Earlier this year, the Supreme Court issued guidelines to curb the alleged misused of Section 498A of the Indian Penal Code, meant to deal with cases of dowry-related abuse. While men's rights activists claim the law is a tool for extorting husbands and their families, women's rights activists feel the dilution of 498A will be an attack on gender justice. On this episode of We The People, we ask: Is 498A really the most abused law in the country? With no bankable data on the level of abuse of the said law, did the Supreme Court jump the gun with the July ruling? Will the top court, in its upcoming review of the law, be able to find a middle ground between the warring groups?

I witnessed the misuse of 498A. If they say if it protects women from harassment?? Why do women ask huge money by filing 498A??? It's not harassment is it . Ask these questions to all those great women who talk loudly

The problems of these kinds of debates is that often the anchors, who are actually supposed to mediate the debate fairly, are biased towards one side of the debate. Anchors should approach these issues from a neutral point of view. Unfortunately that doesn't happen at all.

You won't believe that women are abused unless you see female abuse in person? The definition of patriarchy is "a system of society or government in which men hold the power and women are largely excluded from it.". Section 498A gives married women the power to get men and anyone related to them arrested on a mere allegation and the onus of proving their innocence is on the accused (men), meanwhile, men have no such non-bailable, non-compoundable section, something in the lines of a "False Dowry Allegation Law", with a mandatory defamatory fine and punishment associated with it, how can we even contemplate calling the society we live in today highly patriarchal, it may have been the truth when the section came into existence but female literacy statistics has had a 30% growth since then and many women have also entered the workforce. What baffles me is the very thought of making the offense bailable provokes a huge outcry from the Lawyer, probably because of the existence of a nexus of a small yet significant group of fraudulent complainants, lawyers, and investigating officers who make a quick buck out of these cases.

The supreme Court has made observations after dealing with case after case taking into account factors such as evidence on record amongst so many other important factors, what report do you actually want if the honorable court says this in it's observations after actually having first hand knowledge in this regard? Claiming patriarchy is getting very old way of diverting the issues men face and the fact that women are equally capable of misuse of laws and power, don't play the innocent card just to further your interests, cause you'll will cause much more harm than good to women by playing the innocent card.

One thing every boys family (should be made compulsory law by govt) should do is to ask the girl family to provide an affidavit including the list of gift or if any cash or jewellery they are giving to their daughter and to be husband and submit 2 copies, one in police station or family court of girls home place and other in boys home place and the same should be done by boys family as well this will also be helpful in mitigation of harm such cases

Of course, there should be amendments to 498 A and investigation before a rrest, not instatnt one. But if the law will be abolished at all, what about real victims of violence?

With due respect, nobody is advocating complete abolishment of 498a. The discussion is whether it should be ammended to put the required checks and balances so that its misuse is stopped.

Parents on girl side most of the time gives domestic violence a name of Dowry harassment. In India, domestic harassment most often put blind blames on behaviour of daughter in laws but dowry harassment allegations similarly put blind blames on boys side family. Dowry harassment news tags makes the news Catchy too. Reality in most cases I find that the traditional conservative family in India is not able to accommodate an independent thinking educated girl in their family and we see domestic violence post marriage. Both side Parents not matured enough to handle this or ego of both side parents worsens the situation. There are torturing parents too on boys side who wish to keep their educated daughter in law as kaambai…while torturing parents on girl side too who plays all strategies to single out boy from their sister, brother or parents….we need to accept both practices prevailing today…..Parents shall never marry their daughter to a family who makes dowry demand……Girl shall never think that failed marriages is the end of life…a successful life exists too after coming out of a failed or toxic relationship and giving life 2nd chance…no need of suicide. There are some reality in our society today that girl parents try to lure boys parents with expensive gifts money vehicles to marry a high earning good looking boys. There are several low earning ..ordinary looking boys struggling for their marriage…In today’s society rich parents shows their financial strength to society by offering or taking too large cash and expensive articles as marriage gifts on girl and boy side respectively. Change in mind set of people and society required to tackle and handle this social problem and it will take time….but girl should never take such an extreme steps.
