I lost my house in a fire. I didn't have enough to rebuild. I was homeless for a year. I finally bought a large shed on payments and proceeded to turn it into a tiny house to get back on my own property. Within 6 months, I was fighting cancer. I survived. My credit was wrecked from the cancer. It made me think outside the box. I came up with about $1200 more money and paid my mortgage off to help me become debt free. I decided to live small indefinitely until I'm free to rebuild for cash. No more banks. No more chains. I know this isn't exactly the same. But maybe it can help people get some ideas? I hope.

Those homes should have become property of the taxpayers until such time the intended owner could make good on the debt. Where were our paid representatives?

The two of you discussed mortgages and property lines. It made me remember an interview survivor statement. To paraphrase, they didn't just lose their home. They lost the land that their home had been on. For some, their land slid down a mountain and is now a new ravine too dangerous to build onto again. For others, the river channel changed and took away the homesite, the driveways, the access bridges and culverts, and even the road that had passed by their home. It is difficult to comprehend the level of devastation in some of the hardest hit areas.

Regarding surveys: a friend of mine had property surveyed before she bought it. When the markers for the property boundaries were put into the ground, she made sure every single marker's GPS coordinates were logged in the survey documents so if there were to be a dispute in the future, she would have a certified survey stating said coordinates to refute a boundary challenge. Sounds like a pretty smart thing to do!

Something is extremely warped. FEMA just spent close to 700 billion dollars setting up tent cities for workers who do not work. Paper pushers and lazy untrained DIE wokesters. They need to all be clothed and fed three meals a day and many vehicles for transportation. They could spend only 200 million in building materials, chain saws and even purchasing heavy duty equipment and everyone could rebuild and have millions left over. Government sucks so bad.

Please do not give up. A similar situation happened to me. I did not file bankruptcy but i was able to get help from an attorney. He filed some sort of paperwork with my mortgage agent and i no longer needed to pay my mortgage. Of course the property went back to the mortgage holder but somehow it did not hit my credit. This attorney was in Georgia and I know each state has different laws. I was thankful it was handled.

@ This happened to me years ago. My husband died of a massive heart attack,was DOA at the hospital . The house was in Houston, TX, i was living in Atlanta, GA due to my job. I had to stop making payments on the home and it was being foreclosed on. I went to an attorney in Atlanta and he filed legal papers, charged me 1000.00 dollars and the deal was done. I do not know what he did but it did not do any harm to my credit. The house was in both of our names and we had owned the house about 10 years. It might have been a Deed in Lieu of Foreclosure, I wish I could remember.

@@ky.gambler5281 The house was purchased in 1983. The builder had gone bankrupt, the house was never lived in, was picked up by a bank, and we purchased the home for nothing down from the bank. My husband died in 1989. I leased the house and moved to Atlanta with my job. In one year the lease was up and the renter moved out so I could no longer make the payments. If I remember correctly it was the beginning of 1993 when I got a notification that I was going to be sued. I took that paperwork to an attorney that was a real estate attorney and it was settled. So payments were made on the home from September 1983 to the end of 1990. So seven years of payments and no down payment on the house to begin with. Not much equity, I would say. I did purchase another home in 1996 and was able to get a fixed 30 year fixed loan with10% interest. I paid that loan off in 10 years. I also finished college after my husband died and got a much better job. So you can purchase a home at 10% interest and get it paid for early. If people remembered interest rates on homes were much higher than they are now in the 80s and 90s. People still bought homes then .

I've been volunteering at a local Red Cross shelter in Asheville. I was very lucky with relatively minimal damage. But listening to so many heart rending stories of loss really makes one think hard about planning for the next time. Helene will be the hurricane that keeps on taking for a long time.

I just thought of something. If anyone has already had to show their medical or other types of power attorney to a hospital in the past, they probably made a copy of it for the patients chart. You could go to the hospital and ask if there is a copy of it in there and ask that they get one of the notary's to notarize the copy, (all hospitals have them usually in their business office). That may help someone in the future.

How about property tax assessments? If your house is gone, the county or the state shouldn’t be charging you the tax rates you were paying prior to the disaster. The small governments will go broke due to the income from taxes going down. The fire department, police departments, and the schools will be hurt the most. Likely most employees will lose their jobs.

Don't forget to verify the notary commission. That can be checked on your state website. Make sure you know what fees a notary can charge. Some like to charge a convenience fee and some states don't allow it. Be careful of notaries wanting to do notarization online. Not every state allows it and not everyone accepts eNotarized documents

It’s called collect insurance, then be evaluated for bankruptcy chapter 7. Ch 13 can eventually be converted to 7 under the right circumstances. See a BK lawyer, evaluate and assess starting over. This is so unfair! I hate this for the victims.

DO NOT rush to filing bankruptcy. Foreclosure on property is much better for you thsn bankruptcy. Foreclose, under normal circumstance will only mess up your credit rating for maybe 2 to 3 years. A bankruptcy with mess you up for a solid 10 years, no if's, and's or but's.. A foreclusure under disaster circumstances may not mess with you at all. People will likely need credit to rebuild their lives, don't mess up your ability to get crefit by filing bankruptcy. Also, file a disaster with the IRS. You can amend your tax return to file a disaster when it is a federally declared disaster, which this is. That's another good way to get relatively quick cash from the IRS for this disaster.

People in the mountains are not going to have hurricane or flood insurance so can’t collect anything. Can file for some FEMA funds but that is not much. Even if a home is paid off, there is nothing to sell or any money to rebuild. What a nightmare.

From a legal and technical perspective, no hurricane hit North Carolina. The most northern state to have experienced a hurricane on 9/26 or 9/27 was the southern part of Georgia. The remnants of Hurricane Helene struck Western North Carolina as a tropical storm which, in many respects, was far more disastrous than the hurricane. Had NC emergency management followed the expertise of meteotologists, for the week leading up to the storm, the loss of life may have been greatly mitigated. This distinction or the lack thereof, excited normalcy bias that, "We don't get hurricanes in the mountains." While the intensity and magnitude of the flooding, caused by as much as 30" of rain, was not exactly expected, the event was accurately predicted by local TV meteorologists for several days before the storm. This path of travel that this horrific storm took was not any different than the path that previous floods or snowstorms have taken in history. There is no mechanism available to mankind that could have stopped the destruction to topography or property. The same device used by people who said, "We don't get hurricanes in the mountains," are now being used to say, "We just got hit by Hurricane Helene in the mountains." The disconnect is confounding. These same devices can be utilized to gain self-awareness of the threats and dangers of weather phenomena that the mountains of North Carolina actually do experience - tropical storms. For context, I am writing this from a sailboat in South Florida where we just experienced two major hurricanes - Helene and Milton. There is no callous here - only concern for unnecessary loss due to poor emergency management and lack of situational awareness. The distinction and language is of vital importance.

We have the technology. The land / property boundaries haven’t been swallowed into some kind of “Black Hole” in space. Satellite imagery and known fixed surveyed points not affected by the storm can be used to determine land / property boundaries regardless of what the piece of property has become.

If you can afford it ( which is I find is very reasonable ) put all original documents in a lock or safety box with your bank or credit union. My Mom & Dad only paid like $ 83 a year if I recall. It’s fire proof, water proof & secure . That way when a natural disaster occurs - you know you have it on hand when needed.

In my state of Oklahoma, the rent on a Bank Safe Deposit Box, is on average $60 a month (pricey) AND, UNLESS one takes out extra insurance on THAT box, the contents of it are NOT insured!!!

Whether it was a bank, or your Cousin Joe, there was a large sum of money that the lender turned over to you to buy your house. The lender no longer has that money, and they are looking to the person who borrowed it to repay it. It sucks, because most people have most or all of their money tied up in their homes. If they lose the home they have nothing.

Most lenders will let you do a "forbearance" which allows you to skip payments until you can figure things out and they tack it on to the mortgage on the back end. Worst thing is to not contact your lender right away before the next payment is due. If you let it go without contacting them, there will most certainly be a foreclosure. It sucks, but it is what happens. Unfortunately that is what insurance is for. I get it that most people do not have flood insurance though.

There is a term called ---inducing panic-----The illegal practice of inducing owners to sell their homes (often at ... Also called Panic Selling or Panic Peddling. There was quite a story behind this meaning in real estate and I think this is a good example related to a catastrophe and property sales. Alot of people might have lost land actual ground on their property and a surveyor must go out with the county to decide if this property has to be rezoned. Some property is not residential any more, I have a question about the liability of the county in allowing those people to have residential property in such a dangerous area. I think there are some serious legal issues about what just happened and liability to the county for allowing unsafe conditions. This a longer story in the sense of some of those properties may have been unsafe for housing to begin with. That is really survey and zoning, something about the attorneys is very very strange to me. Those people were in those houses just as this video is finding a mentally sane attorney is a challenge at this point. Some thing doesnt make sense.....im just going to end this here.

The government requires that larges institutions like American Express are required to have important information stored in many different geographic areas.. We as Floridians are going to do the same thing... We have requested new originals birth certificate etc.. What would you do with a town that is selling permits that close public roads, keeping people from their property, and allows others to "Take" that private property for personal and public use? This permit allows the public to walk, stand, sit, put up canopies, display, drive, and park on private property, without permission, due process, advanced notice, or compensation. This is not in a hurricane zone. The town says that their permits do not allow this, but know that it will happen, and their police refuse to cite, arrest, or make them leave your property. Is this not a 14th Amendment violation?

Keep a copy of a google map of your property and the area , before any disaster happen might help in dispute with your property line!

I saw a video of a homestead content creator with property in the area who resulted through change of waterway paths a loss of significant property, started with 25 acres but with boundary changes, they now have maybe 15. That’s a significant loss and change of property and the means to resolve that seem impossible.

If your house is washed away do you get to keep the land? If it was paid for. But I guess if it wasn't paid for then you would have to just lose it all This sucks..

You still have to pay to keep it. Hopefully flood insurance was on these houses. I pay 1400. A year for flood on top of my regular homeowners. And that's just for 60,000. It was around 750. Four years ago.

@@barbrice721if you're not listed in a flood zone then you probably didn't have flood insurance therefore you've just lost everything! You can only get flood insurance through FEMA. I asked my insurance company, and they said not to worry about it because I was not in a flood zone and neither were these people! They were very very high of elevation .

Often estate attorneys keep a copy of wills and other document in their office files. So that would be my first call is to the lawyers office that prepared the documents. Your doctor, dentist or hospital may have copies of medical records for replacement prescriptions and medical power of atty docs.

Although it's morbid something to think about is Death Certificates in regards to life insurance policies and wills, etc; If the bodies are never recovered how do you even begin to handle that?

The mortgage companies have insurance for the value of the property. Does not cover anything in the home but the structure.

The lending institutions do not care about your home being washed away or destroyed by the wind. All they want is the monthly payment as expected and agreed to. If you don’t pay the mortgage, everything is turned into the credit bureau being in default. I speak with experience concerning property being stolen, by a scam artist. I spoke with the bank concerning this, and their reply was, we sympathize with your position, but please make the monthly payment as expected.

You should have gotten the original documents from the attorney, or at least signed copy. Then you can make copies to keep in several places (we gave copies of all our documents to each of our adult children).

Florida does not penalize people for losing their home in a hurricane or tornado. You have the right of rebuilding or restoring. So what is the problem in NC?

I found some General Statutes in NC. They are G.S. 1-354 (2019) and G.S. 41-10 (2019) they both deal with changes to the boundaries due to natural disaster.

In Tennessee, a Durable Power of Attorney isn't recorded.anywhere. My husband had Dementia and I got one, signed and witnessed and notarized. No had to use that original for everything. I supposed another one would have to be filled out, signed and notarized. That is s problem if one cannot get to a notary or signs their nsme.

Many places have updated the maps by GPS. Isn't this also a case of title insurance because they weren't updated to include mud and flood zones.

force majeure: "An unavoidable catastrophe, especially one that prevents someone from fulfilling a legal obligation." What else could Helene be called. That being said, the banks prefer that term only apply to them. In fact, I would not be surprised if force majeure becomes an insurance company defense. What attorneys should do is break or suspend code laws that prevent victims from using the land, with non conforming structures, for perhaps 10 years. Suspension of payments and discharge of interest and late fees for at least 5 years would also be reasonable in my opinion.

Not necessarily, sometimes the land the house sits on is just a small fraction of the land owned. For instance and I live in western NC, my parents home loan was on the two acres that was bought with the house and mortgaged through the bank. Years later my dad managed to buy all the surrounding land, over 100acres and that was paid for free and clear and had nothing to do with the bank loan &home that sat on the original 2acres in the middle of it. Mountain people are smart and SOME land may go with the home but they own more than that and all the surrounding property, making it harder for them to lose it all to the bank if something happens to where they lose the home. My parents kept that land for years after their divorce and the 2acres and the home was foreclosed on by the bank during the financial crisis in late 2ks but they kept that land and made sure the taxes were paid on it come hell or high water, just in case because it was worth alot of money. eventually developers bought it and put in a bunch of double wides where once our small home with a 2\mile dirt road was surrounded by forests and it's own little fortress you wouldn't even know was there.

There's got to be some kind of insurance for the banks so that they can recoup their money, but to try to continue to get money from people who no longer have a house or property is just very wrong on many levels, including their jobs their jobs are gone too and so they probably have credit cards and other bills that they have to pay and I just feel so horrible for them just horrible!
