That biting incident and the punch was intense. I didn’t catch the bite at first, and legit thought the cop just swung. Until I saw the replay. Glad no one was critically hurt though.

When a soft spoken girl says she doesn't want to give her boyfriend's name because she doesn't want to deal with that, that's a red flag that he's abusive. Cops really should have been more understanding about that, especially since she was so cooperative until that point. She is afraid of him, and that needs to be taken seriously.

@@skatingbubba No. The 5th amendment genuinely is one of the more confusing amendments, but essentially it entirely exists to protect you from yourself in a court room and that's it. Because if the prosecution can ONLY indict you by your own testimony, then they don't have enough evidence to exist in a fair and balanced judicial system. Outside of courts, this right doesn't hold much weight as you are legally required to identify yourself and obey lawful commands from authorities in investigations/stoppages.

@@startere1156 In all fairness, the couple of instances I have seen footage of where someone actually gets a lawyer on the phone in the situation leading up to their arrest, these lawyers try to do just that. Some of them act like their client is their sweet little child who would never do anything wrong and the police are the bullies that need to back off before they themselves come over and beat the nasty bullies up. Fortunately, it never worked. The last thing we need as a precedent for a lawyer actually helping in this stage, which is already complicated enough.

Thinking faking one will get them out of trouble. You can tell acting from the real thing. I have had them in dentist chairs, or just driving with nothing bad even going on. Complaints of wrongful arrest and excessive force declined pretty dramatically when body cams became popular. The general consensus is this is exactly the reason; once a person’s attorney sees the footage and can’t justify filing a complaint, the jig is up.

If I was that first couple, I'd be consulting a lawyer. Police often rely on witnesses to establish that a crime has taken place for probable cause or reasonable suspicion. However the store clerk said that they didn't actually see the couple steal anything; only that they appeared to be checking for hard tags and that was suspicious. Being suspicious is NOT a criminal act. Their detainment and search may not be legal. Also, since when are you obligated to identify a third party?

I'm assuming you aren't American? Alright, so the fifth amendment gives you "The right to remain silent" but that's only self incrimination, so she does have the right to remain silent only for questions about herself. She can not use the fifth amendment for anyone else so yes she can get charged for upholding a lawful investigation.

The fifth amendment protects a person from being forced to testify against themselves. Her giving her bf's name isn't something that incriminates her. In some situations, officers have discretion over whether or not to actually arrest some vs giving them a warning or citation. So, she could either give up her bf's name, or go to jail. They had her dead to rights, and used that to give her a way to not go to jail. They would have gotten his name anyway, so the officer was being nice by giving her a choice.

He reacted pretty fast and swift, so it caught me off guard and at first I thought it was unnecessary, but once I knew what had happened, I still didn't like it, but I fully understood it and did some quick research about it and what he did was to slightly knock her out so that she would be subdued, which is pretty smart. Perfect acceptable (by police department standards/policies), and they're taught how to do it properly. I'd rather as opposed to officers being expected to just act like a chew toy.

He always did his job! Always! He never lied or coerced to get a confession. He always told suspects that it was in their best interest to have a lawyer. He never tried to enter a dwelling without a warrant. He always said that there are cops who are lazy and don’t care about protecting and serving. They think the uniform gives them power and love taking short cuts, lying, manipulating, and abusing their position. He said that’s why some cases don’t get solved, they just get anyone they think did it, and put them away. Because they didn’t want to do the work to find out the truth! He even helped with the innocence project. Miss him!
