Talk on UAPA amendment act, 2019 is need of hour, but what media & news channels do we all know. I really appreciate your efforts & research. Recently, Umar Khalid (Former JNU Student) arrested under UAPA on the grounds of "disaffection against india" but what is disaffection? - Nowhere define in the act. Such ambiguity in the act really affects the rights of accused. Even the appeal provision againt the "terrorist tag" is against the principle of natural justice. Branding any "individual" as terrorist, is in the hands of government which can be highly misuse for their political gains. Such amendment which is suppressing the rights in the name of security, unfit for the welfare state.

I think that before detaining someone in this act the government must provide conclusive evidence as to why they think that the person is a terrorist. Also the appeal should be made to the SC and not the government. Your teaching skills are great mam!! Helped me a lot to prepare for CLAT!

1) The act does not specify What is Terrorism and Terror act (we till date not have definition of terrorism), giving govt power of wide interpretation. Govt should specifically mention dissent against govt , ideology etc will not attract UAPA. 2) To remove individuals name one has to ask to same authority who had included, this provision violates The principle of natural justice..ie No one should preside over as a judge in it's own case. Courts must decide on the question of inclusions/exclusion of name. 3) No bail period should bring down.

Very well explained and succinct presentation. After listening to this explanation I have come to this conclusion that this UAPA act is a lazy act for those lazy executive officers who are incompetent to prosecute/prepare quality evidences on time. Instead relying on people's helplessness. It's a draconian law. This law should be repealed. The onus should lies on executive branches of law to provide substantial evidence against any individual prior to their arrest.

Yes today country is in need of constructive discussion. Coming to rights vs security. No dout security is utmost important but at the same time individual rights should be preserved. If an innocent has been detented or rights taken away this will lead to raise in internal extremism which is threat to the society ultimately compramising our internal security. So if rights are taken away in name of security it will surely backfire. We need to secure our country on logical grounds not on political grounds. Thank you.

If the population is reduced then the most of problems may be solved.but people are not ready to understand here, there are drawbacks both in the people and in the government. Here every person things about corruption before jobs, it is so sad that we cannot do anything despite knowing.

@@vkvishnoi4750 well you can see for yourself, the classes of people on whom this law is applied. Political dissenters, opposition leaders, social activists, poor, backwards and minority communities. See the conviction rate. If the aim really is to prevent/curb terrorism the investigating agencies should be better equipped in prosecution..

When you say “branding someone as a terrorist “ it’s saying that the government is acting arbitrary and declaring an innocent person a terrorist, which I don’t think is true. And speaking against the government is not a crime, inciting violence is a crime. Which is what is being addressed with UAPA.
