I overstayed in Lithuania last year by 10 days on my 90-day visa-free USA passport :)--I was nervous arriving at Frankfurt airport for my direct flight to the USA because I had heard that Germany was very strict....luckily, I didn't get into any trouble, there, nor in the USA:)

If you over stay how does getting caught work? Do the police come and find you or do you only get busted if crossing a border?

Hello, I'd like to clarify my travel situation to Europe and how to regularize it. On my first trip in July 2023, I stayed as a tourist for more than 90 days, exceeding the legal limit by 2 months due to urgent family circumstances in Portugal. I returned to Brazil on December 15, 2023, with entry and exit records in Madrid, Spain. I now have a trip scheduled to Italy on July 24, 2024, after being outside the Schengen Area for 180 days. However, I am uncertain about my legal status. How should I proceed? Thank you in advance for your attention and guidance.

I got a fine of 450 CHF for one day overstay. I was in Malta, had the 90 day visa free, miscalculated my schedule, was charged in Switzerland. At the spot I was told that I could pay the fine at my next visit to Schengen area. Now I received a letter warning about the fine expiration. Don’t know what to do, don’t wanna have a massive interest or being banned from the EU, but the deadline is in literally 2 days, since is the weekend I doubt that would have any effect. No email, only a letter.

I might have to stay one more day passed the free 90 days. My check doesn’t deposit the same day 31st in Germany like it would in America. I want to leave on time however, realistically I will not get paid till the 1st of august early in the morning. Are you absolutely sure I will not have problems flying out to any country. Say for example Thailand?

@@bilaltariq9143 It usually works like that for people who do not need a visa to stay in Schengen for 90 days. People who need visa are usually treated more strictly. But it also depends on the officer dealing with you.

Didn’t really go through possible scenarios of what happens (in terms of fines, energy bans etc) if you do overstay. I have uk passport and by the time I leave France in few days time I would have overstay my 90 day allowance by 8 days. I have no idea what will happens but was hoping to get some idea from this video

VERY IMPORTANT PLEASE GUIDE I work in a research project. I had a training to attend in Spain. I am from Pakistan my visa said "Duration 30 days" but my visa validity was for 40 days. (15 Jan to 28 Feb) I stayed 38 days thinking visa validity is actual in and out but now someone told me i over stayed 8 days (17 Jan to 24 Feb.). my heart is so fking broken and my supervisor did this to me. he booked my flights he knew i wanted to leave for PhD in Europe someday and he does not want me to leave. my world fell apart today suddenly when today i came to know my stay was over stay. i have followed all the rules all my life now this happens when i am looking for PhD opportunity. I have certificate from the training institute that i stayed in the training for all those 38 days. will that help? anyone knows?

Well, a lot to cover here 😀 Consider joining the community so I can shoot a video answer for you: m.kzbin.info/door/mCtTBBqi5WudU2UYXZO_wAjoin :) Generally, if they catch you overstaying (not saying it it likely though), you might be deported and even banned from coming back for some time (6 months - 1 years), your future visa applications might also ve affected. As for staying/leaving, not sure about Spain but submitting application for a Czech student visa foes not allow you to overstay you 90 days, you will not "be allowed" to leave the country, you will "have to" leave the country :)

What happens if I overstay in Spain, while I wait for my work visa in Croatia to be finished. Also I used a new passport without stamps to try get around the system as I already used my 90 days :D But I will need to go to Croatia at some point from spain while I have been overstaying, in order to finish my visa application there basically.

I would like to inform you that regarding my passport. I visit the Italy in 2019 for job purpose but after 5 days compeny send me back to India without any reason. Then I received the call from Italy embessy for cancellation the visa then I visit the embassy for visa cancellation. Now I am planing to move poland for job purpose. When I applied for work permit EU immregartion showing passport is showing Default. So please le me know what is the problem and what I have to do. Please suggest me

What happened then if someone was in Schengen area legal then he lost his permit resident cause because of divorce then he back to his country voluntary without déportation he will get ban to enter in the future or no

Hello Jan, my mom worked 90 days in Austria, and the security told her that she has one day to leave, and if she enter in country and stay let’s say stay 10 days or longer and they caught her, she will get banned. So she left, came home with restriction of 90 days,( we live in Europe country, but this country Is not in EU) and got married. She got new passport with new surname, and 90 days didn’t pass yet so she can enter Austria. We would love to go in Greece, but you know that Greece is in EU, and her restriction is still active. Can she go in another EU country, where she didnt’t get restriction for 90 days, with new passport. Or she can’t enter any EU country until that 90 days restriction expires? Thank you Jan 🩷🩷🩷🩷🫶🏻🫶🏻🫶🏻

Hi Jan kalina , I would like tell you that I went Germany and they granted me visa for 2 weeks , but I went Portugal and I send there around 3 month and I come back , but I apply there my TRC and I have expression of interest , but due to some family matter I have to come back . When I was coming back from Portugal they did not ask me any thing. Kindly let me know can I apply visit visa again for Portugal or any other country or not ?

The fact that you applied for a Czech visa or reaidence permit does not allow you to overstay your allowance. Fine should be the least of your worries, you can esíy get deported and banned from coming back for some time.

Depends on where are you from. If you can not stay in Schengen without a visa, you have to leave before your residence card expires if you are not renewing it.

@@senjorit Well, generally, you do not need anything (visa, reaidence permit etc.) to live in another EU country. So I would not worry about overstaying. Different countries might have different requirement for foreigners though. For example, the only obligation for EU citizens in CZE is to get registered with the Foreign Police within 30 days after arrival. You do not need anything else. If you do not register, no one will most likely find out but if they do, you can get 3000 CZK fine. So, Spain might have a similar rule about the NIE number but this is something you must verify on Spanish side, I am not familiar with that.

Hi, I overstayed in Spain for 15 days visa free by mistake. The police Officer stopped me in Germany at the passport checkpoint while going back to my home land (Bosnia and Herzegovina) and saw that I overstayed. Took some information, printed the copy of my ticket and I filled out the form that they will send to, I guess Immigration lawyer to see what is going to happened and he told me that I should wait for a decision that will be mailed to my address. Also he told me couple of times that I can enter Schengen August 2nd and maybe that I wouldn’t be “punished” since I was in Germany for only couple of hours while I was waiting for my flight to Bosnia. So does that mean that they count days of overstaying only in the country that you had your passport checked (for me that would be one day in Germany) or for the whole time that I overstayed in Schengen (15 days in total). And also, my husband is a basketball player who played all over the Europe and has work visa. Would I have problems getting family visa in the future so I could go and be with him in Europe the whole time that he he’s there? Actually my real question would be-do they have me somewhere in the system that I overstayed? And another question-I have booked a trip to Tunisia, would I have problem getting there because I overstayed in Schengen?And another thing, I didn’t get stamp in my passport when leaving Germany. Did they just scanned my passport or that could be another problem for me? Please help, I searched whole internet for answers but I could find anything 😢

Well, if they banned you for 3 years, you can not travel here for 3 years. Question is though, if any country will approve any visa of yours after the 3 years pass anyway.

@@Todo7J Everything went well! I applied for a specific visa once I arrived, that allowed me to stay longer while it was pending. No digital scans were implemented yet, I received a physical ‘residence pending’ sticker in my passport.

Hi sir! Just a quick question. I have applied for schengen visa last year and i thought the validity date is the day i am allowed to stay. I was given a visa valid from dec 15, 2022 to january 13 2023, and the duration is just 15 days. I have not realized until now that i have overstayed for 10 days 😔 but was able to come back to my home country. Yes you can go back, they can put ban for 2 years or maybe not. I had overstayed in France for 18 months and got normal stamp. But going back again with Schengen visa can be problem for us.

Sir I have applied for Schengen visa from 13 June to 21 June but I want to leave country on 24th June So would that be considered as overstay and if yes then what should I do to extend it to by 3 days and what would be the consequences. You definitelly should stick to what your visa allows. If you overstay, you might never come back.

They should always stamp your passport on the Schengen border. That does not always happen though.

I specialize in Czech immigration so I unfortunately do not know about Spain. Every coutry can have different rules about this.

PLZ HELP ME , I TRAVELLED TO SPAIN IN 2019 , I DID A OVERSTAY FOR 5 DAYS , BUT I WAS STOPPED AT ZURICH (TRANSIT) , AND AFTER ONE MONTH I RECEIVED A LETTER FOR PAYING PENALTY, AROUND 350CHF, BUT I HAVE NOT PAID IT YET AND I WOULD LIKE TO PAY IT NOW. BUT I HAVE LOST THE PENALTY LETTER THAT I RECEIVED. PLZ GUIDE ME HOW TO FIND PENDING PENALTIES. IT URGENT I HOPE U REPLY SOON

@@jankalina-CzechVisaExpert hello, I went to the Netherlands as a tourist 2 years ago, my visa expired and I came back to my country from belgium, but the customs police took a report and said to me that you can't come back for 5 years, do you have any suggestions on how to remove it back to the schengen area?
