@@ChilliJonCarne, Is TVL legally on sticky ground when threatening householders with legal action without evidence of an offence? TO PROVE AN OFFENCE OF BLACKMAIL, OR EXTORTION, FOUR CONDITIONS MUST BE SATISFIED:- 1. DEMAND A demand can be for money and includes letters and emails. 2. MENACES Menaces means that there must be some high degree of coercion to force an individual to undertake a particular course of action. 3. UNWARRANTED DEMAND A demand with menaces will be regarded as unwarranted unless the person making the demand believes both of the following. Pay particular attention to point (a):- a) That they had reasonable grounds for making the demand. b) That the use of menaces is a proper means of reinforcing the demand. Prior to the arrival of on-demand TV services, it might have been reasonable for TVL to assume that a householder was likely viewing live TV. However, times have changed and there are now numerous on-demand TV services that can be legally viewed without a TV licence. Can TVL really any longer claim to believe to have "reasonable grounds" for sending letters threatening legal action and overbearing home visits when it cannot be sure that a householder is not viewing legal, on-demand TV content? This is made all the more troubling by the fact that TVL most often has no evidence whatsoever that a householder is committing an offence when sending out threatening, coercive letters. 4. VIEW TO GAIN OR INTENT TO CAUSE LOSS There is a clear view by TVL to gain financially and the intent to cause householders loss of money through a possible court fine. SENTENCING For the offence of blackmail under TA 1968, the maximum prison sentence is 14 years. CONCLUSION What do you think? Is TVL breaking the law with their threat letters and home visits, or not?

well first off, its a government charge not a BBC charge, the government sets the licence fee and the bbc collects it on behalf of the government. "The revenue source for TV Licensing is the TV Licence fee settlement by the Government to the BBC. More information on this is contained in the BBC Annual Report and Accounts and in the TV Licensing Annual Reviews. Section 365 of the Communications Act 2003 (opens in a new window) requires the BBC to pay all licence fee revenue it collects (via TV Licensing), less any sums required for making refunds, into the Government’s Consolidated Fund. TV Licensing doesn’t retain any of the licence fee revenue it collects; all monies are passed to the Government, and then the revenue collected is passed back to the BBC as Grant-in-Aid from the Department for Digital, Culture, Media and Sport (opens in a new window). The Secretary of State for Digital, Culture, Media and Sport may retain a proportion of the licence fee revenue for other purposes (refer to the BBC’s Royal Charter and Agreement with Secretary of State)."

Back in the mid 1980s I was working at a residential centre for disabled people. At that time, I did have a TV licence so I was unfamiliar with the “This property is unlicensed” letters the TVLA sent out. The centre had a TV licence that covered a TV in the communal TV room, which the residents could watch without needing a separate licence. However, it did not cover residents who wished to have their own TV in their own room as their room number constitutes a separate address... to which their mail was delivered. Problems arose when these TVLA letters began to arrive pretty much at the same time (they seemed to send them out in batches). Although a lot of residents had their own TVs, for which we ensured they had a separate licence to comply with the law, many did not and just watched the centre's TV. This was before it was possible to watch TV on computers or phones so the only device they could possibly use was a TV. Theoretically, it was a lot more simple then. The letters only referred to watching TV (there was no iPlayer then). The residents who didn't have their own TV were confused by these letters as they seemed to imply that anyone who didn't have a licence was breaking the law. Although the letter did specify that you need a licence if you watch TV, it did not specify the circumstances in which a licence is not required. Despite our assurances that they can safely ignore the letter, none were prepared to take the chance of being prosecuted and fined... so they all bought a licence against our advice. Because the nature of the centre was to develop independence, we could only offer advice but it was up to residents to manage their own affairs. Having read the letters that were brought to me for advice, I was alarmed that it was so misleading and assumed that anyone who didn't have a licence needed to get one to avoid prosecution. The residents felt that they were at risk because they did watch the centre's TV in the communal TV room (which was licensed to the centre). In effect, the letter ticked all the boxes for extortion in that it demanded money that wasn't owed to them, issued threats and provided no information about their rights. I did request that we contact TVLA but the centre was against that. A couple of years later we got rid our own TV at home as the kids had grown up and left and we cancelled our licence. Shortly after that, we got the letter. This time I was free to respond. I wrote to TVLA, pointing out that the letter was illegal as it was demanding money I didn't owe and issued threats it had no legal grounds to enforce. In short: it constituted attempted extortion. I added that, if I ever receive such a letter again, I will take legal action and seek a prosecution for attempted extortion. I did not receive a reply. However, I did not hear from them again. I purchased a licence when we moved to a new address and got a TV in 1998. Apparently, if you don't need a licence, they contact you every two years to make sure the situation is unchanged. I didn't get another letter from them for over a decade so I guess my threat to prosecute them was a valid threat. We still have a licence so I don't know about the wording of the letters they send out these days.

I agree the tv licence should be there to fund the BBC and not other channels which are funded by advertising and/or subscription. You shouldn’t need a licence to watch live sky. BBC radio should not be free unless you pay the licence but it would be really difficult to put it behind a pay wall. Those who listen to BBC radio without a licence are subsidised by those who pay it. I pay my tv licence as I believe the BBC has to be funded but the current situation is a mess and needs reforming urgently. Trouble government and BBC like it as it is. As to the cost -£154 per year is peanuts compared with my 10 monthly Council tax payments of £250 though I understand the reasons why people don’t want to the tv licence.

Then the BBC changed the rules on watching iPlayer, and as I liked to watch iPlayer I was forced to get a licence. I was then given a TV too. I was then finding though that I wasn't watching much on the iPlayer and what I WAS watching was also being put up on KZbin by the BBC. So it seemed a total waste of money to have a TV licence. So after checking what I was getting myself into again by watching this video I think I am going to cancel it NOW!

Its also worth noting that NOW TV is contract free, unlike its Sky counterpart. So not only is it cheaper than Sky but you can also cancel it whenever you like! Not only this but when you go to cancel it, they will try to attempt to keep you as a customer, so you can potentially get a cheaper package without the awkwardness of talking to an agent!

What I don't understand is, if the tv licence fee is all about the bbc mainly because they are not a commercial channel, why are all the commercial channels included with the licence fee for broadcasting live. Don't the sponsers cover all of that on commercial channels, and if not, what is the point of commercial channels or FREEVIEW boxes.

Don't know if this is still true, but have read a few reports stating - There are some exceptions when you won't need a TV licence to watch BBC iPlayer. These include the following. • You only use a battery-powered device to watch live TV or catch up services. • You have not connected it to an aerial or plugged it into the mains to receive TV. • Your permanent address is your parents' house. • Your parents have a TV licence. Does this mean you can watch iPlayer on a laptop as long as the laptop isn't plugged in?

Hi! Newbie to the channel here, so apologies if this is, firstly, a stupid question and, secondly, has already been asked and answered - but do the 'plus1' channels of a live show count as safe to watch? Sorry if that sounds a bit dim, but I'm a bit mind-blown by the reassurance I now feel after watching a couple of these videos 😊🤯

Exactly. If, for example, Amazon is pushing out a live broadcast, what stake in that does the BBC have at all? What a total con. Has any of us agreed to be bound by contract to those types of terms? No. So if they don't have that, then what can possibly be utilised to say that you can't watch live TV via another platform? The answer is that this is one big extortion racket. It's like buying clothes from M&S and each time you wish to, Levi's or some other company that sells clothes says "you need to pay me in order to do that". Criminal.

I have been living in the UK for 11 years, paying for the TV licence almost from the beginning and I think it's time to move on and never look back, like many others here. It's true that I watch BBC news live sometimes, but I don't care anymore. The way they manipulate information is huge and we still have to see ads everywhere in the rest of the channels! My only question is that I pay for Virgin TV, only to watch the Champions League and UFC on BT sports. The only think I watch live is football as I always record the UFC and watch it the following day. Would this be an infringement when I pay a lot of money for this Virgin TV? If so, I think is very unfair as I only watch two games per month, if any! Thanks!

Nobody will show up on that day, it's just to scare you into thinking that you'd better buy a license before the big scary men come knocking. Sadly people can, and do fall for it. It's absolutely predatory, despicable sales tactics and any other company trying this would rightly be hauled over the coals for harrassment, but the BBC/Capita seem to be able to do it with impunity.

I pay by card, paid 20 quid today to bring it up to date, I am paying them no more, the cost of a licence is scandalous, paying for something i rarely watch, I'm on my laptop daily and basically, the Tv is there for decoration, Netflix and amazon prime satisfies my viewing needs... so what happens next??? threatening letters i suppose?? let them come.....;-), glad i stumbled upon yer channel👍👍👍

I'm in the US, not the UK. I have seven TVs in my home- no fees required. All are Smart TVs and have ROKU- which allows the TVs to use the internet (KZbin primarily) as well as 8-10 free stations (ROKU, Tubi,Etc). Various family members outside the home have pay channels and share the log-in with me- as I share mine with them. So all of us has 6 pay channels at any given time. Gives us access to news, older movies, new films, TV series........All for the cost of Internet and one pay channel. Works like a charm.

I remember as a kid watching ads on tv warning that the tv licensing van was detecting tv signals coming from people's homes in the neighbourhood. It was quite chilling. I think people of a certain age who remember that era still have that hestitancy and fear since that successful advertising campaign, which is why many are still confused as to what they can view without a licence. It is an intimdidation, but it has obviously worked for all these years.

RE: Live streaming. This is so ambiguous, they can not clear it up themselves. Define "proper TV show", does that mean licence holder? or in contract to a broadcaster? does that include the broadcaster themselves? if so this just kicks the can down the road, what constitutes a broadcaster? I broadcast, does that make what I broadcast "a proper show"? The TV Licence Authority can't answer these questions either. So technically you "could" have to pay it to watch live streams but then it opens up a DMCA issue. Its a minefield and no one has the answers, this will not get cleared up nicely. If they choose to push that then they totally could when they move it over to being put on national insurance or council tax.

I just received a final notice from the BBC.. it says you can't watch 'catch up' TV without a licence. This is very confusing.. what actually constitutes 'catch up' TV? Also, the BBC licence fee is not a subscription service, it is actually classified as a government tax, and the BBC are licensed to collect this tax on behalf of the government. The government then gives the BBC an annuity paid from the tax collected.

The name is outdated. It's a live tv channel licence. Any device. Any live channel. The last time I checked, the official licence page also included international channels. The gov or bbc either have part ownership of channels abroad, or they're simply attempting to stretch it's use. If they were super strict, tv licencing crews would come to your home and pat you down to ensure you didn't have a smartphone with iplayer or youtube installed. KZbin has plenty of live tv news broadcast channels. Some tv's have both apps by default and are non removable. If you see the vids on here of the tv licence company entering people's homes, you'll realise they don't often understand the licence themselves, and will charge people by simply seeing a tv and write it up anyway. They don't care if you don't watch it, or only use it for games or dvd bluray, you will be charged as a result of a high likelyhood of use if it's all set up. They aren't going to ask you to switch a tv or phone on and browse through your installed apps. You can use the tv licence page to report you don't need a licence but I think there is the possibility they might check up on you annually anyway. Some regions of the country used to have very active door to door visits, although in the current era this should no longer exist? It's a private company handling the licence related visitations. Imagine tesco or amazon at your door.
