"I'll sue ya if you even look at me funny" could be a reference to Prince, who constantly rejected Als offers to parody his music. At one point when they were both supposed to attend the American Music Awards, Prince had his lawyers send a letter to Al, telling him to not even look at Prince in the eye.

The truth is that she chose to place a 180 degree cup of coffee (in a paper cup) between her legs while being a passenger in a car. She spilled the cup into her lap. Her attorney argued that since is was hotter than a "normal cup of coffee" (175 degrees) McDonalds was negligent. Her injuries were real and sad but it wasn't McDonalds fault. Regardless of how painful an accident is, accepting responsibility, rather than blaming others for your choices, is the right thing to do. That's the whole point of this parody.

Rage Against the Machine is not necessarily factually inaccurate. The band's political views might be too quixotic to have much relevance in American politics but in mentioning power being in the hands of too few people they were not necessarily wrong. Clarence Thomas and Antonin Scalia were on the Supreme Court at the time this band was together. They split up in 2000 so the band had no way to know that Bush would get less than a majority of votes in 2000 and still win the electoral college or that the same would happen in 2016, in fact Trump got 303 electoral votes although Hillary Clinton beat him by 3 million kn the popular vote. The United States has not had the kinds of purges that Stalin and Mao created in their respective countries. In some ways, Josef Stalin was responsible for more people dying than Hitler was. For that matter, Mao's Great Leap Forward led to 30 million people dying either from starvation or from being executed due to the purge of "landlords." The landlords in the PRC were farmers who were punished for being more successful than their neighbors. If you look at the historical injustices, you can certainly make an indictment against the United States but some people simply disliked the band Rage Against the Machine for its supposed inability to convey a coherent message or for trying to send too many messages at once.

To those who discuss the Liebeck v. McDonalds case (1984) below, Ms. Liebeck became the poster child for American lawsuits gone haywire--unnecessarily so. There was great vitriol and spite for this poor soul. Most people don't realize that this martyr (she became one in that case) is responsible for the cup holders in our cars today. Thanks to her bravery, we don't have to risk the same, painful fate--and YES (!) it was quite painful. I saw pictures of her THIRD degree burns, which required she undergo an operation. At the time of her painful and quite serious injuries, there was NO place to put the cup due to the car-design (and car designs, in general). Moreover, the car was parked--NOT moving. She was the passenger. Originally, she ONLY wanted McD's to pay her medical bills--AND LOWER THE COFFEE TEMPERATURE, which was HOTTER than industry STANDARDS. That's it! They arrogantly refused to respect her wishes, and she pressed on. McD's REFUSED to lower the temperature notwithstanding the fact that HUNDREDS of people ALREADY gave McD's notice that they were injured during a given time--when the injuries were recorded. And, by the way, NO, Ms. Liebeck did NOT gain millions of dollars. A trial court judge reduced her original verdict amount--given to her at the hands of a horrified jury to ONLY $640,000 (having seen the pictures, you know what I mean by "only"). It was a David v. Goliath case of arrogance--and a concerned citizen who refused to just knuckle under. Yes, folks, this poor lady pressed on because she didn't want to see ANYONE ELSE suffer that fate. Rather than enviously looking at her with disdain, perhaps people should educate themselves on the true facts behind the Liebeck v. McDonald's story. Thank you, Ms. Liebeck. May you RIP.

Pedro DuhHusky Hi Pedro. Thanks for your most inquisitive reply. For a company to need changes due to people getting hurt is equivocated with negligence according to Tort law. Thus, as a matter of law, McDonalds would be held to be negligent if they were found to be selling coffee that is significantly hotter than industry standards. A company is held to a reasonableness standard. If they are found to be selling coffee that is unreasonably hot--hotter than industry standards--then they are found to be negligent. Moreover, if the company has had notice of hundreds (that we know of at a certain time) of people getting burned and they refused to change it, that is a problem. (People will continue getting hurt without changes.) Importantly, in personal injury law, there are damages for pain and suffering. Admittedly, this is balanced against the negligence of the Plaintiff. However, where a product is dangerous enough that many people are getting hurt with it--and the company has received notice after notice, such that they are well-aware of the volume of injuries--then it becomes a problem for the company (this can be seen in products liability cases also, with dangerous and defective designs). Nevertheless, American law compensates people for pain and suffering (I think this is where you may have the issue--but it is our law, and I do agree that if something can help end human suffering then I am all for it). Also, judges award punitive damages to deter Defendants from committing the same type of acts repeatedly. The fact that defendants pay out punitive damages acts to deter others from wrongful acts, such as those that unnecessarily hurt people. By the way, punitive damages are not restricted to hurting people. There was a case involving Denny's and ONE (if I remember correctly) alleged racial comment (about someone looking out of place--where it was the INSINUATION where the problem lay) led to a MULTI-MILLION DOLLAR payout. Nobody got hurt. Yep, sticks and stones may break bones--but in law if one goes after a member of a federally protected class (i.e., racial, religion, gender etc.) then they are playing with proverbial fire. While that would not have been the verdict prior to 1964, it is law now. It is meant to deter oppression. Getting back to Liebeck, if we can do something to deter needless human suffering--and companies tend to listen when they have to pay--then it is a needed deterrent. If you haven't seen the pictures of Ms. Liebeck, Google them: You will be horrified--and you will agree that no human being should need to undergo what amounts to unspeakable horror at the extremes of what is torture, and conceivably, the limits of what human suffering could possibly be (it really is so much worse than "just" a coffee burn). Bottom line? Laws are meant to afford justice to victims--and to prevent or deter human suffering.

unfun fact: the McDonalds lady that everyone loves to talk about as an example of a "frivolous lawsuit" was an old woman whose labia ended up welded together because McDonalds was deliberately serving coffee that was too hot after they'd already been warned multiple times that it was dangerously hot. When she asked for McDonalds to pay for her skin grafts they told her to fuck off, so she sued.
