Truly shocking. Cop can simply say please exit the property. Write down the vehicle information and walk away. Now his car will be towed and the man will have bail money and impound fees. I thought I heard him say he was homeless. Sad.

​​@@patricial.6758Not so! Victim has now been arrested and likely charged with many crimes that didn't commit. He'll need an attorney and this whole ordeal will likely cost him a minimum of $4,000. That's a prefect scenario where he gets out of jail soon and has money to obtain his car from tow yard or he may lose his car to forfiture as well. Another life ruined by a legal gang of power tripping bullies that went above and beyond to violate the mans constututional rights.

Yea they definitely love that, they want any opportunity to escalate a situation into a possible shooting so they can brag about it to all their other cop buddies and get a couple weeks of paid vacation while their other cop buddies(aka internal affairs) can investigate, and find no wrong doing. Policing in our country is a full blown joke and with body cams, we get to watch it happen every single day.

I don't understand why an employee at the hotel couldn't just save time and asked the guy to leave. It's almost as if everyone is scared of everyone in their own country that they have to call the cops for any minute situation that makes them feel uncomfortable. Grow up, America.

​@realsteel7631 that's if you knowingly know you're on private property. A gate or sign would help convey that. Also, people can walk up to your door if you don't have a locked gate to stop them. It's then only trespassing if there's a sign or you verbally trespass them.

What that cop did was actively participate in a swatting. Regardless of who called, what was said, or whether SWAT was involved the end result was the same. It won't stop until cops get over themselves and stop using "We got a call" as justification for anything. There is no excuse for them.

They had probable cause for trespass in the second degree (the narrator only read the law for first degree) and thus needed to ID him to write the citation. Trespass in the second degree doesn’t require a sign.

Can't be a police officer until you're 21, anyway, so knocking out a 2 year degree between highschool and your age of appointment to the position should be no problem for someone who is serious about joining the profession. Consider as well, that to federal law enforcement, you are required to have a bachelor's degree, and there are thousands of federal cops. Street beaters shouldn't have a problem securing an associates.

This guy is homeless and living in his car, which he was taking care of in the empty car park before travelling on. No one came out of the hotel and asked him to leave, but phoned the cops instead. The police involvement proves yet again "that there is no situation that cannot be made worse by calling the police". There was no investigation, both officers were clueless about the law, assaulted the poor guy and kidnapped him off to jail while using foul language and threats. I hope he gets legal representation, submits complaints against everyone involved in his unlawful arrest and then files a law suit. Then he should be awarded a settlement that will enable him to buy a new home and new car, while the officers have their qualified immunity revoked and are prosecuted in the courts for their unlawful assault and kidnapping. You actually have to see these videos to be able to believe that cops are really this dumb and nasty.

Homeless guy living in a car here. It's fking terrifying just trying to exist. You have to be invisible which means you don't get to socialize at all. You spend every day and night hiding. It's horrible for mental health. You never sleep well. It's not even about the discomfort of sleeping in a car, it's that you always have one eye open. This guy screwed himself, but the cop was in the wrong. This is a tough one. The man was within his rights for most of it but he incriminated himself. He lost the game by simply playing. What you do is shut the fuck up and remain calm.

Only in certain states and it is very hard to tell, in the moment, if an arrest can be made to look lawful or not in the eyes of the court. It's always a better option to just stay silent, take the arrest, and then your paycheck. You will not look good in front of a jury fighting with cops, even if you could "legally" do it. The cops look horrible when they confidently throw an innocent person in jail.

Doesn't really matter that they weren't called for illegal dumping. They were called to talk to the guy, he admitted to a crime, and then he refused to ID. The sergeant said you can either provide ID or we will arrest you, so gave him the opportunity to ID. So I'm not really seeing an issue with the sergeant, at least in comparison to so many other cops I've seen on videos like this. There is a clear issue with the first officer that didn't seem to know what trespassing was and possibly illegally detained him. Could also be an excessive force issue, but it's always hard to tell with body cams that are basically pressed right up against the person being detained.

This is one reason why I have a Camera on my Motorcycle Helmet(Main mode of Transport.) and one on the dashboard of my car. And, I think it's a good idea everyone else should as well. It helps in these situations as well as witnesses for insurance.

@@Govtflu you dont need a court. its on camera. it is illegal for a cop in uniform on duty to slam a handcuffed, non threatening civilian against his van because he chooses to not agree and bow and simper. what is your position - that this brutality is acceptable unless some bureaucrat in a court somewhere tells you its bad? just sit back down and turn the cable news network back on.

All public employees and all law enforcement employees should be required to take continuing education classes on local and Constitutional law. Period.

This man is giving a class in how not to deal with police. He could have told the police that management never asked him to leave, but now that he knew they objected, he was prepared to leave. He also could have told the police he would not identify himself because he was not suspected of a crime. If the officers insisted on seeing I.D. he should have shown it to them, then filed a complaint.
