If you've done your time then you paid your debt, it's not for me to invoke my own brand of justice. @@TheLivewire18 slander /ˈslɑːndə/ nounLAW the action or crime of making a false spoken statement damaging to a person's reputation. So how does slander work?
@TheLivewire18
@TheLivewire18 3 ай бұрын
@@Freakyman403 Legally you have to prove intent and damages. Legal intent being, I know for a fact that it’s not true, and I’m saying it anyway. I am allowed to disagree with a jury, that they got a decision wrong. That’s not slander. For example, if I say OJ Simpson is an obvious murderer, that’s my opinion. Just because a jury acquitted him, does not mean I’m no longer allowed to have that opinion. You would need to prove through say text messages, or phone recordings that he knows for a fact that he isn’t actually a what I’m saying, but he’s going to lie on him anyway. Ben if I’m lying, proving it lying in a court of law is extremely difficult. Legal damages being, you have to prove that my specific lies cost you something. For example, after I started lying on you on my KZbin page, I lost out on 2 job contracts that would pay me 20 thousand dollars this year. That’s damages. It can’t just be something “in general when these charges came my life was screwed.” It has to be when this cop told those guys in the store I was a molestor, it resulted in me losing 50 percent of business at my shop. Legally? To be prosecuted, the bar is intentionally extremely high to protect freedom of speech. In day the Inited Kingdom?? Oh it much MUCH easier.
@TheLivewire18
@TheLivewire18 3 ай бұрын
@@Freakyman403 My responses keep getting flagged by KZbin. Idk maybe if I phrase it this way it won’t. Slander is spoken, libel is written, but this wouldn’t qualify. You’re legally allowed to disagree with a jury. Just because OJ was acquitted does not mean it’s defamation if I say I think the jury was wrong and he did he is a murderer. That’s just freedom of speech. In order to prove defamation, you have to prove intent, that the person knows for a fact that they’re lying, AND they their specific lies have caused damages to your life. For example, if after I defame you, you lose out on a contract that would have paid you 12 thousand dollars. There’s the “damages” But still, at the end of the day it’s impossible to prove the cop knew for a fact he wasn’t a molestor, and just saying “he was acquitted” is not enough to hold up in court. You’d need like text messages of him saying “I know he’s not a child molestor, but I’m going to ruin his life anyway.” Just saying, he was acquitted in court is not enough to hold legally. Like it or not, that’s just how the law works.

@bronyinsticks It IS slander, and I would sue. Police officers aren't paid for their OPINIONS. While in uniform, they should keep their opinions to themselves like good servants and just enforce the law. If a cop can't handle the rules of professionalism, then they shouldn't be cops. ALL law enforcement have outlined the policies and standards of professionalism and courtesy to CITIZENS while in uniform ... prove me wrong.

While I agree, I can also see the other potential point of view to some degree. The Mrs. worked for the DA's office in the special victims unit. There is a lot of times when the burden of proof is too high to prove beyond a reasonable doubt the individual is guilty through suppression of evidence, calling into question a witnesses'/victim's testimony, etc. The system may know for a fact that they're guilty... I do believe that even if this is the case, an officer does not have the right to harass the individual, as shown in this video.

@@BrendanCBreen No. Not-Guilty is Not-Guilty for everyone or we can just skip trials and jail anyone that gets accused. People get accused of things all the time for many reasons. @Marynicole830
@Marynicole830 2 ай бұрын
@@BrendanCBreen I get that but the burden of proof has to be high, we can’t have the state holding innocent people against their will. I have noticed something. People get so much jail time and on such little evidence, sometimes just the cops word, for non violent crimes while it seems violent crimes aren’t prosecuted to the same degree. I think all crimes need to have a high burden of proof but if it was about protecting society then wouldn’t violent crimes be the crimes that get the attention? Why is it drug crimes or small financial crimes? Minor Traffic crimes even. Sexual crimes are terrible and u e been the victim of more than one, starting young. But if we are throwing innocent people in jail over it, the guilty party gets away with the system being the way it is, is the reason that as an adult I didn’t report anything. I wasn’t convinced the guilty person would be treated fairly. As much as I hate them, I hate unjust punishment more. While non consensual, and one of them happened when I was much too young to consent, I was never threatened nor was is super violent. Traumatizing? Yes. Life altering? Yes. PTSD inducing? Yes. But I am healing and am doing better in life. The people that hurt me deserved something for what they did but I know how my area treats even drug convictions. Not to mention the danger in jail if what they did got out and it would. I hate them but I would be bothered if they were killed in the system I was a part of putting them in. No it wouldn’t be my fault but I would have had control over their fate and I wouldn’t be happy knowing they were killed and I know there is zero protection for sex crimes. Some people wish death on their attackers, and that’s totally valid, but I’m just not like that. And the fact is the crooked system we have is a very big part of the reason why I never sought justice. I don’t think what I would have gotten would have been anything I would have recognized as justice. I know I’m not alone in this though we may be a minority, it shouldn’t even have to be a consideration.
