What happens if USCIS decides to fight back the mandamus?

There will be a hearing. The USCIS will have to argue that they are not statutorily mandated to act within the period of time or that there was reasonable delay in the process Any reasonable attorney would never bring a mandamus action if there weren’t grounds for it

@OmarOsman98 Thank you for your response. The USCIS chose to respond on the very last day of the mandamus deadline.....sounds like they want to delay further. They have taken 9 months for background check....Still not completed yet. The case was refused under 221g administrative processing.... The applicant is from a non concerned country and 80 years old...despite explaining the caring needs of the applicant, the USCIS has chosen to delay as much possible.

@@Differentbias Filing the answer that late will either really boost your case or make their case. They will argue that filing late was due to a reasonable delay as was the case with why they have failed to respond to your application. Nonetheless, your attorney has to look at the relevant case law on the issue and go from there
