We The People: Is Death Penalty A Deterrent?

February 1 - that's the day the four convicts in the Nirbhaya gang-rape and murder case are to be hanged to death, instead of January 22, the date first set by a trial court. The four men found guilty of the rape and brutal murder of a 23-year-old paramedical student in the national capital seven years ago are to be executed by the state at 6 am on February 1 in fresh warrants that were issued hours after President Ram Nath Kovind rejected a mercy plea filed by one of them, Mukesh Singh. The new death warrants or black warrants are dated February 1 because according to the law there has to be a gap of 14 days after a mercy plea is turned down, so those on death row can exhaust all legal options before one can be executed by the State. The three other convicts have yet to file their respective petitions, which they may do at any time prior to their execution. However, remember that each time a petition is filed and rejected that 14-day period must be observed, thereby prolonging the execution. That's not all, on Monday, the Supreme court is to hear a petition by another one of the four convicts - Pawan, who claims he was a juvenile on the date of the crime and should be punished according to juvenile laws. These developments in the Nirbhaya case have now revived the debate on whether death penalty should be retained as a punishment for murder under the Indian Penal Code? And we are asking tonight on We The People whether the death penalty is a deterrent for rapists?

I do not agree with the hanging . Everyone has to die one day or the other. There is trouble death penalty for a while they will also dying but this is not a civilized way of punishing through death penalty. Instead of hanging, be given life imprisonment for whole life, so that he will continue to yearn for one minute of his life. According to the rules of nature, they also have to die one day. Therefore, the culprits should be sentenced to life imprisonment in lieu of capital punishment and they should be banned from visiting their relatives, friends and any other outsiders in jail. Perhaps life-long imprisonment will be decent in place of hanging while one day they will also die.

The criminal also has his own family, he also has parents and children. So when a criminal is sentenced to death, his death is like a nightmare for his family member. His family suffers more than that. So instead of sentenced to death, full life imprisonment would be an option for whole life suffering.

Interesting to hear the convicts mercy petition, but even after all the torture and time in jail he still had no remorse as per the 'India's daughter' documentary, study of convicts is very much needed to both prevent crimes as well as ensuring speedy justice

NDTV should rename itself "Charitrarupi Chachi Channel" and one each of these rapist-killers should be sent to Ravina Kohli and each of the NDTV Auntyjis' homes for them to be rehabilitated. Also, please designate Guptaji as Chachi Number 1. Gupta Chachi could join with Arvind Kejriwal and start a tailoring shop for these four along with the one who got let of, and they could canvass among the other Chachis for business. Perhaps, Vrinda Grover and Indira Jaising could be the first clients?

Hanging a person necessarily does not aim at deterring potential murderers. It is a punishment for a person who committed a murder falling into the rarest of the rare category. The Nirbhaya case will not meet the ends of justice if the quartet is not hanged. There is no substitution for death penalty. Abolishing death penalty in a country both vertically and horizontally, will be counter productive. A sexually immature society like ours will have a spike in all crimes if such a deterrence is removed. Even in USA, there is a çontinuity of death sentence. All these so WC seat experts will fight for justice if they are just interrogated by police. Are they joking when they promote abolition. It is their class which will really benefit from such abolition

Yes it is a deterrent. The only problem is that the culprits always have used the loopholes, corrupt judiciary & the Political hands to delay & evade the punishments. Once the above factors do not play , capital punishment shall deter those who plan for a rape or murder. Those who kill others in an outrage, which is too low in overalls, cannot be deterred by any thing.
