that's actually not legally true. you can only be charged with theft once you leave the store. you can get kicked out for putting things in your purse but you can't be charged with theft until you walk out the door

I don't know if that woman took anything out of the store or not BUT I do know as a sales associate in a high theft retail store that THE LAW says a person must past the last point of purchase with an item for it to be considered "theft". People can "conceal" items all of the store - that is why associates do "recovery," You would think the piloce would be aware of this.

@@NastyN88 I spoke to a local officer = concealing or presenting an intention to steal can get you a shoplifting citation. LP at the store = can only document the event, not call the police. So, the law sometimes does not apply to businesses that have procedures.

Regarding the last idiot, most legal jurisdictions have a doctrine of amotio whereby if a thief moves an item so as to facilitate theft, or deprive the owner of their property, those acts are sufficient to establish the complete crime of theft, as opposed to the incomplete crime of attempted theft.

I can say with 100% certainty that if you are caught in a store hiding items that you are 100% innocent if you don't walk out the door. You simply say you were conserving carrying space for more items if you have not left. I watched this occur with a coworker. He was immediately unhandcuffed and released and essentially quoting from the cop "you are innocent until proven guilty, and since he didn't leave the store, then the store must prove he was going to leave with the item."
