That's probably why he is going to JAG. I regrettably signed an Article 15 over something stupid because there was no punishment just to get it over with. I kind of wish I feel it just so I didn't feel so dirty. But it was not worth me loosing and getting real corrective action.

One of my coworkers still doesn't understand how I am willing to be so "combative" to higher ranking people and will straight up call them out or challenge them. I haven't quite gotten into things this bad but got close. But I also know when to pick the fight and plan out what the results would be; one fight I didn't pursue was with the vice base commander, but there is plenty of record showing that he was a dirt bag and got himself into trouble.

If you get out of the army without getting at least 1 article 15 at some point there's 1 of 3 reasons. 1. You didn't stay in long enough 2. Your a super soldier PT stud that gives sergeant major a hard on 3. You didn't live life hard enough Greatest first sergeant I ever had told me when I was a pfc "you'd be hard pressed to find a 'good' nco who doesn't have at least 1 article 15 in their career." As a lifer, I can honestly say, that I have seen my fair share of these type procedures. The first story, you will not believe, mainly because of the soldiers name. I was a SQD LDR, had an E4 who's last name was Dumass, true facts. He was a generally good soldier but had an issue with getting up in the morning. Several times this soldier was late for PT and the 0900 formation. As we all know, you just don't be late for PT. Anyway, he ended up missing the DIV run so the CO demanded action. So I laid out a plan, if he missed formation again, I was referring him to the PLT SGT. If he missed a 2nd formation, he would be recommended to the 1SG/CO. Paperwork was in place, it was up to him. Within 3 months, he had had his first company grade ART 15. Within 6 months he was chaptered. Last story. My unit went to JRTC in Jan for a training rotation. I volunteered my SQD to work the night shift which ran from 1600-0800. Our training cycle went for 17 days and my SQD performed above expectations. When we got back to Garrison I put all of my soldiers in for AAM's for various actions. Within a couple days, all recommendations for awards were sent back. The reason, clerical errors that needed corrected. So I went to the S-1, sat down with the clerk, SPC (I don't remember her name) and together we fixed all the recommendations. I promptly resubmitted them and within a week, they were sent back with a note on the packet the stated; "I don't give awards for soldiers who just do their job". This pissed me off, but as an E5, not much I could do. Placed all hard copies in a file folder and that was it. Fast forward 3 months and I get called out for an award. I was recommended for an award and they approved it, get this, for outstanding leadership during the same training cycle that they denied my recommendations for. Needless to say, I was pissed. The 1SG, read the award, presented it and completed the other 3 soldiers awards. When he was done, everyone clapped, I requested to speak to the unit. I explained that I had submitted them for awards and they were denied because in our unit, soldiers don't get awards for just doing their jobs. I called the unit to attention, informed the 1SG that refused to accept the award and requested that he remove it from my 201. What I didn't know was the BN CO and CSM were standing to the side and witnessed my actions. This led to me and my entire chain of command being called to the BN HQ and a 15-6 investigation. In the end, all my soldiers received their awards, 2 had ETS'd and 2 had PCS'd. My 1SG was asked to retire or face a bunch of charges for gross negligence. I was verbally reprimanded for calling out the chain of command at the formation and not using the open door policy.

After being given extra duty and restriction for 4 weeks without NJP, the acting 1st Sgt then filed NJP and CO elevated it to field grade. I demanded a summary court martial as I had already been punished informally. The JAG refused to file charges and I got an early out. General Discharge with Honorable Conditions and no loss of rank, awards or commendations.

He was able to get away, we even havd evidence it happened and yet he is the one getting punished and discharged. I swear during my article 15 hearing I had this young, milk on his breath captain try to tell me what a shit soldier I was. Because I didn't let my Platoon Sergeant talk to me crazy. Only thing I did was stand up and politely asked him who the F@ck was he talking to like that. He felt threatened and went and cried to our Sergeant Major. Then asked me why did I do it. I told the Captain that I volunteered just like he did. I didn't volunteer to be abused and disrespected. I'm still shocked I did 20 years.

If you have a shaving profile, it's in your medical record. If you get written up for that, I'd ask to speak to JAG first. JAG gets a copy from your medical record and would ask the CO if he really wants to go forward with this. Of course, you're a marked man at that point.

@@austinferrell4921 Generally speaking, if you oppose the command they will have it in for you. That's not how it's supposed to work, but we're talking about human beings here. Putting on a uniform doesn't change that. If you challenge them (the command) they will nit pick you to death. They will judge pretty much everything you do and look at it in a negative light pretty much exclusively. I saw a guy in my company who opted for a courts martial rather than "office hours" (USMC) and he won. Well, that went over like a screen door on a submarine. Thankfully, the battalion had a regulation that required him to move to a different company or he could opt for a different battalion on base. He opted for a different battalion.. The powers that be, be they Army, Navy, Air Force or Marines don't like to lose and when they do, they'll still extract their pound of flesh in some other way. Oh, and I'm sure the company commander in that guys new command got a phone call from his old command....so yes, it can mark you for the rest of your career. But I will say this, there ARE officers who give a guy a chance to start fresh....but it's not totally, but somewhat rare.

Heres my article 15 story. Was stationed at ft.benning to help train basic trainees. Specifically for mounted react to contact training. I was a driver of hmv and other vehicles and instructed basic trainees about the vehicles. The company I was in often provides soldiers for military honor funeral detail. Well a month straight we had a range every day of the work week. We were usually pretty buisy but atleast 1 work day wouldnt have a range. NOt this month. Meaning every day of the work week we were out on the range training basic trainees for a month straight. And on the weekends some of us would be selected for Military honor funeral detail. I was always selected for this detail. Because i was one of the more trustworthy. And always had my dress uniform ready when inspected. I always kept it ready for inspection. So for a month straight I was working every day. no days off from 6 am to 5 pm or longer if the range hadnt been completed before 5pm. And on the weekends i was part of military honor detail. Now during this month is when my drivers license needed to be renewed. But I was never able to make it to the dmv because i was always at work. I think you see where this is going now. After the uptenth time of telling my nco that I need to have one day off a range to go to the dmv to get my license renewed. . The day my licenese expires came and went and I get stopped by a cop heading to work for pt. I accidentally had my brights on. Civilian Cop: Sir do you know your license is expired. Yes sir. I just havent had a chance to get to the dmv because of my duties. Stop making excuses son. Get it fixed. Heres your ticket. I got an article 15 because i got that ticket. I got that ticket because my duties didnt allow me to make it to the dmv. Exact words out of my company commander: You should have got it renewed last month. lost of rank, 2 weeks of extra duty (which consisted of my normal duty then from 6pm to 12 am I was at battalion mowin lawns cleaning all that jaz. 2 months later i was repromoted to the rank i had before the article 15. OH and I fought the ticket. Went to court explained the situation. And the judge dropped the ticket.

Think we had 10 people who got extra duty and lost rank right before getting out. On top of that they were Med boarding out so wtf they doing at PT anyways. This happened often in 10th Mtn. I personally saw a guy get artied for disobeying a direct order. The private had broken 5 vertebrae and the orders were to pick up a 2,000 lb machine. During my first enlistment, I earned 6 Article 15's (5 Company grade, 1 Field grade), all for Insubordination. I was young and dumb, and could not keep my mouth shut when stupid shit was being done or ordered. Once you got on the lifer's radar, they would call you on even the slightest thing. I was an enigma, as I was very good in the field (top TOW and Dragon gunner and gung ho when performing missions, weapon firing etc...), but when I got back into garrison, I was a real pain in the ass for command. Loved and hated. Still did over 2 years as an E-1 over 2, and received an Honorable discharge. They even allowed me to reenlist a decade later. Finished out with 6 years total, no more Article 15's, and rose in rank to hard stripe E-4 Corporal. Go figure!

Unfortunately for a friend of mine, he got an Article 15 for the destruction of government property. He punched a wall and broke his hand instead of punching the officer who was screwing his wife while we were away training in Grafenwoehr Germany. Nothing happened to the Officer, but he was moved to another base. We actually had a Captain who was exactly like him, he was pissed off because he was passed over for promotion three times and took it out on us. We had 6 Article 15s in one month for minor infractions, the place was a joke!!!

When I was in the Marines (CH53 crew chief) I went to the beach and got sun burned AF! So sun burned it felt like I had the flu, puking, diarrhea, cold shivers, et al. The week after was an absolute living hell. But, I didn’t miss a second of duty. Even when I had to wear the aircrew gear during flight ops whenever we landed and I took my vest off my shirt was drenched with fluid from all the blisters on my back, chest, shoulders, etc. I remember peeling off a 14 x 8 inch piece of skin, putting two holes in it, then sitting on the jump seat and saying to the pilot “are we getting close , Clarise”, when the pilot looked at me with the WTF look on his face I did the slurping action. Lmao He didn’t laugh, just looked disgusted. Hahaha! The good ol days.

Oh I've seen the shaving waiver getting torn up (It's a recommendation from the mil doc, not an order until signed by the CC was the line of bull) Also got to witness an Article 15 for chambering a round at a clearing barrel. No discharge, caught error and cleared properly. Battle turned him in after.

@Eric Cartman We only had one "battle buddy" during basic & AIT. (The only role they served was to hold your weapon when you went to the latrine and to provide the other poncho in order to construct a tent).

I know a buddy who after a FTX no sleep 12 mile ruck went home drank beer, and showed another soldier from another unit his handgun. While drunk he loads it saying “this is how to load my weapon” he then says “this is how to unload” charges the weapon, drops the mag and then says “then you dry fire” pulls the trigger and the round ricochets off the bed frame and goes straight through the other soldiers tib and fib. Immediately calling 911 and while on the phone with the operator he says “it’s ok I applied a tourniquet “ when the ambulance shows up the tourniquet was so loose he was still bleeding out. His punishment? No reduction no extra duty, instead he had to teach all weapon safety briefs for the entire year as well as any class involving the proper application of a tourniquet

Not related to an article 15, but I was doing my AT and every day we had PT, I mentioned my back was hurting. Told to run anyways. This went on for a week before one day I had my NCO talk to me about having issues with coming to him about our problems (personally, didn’t respect him, but I listened anyways). Went on to talk about PT and doing it to standard and such. Was told to run instead of walking after knowing my back hurts. I ran. My back seized up. Sent to the hospital. Edit: What happened after this was said NCO getting the Battalion SGM have a talk with him and CO with my LT. Mind you, I had other NCOs know I mentioned my back hurting while doing PT and other duties. I even had one tell me that I was basically being lazy on PT and was told to never show up again, go into IRR, or get a profile. My unit was full of this crap.

Got a company grade in Korea for breaking curfew January 02. Don't know if you've ever been, but it gets down to sub zero temps in winter with the wind chill. So me and my two buddies that also broke curfew had to take the sand bags around the HQ building, bring them into the utility room for the building, old Camp Casey barracks from back in the day, thaw them then take the thawed sand and refill new sandbags.

LOL My 1stSgt at Courthouse Bay (1371, rah) was legit getting pissed off at me during my first counseling with her prior to getting a company NJP because I WASN'T trying to grovel at her feet and that I was being a grown ass man and accepting the fact that I fucked up. "You're just STANDING there like you're just gonna ACCEPT your PUNISHMENT!!!! REEEEEEEEEEEEEEEEEEEEEEEEEEE!" I'm just standing there thinking like...the FUCK you want me to do, 1stSgt? Cry like a little bitch and beg you to not be mean to me? I guess she was used to the younger group of junior Marines she had to deal with, but my ass was like 27 at the time, married, had a kid. I know how to handle my mistakes.

Heath Dean BAHAHAHAHAHA that is hilarious! The worst I ever went off on someone was a Lt. Col ginger out in 29 palms. So I got messed up on range 400A. Some boot as engineers placed charges incorrectly and a little to close, I got hurt and continued running the course and had a major heat stroke. Long story short, my nerves got fried. So I’m walking like the fucking ginger bread man from shrek, I kept requesting a cat scan, well this Lt. Col does a little joint test on me and says “marine, you are fine. There is no need for that”. Now remember my nerves are fried so I can barely walk. I screamed “Fuck that shit! I want a JAG officer right now and everyone in this room I want the damn names of and I’m filing hazing charges!” And I continued going off, the next day I was driven out of base for some cat scans and they found 6 hematoma’s on my spine.... sometimes you gotta lay into a mofo. Ooooh Rahhh

@@thejonohshow5914 Jesus, I WISH I had had the stones back then to go off on this woman. I was brand new to the Corps, about 5-6 months in. PFC, 27, married, kid. I had to keep my mouth shut and just suck it up or else I probably wouldn't have gotten the lenient punishment I DID end up with. 14/14, $400/mo forfeiture (SUSPENDED, thank fuck). My company CO was a Maj, so if he had WANTED to, he could've gone field grade on my ass and taken my skeeter wings, but he felt billet over rank was appropriate and gave me a pretty light punishment. If 1stSgt had her way, I can damn near guarantee I'd have gotten 30/30 and loss of rank. Joke's on her, though, I still made Sgt before I got out. My command when I hit the fleet was like, "bruh, that's the dumbest fucking reason I've ever heard someone getting NJPed for." Glad they felt that way, cuz they could've made my life a living hell for being a shitbag getting an NJP in the damn schoolhouse.

I was still married but legally separated for over 2 years, living in separate state's, when I met my (now) 2nd wife. 12 year's, Clean record, 5 deployment's, Solid NCOER's. Field-grade article 15 for adultery. 45 and 45 busted down from E-5(p), then got RCP'ed. Battalion CO was a female.

I've had a few Art 15s while in 10 yrs and most of them I possibly deserved. One, however, was because I was in a collision on my motorcycle off base when a woman on her phone merged into my lane and knocked me off my bike. I shattered my elbow, cracked my shoulder, and broke my collar bone. My BN CDR did try to take away any possibility of sick leave to recover and demote me citing my injury was self-inflicted.

I was offered an art. 15 once. It was the word of a drunken private against me, an E-6. Knowing he had shit for evidence, I refused the article 15 and demanded a court martial. The BN CDR got plunked because he wanted a staff sergeant soooo bad to make an example of. He left the battalion to become the 8th ID inspector general and the new BN CDR threw it all in the garbage and told me to soldier on!

1:20 ... Higher orders. I don’t know about other branches. In the Marine Corps, though, every time a Marine - especially an enlisted Marine - gets a promotion, we are reminded to “observe and follow such order and directions as may be given from time to time by superiors acting according to the rules and articles governing the discipline of the Armed Forces of the United States of America.” In other words, if the Company Commander gives a direct order to a junior enlisted member to follow a specific instruction, that junior enlisted can’t gaff it off because a squad leader or platoon sergeant refused to let them carry out the CO’s order.
