma kit you might appear rather gung ho to use a fire arm. So what makes sense might not be a necessarily a good idea.

@M M Actually Mr. Kirk did a video on that and Washington State law has certain protections. One allows you to recover all your legal fees in the event that they attempt to prosecute you and you are acquitted. Also keep in mind that if you kill the aggressor, the family could still sue… so “killing” them does not protect you. That said I’ll assume you were being sarcastic.

@@jimmercer1961 Vigilante is a word that carries certain connotations: like the notion you 100% have to rely 1st on Law enforcement/EMTs. Rittenhouse case shows that isn't really the situation and even in Washington State if some 3rd party bystander witnesses somebody being mugged at knife/gunpoint they can shoot that person legally. DO you call that being a vigilante or being a helpful member of society? Either way being, it doesn't require you to have compassion/sympathy for the perpetrator who forces you to use lethal force in self-defense. That kind of goes against a large portion of history, where before 1900s you see the enemy as an enemy and mercy isn't really expected. In such a case it would be one of the rare ones where I'd actually call 911. Let your servants (the gov) sort the BS of the person's health out: if you just concluded moments before shooting them that you were OK with removing them from existence to deter what they were doing it isn't wise to go back on that logic and save them yourself.

Thank you for another great vid. They are tremendously helpful. Given the scenario presented, if the firearm has been secured in our vehicle or home what do we do when they ask for it? It seems like giving them your keys AKA permission also enables them to search without having to obtain a warrant. They will likely not allow us to retrieve it ourselves as it's a safety hazard and going into your home accompanied by an officer is giving them permission to search. It seems leaving the firearm out in the open, which is effectively unsecured, is also a sub-optimal choice. I don't have anything to hide, being a responsible and law-abiding citizen, but I won't undermine my/our rights by enabling them to circumvent due process.What would you recommend?

I noted that the video did not mention contacting an attorney on site or one of the many prepaid legal plans.🤔🤔🤔 The disparity in process between how citizen involved shooting are handled and how they are handled when the a LEO is the shooter makes me think there is a need for congressional review. Other than hypocrisy, there isn’t a justification for the two well defined policies/procedures to be worldly different.🤡

Serious question, I carry right appendix, I also use a cane to be ambulatory and the cane goes in my right hand. Can you see the dilemma I have with holding both hands above my head if ordered to? I hope I never get shot by cops after defending myself legally because I use a cane in my right hand.

Tell the 911 dispatch of your situation and that the weapon has been placed away from you on the ground. Alternatively, find some object to lean up against while raising your non-cane arm in case the police insist you somehow drop the cane despite your calm request. If you can sit or kneel prior to their arrival and raise both hands that way, maybe that would help as you walk them through your disability?

So what if this happens to a person with medical needs (i.e daily medical issues I.e meds or procedures) that could be life threatening if not met after being taken into custody (even though innocent)? Does the arresting agency have a responsibility to make sure medical needs are met until you are released?

Yes they have an obligation to make sure your medical needs are met. But, practically speaking, innocent or not everyone involved with incarceration will treat like you’re a criminal and many of them will be low on empathy for you or your needs.

While I don't disagree with your reasoning on police booking the shooter into jail while things are being sorted out, this seems incongruous with how the legal system currently operates in light of the war in cash bail and perps being released within minutes or hours for most crimes.

So we've used our firearm 100% lawfully in self-defense: out of interest, what law permits law enforcement to disarm you (as your constitutional right is still to 'keep and bear arms', it doesn't temporarily go away because somebody 'thinks that maybe' a crime was committed? ^^Further related I am truly wondernig if it is still reasonable for law enforcement to think that a crime might have been committed if the victim (and shooter) calls in to report you've been the victim of a crime and used lawful self-defense? You've informed them that you were acting lawfully, that you were actually attacked. All the information is there, so if they think about the 'other possibilities of what the situation could be' that is more on them right? So ultimately, NO crime has been committed by you and you've already informed 911 of the very basic facts of that. In fact LEOs when arriving if they paid attention to the 911 report should be asking you if you want to press charges (if the perpetrator is still alive), because you're the one that called FOR THEIR HELP. If the perpetrator is deceased (so you pressing charges isn't really useful) then the only investigation they could claim to have is into the untimely death of the perpetrator. You're 100% innocent until proven guilty, and I don't see a LEO arresting you just because 'somebody' has been shot is reasonable. 911 has the basics from you, which may (depending on if bystanders were around) be the only report they get describing anything beyond a gunshot, so that'd be all the LEOS were working off of, and so I'd argue that 'probable cause' that you committed a crime doesn't exist. Arguing that because of the severity of what happened (somebody getting shot/killed) means that info in itself is the 'probable cause' would be incorrect: people get shot by accident cleaning weapons, at ranges by accident, and of course when somebody is using lawful self-defense: so its a logic error to assume the worst in that; because by doing so you are in fact then assuming (ignoring the evidence at hand and 100% making your own guesses) that the victim in fact committed a crime. ...Basically in the ideal world (and maybe laws need to be passed to help protect ppl who use lethal self-defense) you should be able to just call 911, give them the info WGL describes, and continue about your business: because no crime was committed you shouldn't be restricted from traveling (a right), (questionably) illegally detained for questioning, or even need to get an attorney (which ultimately is then a forced cost to you, cuz the perp prob doesn't have $)...As I type this out I realize that YES, we NEED more laws protecting the victim that uses self-defense in these cases: both from the detainment by LEOs and from facing any civil/criminal liability (no case should be able to be brought against them)

Seriously? Only first statement. Responding Police d not KNOW you are good guy. Even if they know, trust you personally. Did you do things right? It stinks. But once things are safe. Realize you are along for the ride. You do. NOT have ability to change course. A favorite tactic to scared kids, or adults. “You didn’t mean for anyone to get hurt, you want to go home….just tell me what happened, & I can help you get home tonight…”
