My dad is a contractor. He use to build a lot of basement foundation walls out of block. This one homeowner didn’t want to pay up when he was supposed to. My dad asked him to meet at the job site to work something out. My dad got there early and waited in the still open basement area with a sledgehammer... When the dude showed up, my dad told him that he could either pay, or he could watch as the basement was demolished. Homeowner laughed. So my dad swung his hammer and put a big hole in the wall where the block was not core filled. Guy freaked out and yelled saying that dad couldn’t do that. My dad said “Well, since I paid for the material AND built this, technically it’s mine until you pay for it.” Not sure if that was legally true or not but it worked. Guy wrote a check on the spot. My dad went to leave and the guy said “Aren’t you going to fix that hole?!” My dad goes, “You just bought it in that condition, but if you want, I can give you an estimate for a repair job.” My old man has no chill!

I had a non payer that lived out of state.. all over me to get the roof done because he got the home sold. I did. Then payday he ghosted me. I called on another number he picked up and said hey the slate color shingles looks green (someone sent him a pick) I am not paying for that. I said you signed for the color not the first roof I have done. I do not pick peoples colors. I told him I have made many trips to the house and ran into the buyers and one said she use to roof went on the roof said great install job and her girlfriend said I LOVE THE COLOR. I said punk you are a weasel get the money. He hung up. I had got the buyers contact info and they called me two weeks later said the home inspection raised a few issues not with roofing and the seller was being ridiculous and they may walk. They did. In the meantime I went to the recorders office and placed a Notice of contract on the chain of title. Not a lien just the contract and a statement of balance due. The first buyers walked and two months later he calls screaming I have an attorney friend and you can not do that bla bla bla. I asked O do you need me to sign a release to clear the title before the closing? He screams yes I got a lot riding on this. I replied get the money and I will be glad too. He did.

With the internet these days I get calls for jobs from national companies. I weed them out but I got one now out of FL they are the ones that said 45 days for pay after the customer signs off well 45 now turning into 60 days and nothing but excuses. I said in an email... I am not telling you how to run your business but may I suggest getting out of the class A office space in Boca Roton FL and decrease every pencil pushers salary because you do not even have $250.00 to pay a contractor. You are doing something very wrong. The lady called with attitude and said fill out this one time authorization form so we can pay you and put you down as a NO HIRE. This is all information they have on file already. She said include a copy of a check with void written across it. I did and I also included add this company to my wall of shame. and check for late payment. That was 4 days ago still have not got paid.

Around these parts the Small Claims court allows us to addinterest to an invoice and add any expenses invovled in collecting on an invoice. I had occasion to drive a single mile out of my way on the way to work each day for three weeks , adding the new amounts for my time to drive that extra mile each day and weekly interest. The customer saw the bill increase each day and was in tears of rage as he paid. Sweet dollars in the bank. He then tried to blacken my name and I got even more good paying jobs from those folks who knew him for not paying his bills.

I sold real estate, and I had a client that I found out was stiffing people (I dropped him fast). He didn't pay for the HVAC unit a contractor installed. Unfortunately for my client, the HVAC guy still had the access code to the property. The contractor fried the unit so it wouldn't work any more, and it nearly burned the house down. My client acted like the HVAC guy was off his rocker, but I learned quickly my client wasn't paying people. He had an investor give him $15,000, but spent it on his kids instead of the property and wouldn't give back the $15,000. That investor took a sledge hammer throughout the house. I walked away after that because I did not want to be associated with my client any more. He was bad news.

When a guy didn't pay me, I put a lien on his house. No court order or anything, just a lien I wrote. The county recorder clerk said, "If you don't have a court ordering this lien, it won't work." I said, "Hey, your sign here says you are not allowed to give legal advice. Here is the money, now record it." I charged 10% simple interest on around 1,300 bucks he owed me. Years went by and I almost forgot about it. Then one day I got a letter from a title and escrow company. The guy was refinancing his house and had to pay my lien. I ended up getting a certified check from the escrow company for $4,600.

So frustrating when you do a job and then people don't want to pay. My Dad and I had a small construction business going for a while and we shut it down because we got tired of people trying and sometimes succeeding in not paying us. Just because you don't get paid doesn't stop the lumber yard, or the concrete plant from wanting their money. Last job we did the guy wouldn't leave us alone until we agreed and then tried to back out of paying the last installment. Dad calmly informed him that we could remove the quarter basement from beneath his house with a backhoe or he could come up with the money. Amazing how fast the materialized. Unfortunately that was the third job in a row where someone tried to shaft us so we called it quits. Thing is we were usually the lowest quote by a couple grand so it wasn't like we were sticking people, just trying to make a living.

For those saying "why is he giving back free sand" here's the reasons. 1) The broker needed the sand delivered to the contractor to be paid by said contractor. So the broker doesn't get paid and therefore inconvenienced. 2) The broker will lose his margin on the sand/asset, due to the cost of operations in recovering the sand (excavator, operator). Plus you factor in wastage, he may only recover 95% of the sand/asset. 3) So now not only is the broker not getting paid, he now has a bill from the trucking company that will most likely accrue interest, loss of margin on the sand and additional time and cost to procure another trucking agency. All in all he's in a horrible position.

It’ll be a pain to clean up, $ involved, plus it doesn’t look good for your “on site customers” to see this. I mean, let’s face it, with the way the driver blew through there, anyone catching a glimpse (and look 👀 at all the windows) is gonna check it out and start asking questions. I mean his day.. he’s screwed! Bonus, I bet it’s fun for the driver!

When customer balks on his end of the contract, makes the contract void. Yes he could call the law bout it, then has to explain why company is dumping sand into parking lot. My advise pay the trucking company what is owed, what was agreed upon and get on with life. Not trying to brag (cause I know people been doing it longer than me) 20 years a driver both company and o/o, don't skip paying, do what you are supposed to do and pay the people hauling your freight. Easy and simple to understand.

I do snow removal & when someone don't pay their bill I take my 966Cat loader & pack their driveway shut & I pack it down so its no easy to move with a snowblower or a shovel it takes a pice of equipment!! About 95% of the time they will get the bill taken care of very fast!! Man you have my respect for your!!👍🇺🇸🦅

When the customer doesn’t play, the contractor gets to play. My family owns a garbage and recycling business, and we rent roll offs to the public. In ten years I’ve had to dump unpaid containers three times, and I’d like to tell you about my favorite. A little background on our area, we have a huge hospital, (one of the biggest on the east coast,) which in turn has brought a diverse group of people into the area. Our population in 2000 was 4500 now at the last census it was 17,000. Anyway, we rented out a 20 yarder to a foreign couple. No problem. The problem was picking up the container, which was wayyyy overloaded. (20 yarder with 2 foot of shit sticking out everywhere.). Now in our service agreement, it CLEARLY states that their will be a $250 surcharge for overfilling a container. I tried explaining that to these people all the dangers, hassle, extra work and extra money it takes to make sure that I’m not gonna get arrested by DOT because I have an overloaded container. They were anything but pleasant to me, borderline hateful, that I was doing my job. Now all this time they had no idea that I own a small part of the company, so I’m just sitting back and let the husband curse me for telling him about how they can’t read instructions. I said”I’ll take the container, but you’ll be getting an additional bil for $250 plus any other expenses.” This guy slandered me like I beat his only child. Wasn’t the first time for me, and probably won’t be the last. Anyway, I picked up the container and took it to our shop about 10 miles from their home. I get back to our shop and one of our workers points out about 15 TV sets in the bottom of the roll off. At this point I am fuming mad, because dumping electronics at a landfill is a serious fine, and expulsion from the only landfill we use. Now hadn’t someone seen that, we would be up that certain creek without a paddle. So ya know what I did next? Took that 20 yarder full of construction waste, TV’S and who the hell else knows, and dumped it right in front of their garage. Now they can be late for work, cause they are sorting through their own bullshit. The customer is not always right. I should have recorded the husbands reaction when I showed back up to return his garbage. After the fact, I would drive by at night, and it took him and his bitch wife about a week and a half of cleaning before it was all gone.

Since your contract is with the broker not the shipper, as my contracts were, there were remedies under contract law that could have been taken. These should be clearly spelled out to cover situations such as this. I always included a clause which allowed for double payment if product was not accepted as shipped by the shipper. Thus allowing for fuel, time and vehicle wear and tear. If shipper wanted it returned they had 2 hrs or it went to the dump. Only threatened to use this clause once and they accepted it. Broker would be responsible for my bill. And I would own a brokerage if I had to.
