I agree. But the problem is, there are so many times when the cops make clear and provable violations and the cops get by with it. Which means, even if it was an unlawful action, the police investigate themselves and the courts generally back the cops. So regardless, the innocent will still be oppressed and the corrupt and inept cops will still get a pass. A person's defense against the unlawful acts of a cop will simply be deemed itself unlawful.

Absolutely, but wait till the DA starts throwing every possible charge at you to include jay walking. Question is how often does this occur? Given Audit videos seen id guess 23-34%. Based on my experience of cops charge hunting and fabricating cause to check, 100%. Although none went far enough to do things like in this video. Ill leave it at this, its rare people I talk with in active legal defiance being bothered by a cop. A few use to do the drug thing and excluded those experiences talking with me.

​@simonbrown7501 Well, clearly, she didn't do anything wrong and was still charged for resisting arrest. The officer said on his own bodycam she wasn't arrested. The cop didn't even ask her anything. He went up to her car, told her to turn it off, opened the door and took the keys out himself. That's theft. He was hostile from the start. If I was her, I'd probably act that way out of fear, too. She was still arrested for nothing. He used excessive force on a woman who had no knowledge of the burglary situation because the cop was at the wrong address. The cop didn't speak calmly, he escalated the situation, arrested and charged an innocent woman for nothing. But yeah, this comment again because it's BS what they did, and they got away with it.

The arrest wasn't false . He was attempting to detain her as part of his investigation . Her refusal to comply to the instructions from the officer and fighting with the officer is what she was arrested for .

@@j.a.3138yeah I’m willing to bet an appellate court doesn’t agree with the lower court’s ruling. Simply because it’s not in line with the constitution. There’s nothing reasonable about being so ignorant you end up at the wrong address detaining someone who you have zero knowledge of the situation about. He had zero reasonable suspicion to stop her. None. An anonymous/unverified/untrusted 911 call isn’t reasonable suspicion for anything. Probably a dumbass magistrate judge too, who don’t need to know jack shit about the laws to become judges.

When their department and the city/county/state/feds just pay any judgements anyway, taking away QI does zero good. Even the states that have removed it did no good. You are forced to sue in federal court where the state law is irrelevant.

Unfortunately, even if a verdict is overturned, usually the process was "itself" the punishment. People need to obtain substantial financial reimbursement after inappropriate actions of LE.

It's because he was acting in good faith (even though he erred with the address). There was no intent on the officer's part to abuse his authority while carrying out his duties.

@@darkorhino there is only good faith for the stop, him entering the vehicle and seizing the keys is still a violation of the 4th. He didn't try and identify them or verify any information before taking action. Anyone else in any other profession would still be fired instantly if they made such a horrible mistake and if their mistake caused injury to another physical, emotional or, monetary the offender would be responsible. But for some reason we give police a pass they mess up the citizens pay for it and the person who made the mistake gets off no issues. Speaking as a former police officer every police officer should personally be forced to hold a minimum insurance coverage amount so that if they "Make a mistake" while "acting in good faith" the insurance company has to pay the damages and if the insurance doesn't cover it then their retirement covers the rest and if that still isn't enough to cover it a federal garnishment of their future wages until their debt is paid. I guarantee you that insurance companies would drop bad cops from coverage quick when they start to lose money and then since they can no longer get then needed coverage to be a police officer they can no longer be a police officer. Simple quick solution.

So let me get this right, the ONLY reason she was stopped is because she was backing out of a Driveway AT THE WRONG HOUSE, the Cop then FORCIBLY and ILLEGALLY entered her vehicle to pull her keys out of the Ignition.....so the Cop was WRONG and committed Crimes, but because of HIS EGO and the Follow-on Cops Ignorance of the situation, the Lady is the one that is locked up. Here's an Idea, drop the INNOCENT Woman's charges and CHARGE the Cops with Assault, Carjacking, Malfeasance in Office, Violation of Oath of Office, and Conspiracy to Deprive Rights. Until Cops are actually to the Standard of the Law and are put behind behind Bars for their OWN Criminal Acts, nothing will change. How many times have we heard Cops say "Ignorance is no excuse"....so the Cops should be held to that same Standard and shouldn't be able to use 'Ignorance' as an Excuse for their OWN Behavior!!

I contacted Sheriff Chitwood after this incident. Of course,he defended the deputy, because I quote, she cussed at the cop, but it was the deputy who first cussed at the young woman, who was innocent of any crime. The deputy was not even on the right street. He had gone to the wrong street and attacked the first person he saw, which is just fine and dandy with Sheriff Chitwood.

You get the quality of police that you deserve by putting up with their unlawful actions. I live in what some term a 3rd world country, where this event would result in physical action by the public against the police involved, starting with being verbally warned and if not heeded? escalating through ICU visit to possible death for the abusers.. Based on this, the police are very careful about how they treat the public...

Even once they knew they had the wrong address and wrong person they still maliciously prosecuted her for four felony charges punishable with up to 20 years in prison. As far as I can tell the alleged offence was not helping armed criminals in costumes with the unlawful assault and kidnap on her person.
