@@mosesbacke2311 yup, that would be even easier for the women impacted, not sure how the new laws impact on people doing that though, probably easier to prosecute than the transporting out of the state. Random posting of aborition pills into the state from outside it would presumably be beyond prosecution though, kinda like the scam ebay seed sending that happened a few years back, where people were getting unsolicited packages of random seeds, millions of people just posts the pills to random addresses inside Texas every week would cause chaos for their government :)))

Meanwhile in France in a bid to end under-age abortions, birth control, including dr appointments and any tests needed, are free to 18 year olds and younger. That's the WHOLE POINT. The Supreme Court doesn't need to "hear" a case to make a decision. I think that some Guardian or NYT columnist asked the same question (I've read so much abt this insane law that I can't remember). I would guess that the ppl who drafted this law drafted it in such a way as to avoid that interpretation, tho I cd be wrong. You might want to watch Maddow's recent piece about a bar in Massachusetts, Grendel's Den: In short, legal scholar and law professor Laurence Tribe successfully argued before the SCOTUS in 1982 that a Mass. law allowing a non-govt entity (in that instance, a church) to take on the function of the govt was unconstitutional, and the court agreed; he has just co-written an op-ed saying that the underlying legal principal here is the same.

@jeffmacdonald9863
@jeffmacdonald9863 2 жыл бұрын
Basically yes. The argument is that you can't sue to get an injunction to block the law. I believe the case where the request for injunction made it to the SC argued that judges should be barred from hearing cases, on essentially the grounds that they were enforcing the ban. Once we have an actual suit in progress and a decision is made there, then it will be appealed all the way up the chain to the Supreme Court, who will then either strike down this law or overturn Roe. It's mostly not designed to hassle women, but to damage the abortion business. Women will be hurt by it of course, but I read the intent as doing damage to abortion providers while the courts wrestle with the law. Driving some out of business and making abortion harder to get in the state in the long run, even if the law is eventually struck down.

Hi Samantha Bee. I did a little research before work. I found that the new law, all of which the Texas law violates the following (Yo Samantha Bee, Glen Kushner, Legal Eagle, correct me if I missed anything here); 1) Doctor- Patient Privilege 2) Hippa Rights for the PATIENT. 3) Per 18USC241& 242 CIVIL RIGHTS under the COLOR of LAW. 4) For the so called lawsuits by these vigilantes Per the 4th (probable cause) and 14th under a little thing called Due Process. 5) State law (per Texas Penal code) 42.07- HARASSMENT, Abuse of office under title 8 section 39, civil rights under section39.03 (2),(3) aka official oppression, PC 36.06 Retaliation, PC 42.07 HARASSMENT,PC 42.072 STALKING to name a few. So ladies in Texas, you still got a few bullets, load em' up and use them!👍😉

The problem is that unless you are married and already have kids, many OBs won't perform an "unnecessary" hysterectomy. In some states...If you are married, your husband has to agree to allow it. If you are unmarried you need to have your parent's permission. Keep in mind I was 35, already had a child, and still needed my parent's permission to have a hysterectomy.

Great presentation! I suggest an interim plan (without an end date, sadly). States that (a) are pro-choice and (b) adjoin a "pro-Life" state should establish hubs to provide abortions for financially needy women. Special funds, created by pro-choice donors, will get the women across state lines, provide the services (and accommodations etc.) get them back to their "pro-life" states. Problem solved. As an adjunct, states like California should copy the TX Abomination and direct it at guns, gun-owners, guns' sales etc.. All enforced by private citizens who 'd like a bounty. One Supreme Court decision [Roe vs. Wade] is as good as another [US vs. Miller]. Right?

The law doesn't permit ignorance as a defense, so it's possible to sue a prolifer for aiding in an abortion, whether they know they helped or not. Even if they lent money and should have known, they can still be sued for $10,000 per abortion they aided or abetted, plus your court fees. RBG used discrimination against men to enshrine equal protection for the sexes, so why not use their Draconian law against them to protect a woman's right to choose?
