हमने कई किरायेदारों को कोर्ट से स्टे आर्डर लाते और मालिक बनते देखा और सुना है. भारत के कानूनों का कोई भरोसा नहीं, किराये दार को चार पांच साल से ज्यादा न रखें. भारतीय कानूनों में कहीं भी एकरूपता नहीं दिखलाई पड़ती है.

Sir, very important information. You are right general impression is that tenant becomes owner after 13 years, which is not legally correct. म. प्र. के मु. म. ने एक बार एक स्टेटमेंट दिया था कि " कोई माई का लाल...... नहीं करा सकता है..." उसी तर्ज पर मेरा कहना है कि " कोई माई का लाल किरायदार से अनुबंध करा कर दिखा दे आते समय 11 माह का अनुबंध कर लेता है वाद में टालमटोल कर समय निकलता रहता है शासन व पुलिस प्रशासन खुल कर किरायदार का साथ देता है कोर्ट में जाने पर वकीलों की तिकड़म बाजी के चलते 10 से 15 साल निकलना बहुत आसान बात है बस एक ही तरीका है &#® समझ गए होगे। " जय हिन्द जय भारत भारत माता की जय "

कानुन ज्यादा लुटेरा को अधिकार देती है माना की मकान मकानमालिक का होगा लेकिन बहुत बरी कीमत चुकाने के बाद,कानुन,कानुन के नाम पर मकानमालिक को बुरी तरह से ब्लेकमेलर करता है और उनका पुरा खुन खींचकर न्याय देता है।

Why do I need to pay 2% of the rent agreement every year. I am living in residential area and 2% is applied both in residential and commercial place. This is unfair. In commercial place, the intention is run a business. But in residential area, it is 100% expense for a tenant.

For all Landowners... Instead of rent agreement we should go for Leave and Licence agreement which gives the right of only using the premise does not create any right of tanent. Why u want to establish a relationship of tenent n landlord. Instead go for this agreement. Ex: u watch a movie in theatre u buy the ticket bt that does just mean a permission for limited time to use that place bt u dont own the theater in anyways. Leave and license is same like theatre example n get it registered, so it will be conclusive evidence.

How a tenant can be vacated? I've seen cases where tenants pay a very nominal rent (say Rs.5 per month) via court and possess the property for lifetime, years after years that the owner leaves the topic.

Thank you Advocate Mr. Naresh for your valuable information 🙏 Please let me know if a tenant who has been residing in flat since past 14 years on Tenancy Agreement of 11 months each (renewed in each term of 11 months), can claim ownership of the property. The agreement has been made on Rs.50/- stamp paper and cash receipts are also not issued, as the tenant does not insist of a receipt. Please let me know if under this circumstances :- (1) The Tenant can claim ownership of the property? (2) If he refuses to vacate the flat even after giving 1(one) month's notice as per the condition of the tenancy agreement, what are the legal remedies / options the landlord has to get the flat vacated (irrespective of wheter he continues to pay the rent or not) ? (3) What should be the value of the Stamp Paper as it is presently being done on Rs. 50/- Stamp Paper? (4) Should the agreement be notarised? (5) Should a cash receipt be issued to him or not (he is paying by cash only and does not ask for a receipt)? Regards and Thanks 🙏

As far as I know, in Karnataka, Stamp Value of any Agreement is Rs100/- You can use any number of Stamp paper/papers for the wordings of the Agreement but the total value of the Stamps need to be a minimum of Rs 100-/..

I feel this law should be a little diluted because old people who have rented their House or any of their property which is their source of income and they can't move anywhere, alone, weak vision, memory loss unable to understand for such people some relaxed law is necessary. Otherwise where they have to go. Law should be in the favour of the land lord and not the Tenant. And the landlord can ask him to vacate at any time with one or two months notice. Its known now " MIGHT IS MY RIGHT " works such things should not happen.

Sir, if the tenant comes to know after a long period of time that the landlord is not a real landlord of the property in Khasmahal land and is not the leaseholder also of the Khasmahal property in which the tenant is staying then what should the tenant do according to the law in such a circumstance.

Hi, I agree with Mr Shankar Sharmaji because we faced this personally, our tenant was not ready to leave because, within the first eleven-month of renting the property, the rent of that property was gone very high so the tenant was refusing to leave the property, the matter went to court and after paying the legal fee also tenant was saving the money on the difference of the rent. After 18 years of legal battle, we won in the district court then the tenant moved to High Court. All this period of 18 years tenant was paying the old rent only so you can think how much he must have saved in the difference of rent, ever after legal cost.

इसी को कहते हैं अंधे कानून अंग्रेजों द्वारा बनाए गए इस तरह तो इस देश पर भी अंग्रेजों का कब जाए अंग्रेजों ने 200 साल तक कब्जा कर लिया है जो कानून न्याय सत्य एवं धर्म पर आधारित ना हो वह कानून ही नहीं है अंग्रेजों द्वारा बनाए गए अंधा कानून तथा कंगारू कोर्ट के तथाकथित आदेश असभ्य तथा अपमानजनक होते हैं न्याय प्राकृतिक होता है चाहे सैकड़ों वर्ष बीत जाए अनंत काल का समय हो किसी वस्तु पर किसी अन्य व्यक्ति का अधिकार तो नहीं हो सकता है जो जिसका है उसी का तो रहेगा अंग्रेजों द्वारा बनाए गए पाखंडी कानून आज भी चल रहे हैं जहां चपटी धरती वाली अब वैज्ञानिक तथा असत्य पुस्तकों को धार्मिक पुस्तक बता दिया जाता है तथा उन पर सत्य की शपथ तथाकथित न्यायालयों में दिलवाई जाती है

What If the agreement is over on October 2020 n tenant wanted to vacant the house on 11th November 2020, but owner was reluctant to only give the money once the belongings is kept down in building premises n handover the keys to him, n if he feels like the flat is OK only then he will transfer the security deposit, for which the tenant didn't agree, n tenant kept on asking for the security deposit since November 11th 2020 till 4th Febraury 2021 , but the owner kept on delaying it, and now he is sending us threatening messages for which we have done NCR against him, but he hasn't stopped still n also he complained that we didn't pay him rent since October 25 2020 (which is false because he is holding on our security deposit) , what can be done kindly suggest please, kindly answer, and If the new agreement was never made from 25th October 2020 how can he claim that we should pay his rent and electricity bill as he has kept us in his house forcefully by not returning our security deposit amount back as then it's his mistake , kindly suggest me please what can be done??
