The biggest point is you need to be 100% clear that you had no other option. I have worked dispatch and we are trained to defuse the situation. I've had an active call where a homeowner was home when the house was being broken into. He did grab his firearm but we are super clear that the intruder was not appearing to carry a gun so we instructed the homeowner to barricade the door while police were in route so there was no interaction between the homeowner and intruder. 911 normally keeps you on the phone until police are close or they hear the sirens and noises. He's not joking about EVERYTHING being recorded. Things have been digitally recorded and kept for so long now.

Then when the officer asks me why I shot the invader 17 times I probably shouldn't tell him "because that's all the rounds my CZ holds"?

My thought would be: I was taught to keep shooting until the threat stops, and I did not perceive my assailant as ceasing his attack until I ran out of ammunition.

@@GoblinKnightLeo Or just don't answer the question and keep your mouth shut. Any justification on your part can be told by you to a jury, there's no reason to tell a cop.

@@KingAdrock420 That's probably the better plan, but you may not have time to call an attorney before the police arrive. Refusing to give *any* statement is typically bad.

@@GoblinKnightLeo True you may not be able to call an attorney before the police arrive, but that's not really relevant. "Don't say anything" is exactly what an attorney will tell you in this situation. As the OP explained, while there are a _few_ things that are good to say to police, the danger of saying too much is infinitely worse than that of saying too little. So be polite and cooperative and tell the police you indeed want to give a full statement... but only *after* you've spoken with your lawyer. Any reasonable officer will be fine with this, because that's literally what they tell their own families to do.

Good friend of mine was involved in an home invasion shooting years ago. Long story short, drugged up bad guy broke into his home and he shot the guy with is shotgun. Somehow the police got the idea that the victim (robber) was actually staying there (cause he spoke up) and my buddy spent the weekend in Jail. Come Monday the lawyer got involved and cleared up the facts and he was released. Had he simply shut up and said "I'm not talking to police until after I talk to my lawyer" cops are going understand that.

get out the mop bucket and call the carpet cleaner company. also call your refuse company that you need an extra pickup before the body starts smelling

I was wondering does ohio CHL cover an AR pistol? I want a truck gun and was considering an Ar pistol. But i want to have a loaded magazine in it.

I cannot carry inside a bank. Well and good. Does this apply to an extra belt magazine? The new Ohio laws may protect me having my conceal firearm in my vehicle at work. Does this apply if my company is headquartered in a state other than Ohio? Even if so, how does this apply to company vehicles?

what should I do if someone breaks in and I discharge my firearm, but my neighbors are the one to call the police first? Also what should I do if there are multiple criminals inside of my house and the police arrive when the criminals are still inside my house? Thanks, josh leasure

can i conceal carry a AR pistol, Micro draco, or micro uzi since they are considered pistols...or is there any exceptions because of how big they are?....by the way im in ohio

The conceal license in Ohio is a "concealed handgun license" even if it's considered a pistol, if it's not considered a handgun it wouldnt qualify

I have a CHL in ohio. If i get stopped for a traffic violation. Do i have to inform the officer if i do not have a firearm?

No you don't have to advise them if you do not have a firearm but it's in the best interest that you tell them you have a concealed handgun license and you are not armed.

Excellent advice. I've heard you should point out evidence, state "I am willing to sign a complaint" then STFU until you talk to your attorney.

I have a question about a story I just seen on WHIO where a guy came home found his home was broken into and someone was in his bathroom taking a shower and he went and got his gun and shot through the shower curtain and killing the intruder and now he is charged with 2nd degree murder, my question is this , if someone breaks into your house and are taking a shower and you don't know if that person is armed do you have a right to stop the threat? I mean just because he is in the shower doesn't mean the intruder doesn't have a weapon. The news didn't say what State or anything, but if I came home and caught you in my house your dead . Does the castle law protect me?

glocklvr22 I'm not a lawyer (figure that one out,) but when you claim self-defense, you are, in the eyes of the law, claiming that you did murder someone. The deal with self-defense is was that death justified? Sure, everyone has the right to feel 100% pissed off and violated that your home was broken into, but the story you described was that the homeowner wasn't in inmediate danger. If I was the prosecutor, the point I'd hammer home is "you're life wasn't in danger, why in the world did you enter your home knowing someone broke into it and kill someone who was not an inmediate danger to your life? Why did you not let the police deal with it?" The prosecutor will paint you as a bloodthirsty maniac and that was simply the excuse to act out on your repressed emotions...and in the eyes of the jury, you're already damned. "but what if...???" So what? Call the cops and bug out. Unless you need to put your life in a dangerous situation (kids are home or something,) it's not going to turn out well. We had to learn things like that when taking conceal carry courses.

Your home is invaded, You used your firearm to defend self or family or home. "911, what is your emergency?" "I have a home invader, I think he is armed and dangerous, please hurry." Get out of the house or away from that area of house and DO NOT mess with anything. Assert your right to only speak with your attorney. Is he dead, is he alive - you are not a doc and do not know. Did you really injure him or miss; (maybe he fainted) you are not the doc. You are convinced he was and is armed and dangerous. And even those points of your understanding are NOT told to police except through your attorney.

Although not against the law here in the Socialist Republic....OPS! I MEAN....."State"...Of New Jersey; They have become aware and warry about not talking to the police after a shooting involving a firearm (In a New Jersey the prosecutors purposely and repeatedly refer to them as "Deadly Weapons"). So now the "New Jersey State Senate" have "Instructed" the LOE community to arrest ANYONE involved in a firearm shooting (Regardless of the circumstance) that refuses to talk to the police, and charge them with "Obstruction of Justice for Impeding/interfering with a Lawful Police Investigation". Hence if you do NOT talk to the police when THEY decide you should, then you get arrested for getting in the way of their investigation. GOD I WISH I COULD AFFORD TO MOVE OUT OF NEW JERSEY! Reply
