I knew of legal separation in the Philippines, but never really looked into it before assuming that it had more to do with protecting women from spousal abuse/neglect/abandonment. However, that's not true. It's much more expansive. For all practical purposes, it appears it's kind of like divorce-lite. It allows for the legal separation of properties, spousal support /child support / custody arrangements for children, etc. And yes, from what I read it requires very specific legal criteria, terms and conditions. It requires the petitioner to come to court with "clean hands"; meaning a spouse can't already be cohabitating and committing adultery with a new boyfriend/girlfriend and then ask the court for a legal separation. It appears to be a quite complicated aspect of Philippine law wherein a judge would have a lot of discretion. And where there is any form of judicial discretion in the Philippines, money talks and BS walks! Anyways, let's assume this would require a skilled lawyer and some fairly expensive legal fees that few Filipinas could afford. The odds that she was legally separated are slim. Thanks again for the great info!!! I hope gullible expats don't use this info as a way to get entrenched in a bad relationship. Plenty of fish in the sea! Best to just move on and find another Filipina without all these problems!

Well, in legal terms, separation means only one thing in the Philippines: that the spouses have filed a petition in court that has been approved and they are granted legal separation of assets and liabilities. Unfortunately, a sexual relationship outwith the spouse, even while legally separated is still regarded as adultery. The only way, in the Philippines, to end a marriage is through annulment, which takes a while and can be very expensive. As regards Chuck's situation, he does have a legal defense to any case filed against him: but he would have to prove that he did not know the true status of the woman and that can be difficult, as it's a "he says - she says" situation, with no corroboration.Chuck needs to get to the bottom of whether or not they are legally married, in case the guy claiming to be the husband is trying it on. The woman needs to come clean. If they really are married, I would think it's highly likely, however, that the husband of the woman has also committed concubinage (the male version of adultery in Philippine law) since they separated, so it may be worth looking into what he's been up to. If he has, the threat of a counter charge of concubinage might well make the husband back off. As it stands, he likely only wants some of Chuck's money, but going down that road will be a never-ending handout to keep him quiet. You really have to be careful when considering a Filipina for your gf. Knowing her true legal status is important and, if she denies being married you really ought to surreptitiously record her saying so! Sorry for the long comment!

In coming to the Philippines, I recommend having a good all around plan which includes things like handling financial matters and dating. Dating a married woman in the Philippines can only bring about problems, even if they are separated. Vetting in online dating is a must. Get it clarified. About half the women I talked to were married, but separated. Once you find that out, wish them well and move on. There are plenty of nice single women.

Separated is STILL married. There is NO divorce in the Philippines. Only annulment. He could end up in jail. Leave her immediately. As a foreigner he has NO rights in the Philippines. She also guilty of fraud by claiming she is not married. Unfortunately being a foreigner he has NO rights here. Chances are he will be held totally responsible. Chances are she will walk Scott free.

she wasn't asked if she was married. She was asked 'where is it at" like what is your status? Separated...... well that means different things in different countries. Like the implications. Lost in translation, springs to mind. Check that you understand what that means in your chosen country. Separated means that you have been previously MARRIED in the Philippines, usually. So you have to dig and find the rock bottom bare truth. Obtain a CENOMAR, the official Philippine Govt document that specifies her official marital status. You will have to apply for that. If she has been previously married, bear in mind that there is no Divorce process available in the Philippine Court system. You can 'annul' the marriage through the Catholic Church of the Philippines.... apparently that is a money making racket for the church, and is expensive. And how legal the Church annulling the marriage is, and how that fit's into the Govt system of no divorces, I don't know. It is definitely for a local lawyer. Does her CENOMAR record get updated to 'single' after an annulment? Much quicker to not go there and do that. You can get arrested and charged with adultery, so don't forget that. And that's not just in the Philippines.... so check out the local laws where ever you travel.

But hell, the family was making $200 a month so I'm sure they were happy with the situation. There are so many available ladies there that there is really no reason to get involved with a woman with children. Offcourse she could be lying about not having children too, so you need to thread carefully and find out as much as you can before you get in too deep. I had done some research about the annulment process a while back. Many said no never just a waste of money and some said it took ten years but yes it finally came through. It seems from what I remember the bottom line is,, ""The only time they get approved is if the reason would have prevented the marriage approval in the first place"". Such as if one of them was already married and the marriage never would have been approved if they knew one of them was already married. Nothing to do with adultery or how long they were separated. That is my understanding. So if he's thinking about an annulment they might want to check the grounds for requesting it to see if it is a good enough reason

[committing] adultery in PH is a crime. What I dont know is who has the burden to prove it and what constitutes proof (photos, videos, a hunch, hearsay) and what exactly is adultery? Is it (adultery) only when sex takes/took place or already when going to a cinema (without any form of intimacy [kissing, cuddling, touching, hugging])

Break off the relationship and go to another Island….also Mike gave you good advice to have an agency check to see if changes are filed. If you have a warrant for your arrest you better talk to a lawyer and deal with it because they will find you soon enough. If you’re in the clear than thank the good Lord and never never date a woman who is married. There are ways to investigate if she’s married have her show you a ( Cenomar) which means she single never been married 😊

I'm not trying to be rude, but why do people believe they can live overseas broke? God willing, I plan to retire in three years, with a projected monthly income as of 11/2/24 of $5000 a month (in the last two weeks of the current US presidential election, the value of my pension invested in stocks and bonds has dramatically declined). I wholeheartedly agree that the gentlemen should have investigated if she was married. I'm hearing and reading of too many situations of Filipinas lying and men not investigating whether a woman is married. Going to jail over a woman is not worth it.

Food for thought. Most likely the husband left her for another woman, this is also adultery, and he committed it first. Have an agency renew your visa for you to see if there is an issue, or if this is just a warning. Then do some homework on him, find out his living situation and see if he has another woman. If he is also guilty, and this goes to a judge, he will be in the jail cell next to you for the same charges. I am not sure how the court determines if adultery has taken place, but the burden of proof should be the same for both parties. I suspect he is also guilty of this crime and thus has not filed any charges. There was not an issue until she found the "Golden Goose", and now he wants a few of the eggs. Adultery is a crime, extortion is a crime, it is best not to add a third crime of bribery to the basket. I would do this. Get her back home. Keep your distance from her until you can sort out the situation. Have her or some third party contact him and find out what he wants, or what his expectations are. Do some due diligence on his living arrangements and see if he is also guilty of adultery. If he is clean, then you have to walk. If he is dirty, then there is really nothing he can do unless he wants to join you in jail. Either way, you need to find out his situation or the emotional stress will kill you. Good luck. Not an ideal place to be in.

Foreigners have no rights in situations like this. It’s best that he let go and run. Don’t let no one in her family know where he has gone. Cut and end this, he should not talk her husband. He wants money, the problem is once he makes one payment to her husband the demand for money is going to keep coming, it will not end. Because the law is serious, do not get involved with a married woman. Philippines is serious Catholic country, there is no divorce and the church is very powerful. Politician is not going to go against the church. Foreigners should get that idea out of their head. They are not in the west. Learn the laws and don’t violate the laws. No matter how beautiful she is, if she’s married, she is off limits. Guys need to wake up they are not in America or any western country. They violate this law because they have found themselves in love with a woman, they found themselves in prison and deported after. Separation doesn’t mean divorce. It just that they are separated. The husband still has rights and the wife has rights. There’s a verse in the Bible, divorce is not allowed only under one condition. In Philippines it’s seriously applied. There are many women in the Philippines looking for a foreigner and don’t care what he looks like. They are concerned about one thing and that is can he provide for her. So friend let it go and get lost, don’t talk her anymore no matter what she says, the law is the law.
