Otherwise, supporters or the nation has no idea where the money went. A candidate could take all the money and merely say he spent it under the table with no justifications. Candidates could live off of running for office with no real intention of running. They simply claim they ran out of money and are forced to suspend their campaigns, then live the life of Riley.

So, let me get this straight. Lawyers are going to try and argue it didn't happen. But if it did happen, it was Cohen and Trump knew nothing about it. But if Trump did know, it was nothing to do with the campaign, because this thing he denies doing is something he did lots of times over the years. Glenn Kirschner did a video about this type of scenario, his example was cases where there's a killing and the defence argues it wasn't the defendant but if it was it was self-defense. He said it never works. I would think he's right, I can't see the jury buying a defence that basically asks you to choose any possible scenario other than guilty. You may be able to convince them that one story is plausible, but as soon as you give various alternatives they know you are lying.

Ari, that articulate legal analysis was very informative, thank you. There was so much detailed evidentiary legal strategy there (factual vs. legal defense), I needed to listen to it twice. 🙌 I will add my 2 cents that, trials "should" be about facts, as you say, or the truth, however, my cynical experience is that it's simply about a version of the facts/truth and comes down to what is "provable" beyond a reasonable doubt. It's a sad "truth" about our legal system.

The issue was using campaign money. So no, it would have been fine to use cash if it was from a personal account.

Not from Cohen because it was still too large an amount to legally contribute to a campaign and the purpose was to benefit the campaign. If trump paid the cash himself that's trickier. If paid to benefit his own campaign I think he still has to report it accurately or it violates election law.
