It's not about if it's sinking in or not, it's about NAR eliminating their competition and monopolizing the market and paying high priced lobbyist to argue in congress to pass their requests. The problem is, we don;t have a voice in the argument and need you Jerry, Pace, Jamil, Brent and any of the other leaders in this industry stand up for and defend our industry.

This is exactly what it is. This is why it’s the real estate board in SC that created this law. They only want to funnel sales transactions through the on market platform and limit the money made on transactions.

Yeah Jerry, I talked to a flipper named Brandon who does a lot of deals, who flips in GA and SC, and he told me some things about this guy you interviewed. He was one of his students. He knows the guy pretty well and he said, this guy pushed for this law so that he can make money for his own program to teach people about installment sale technique. This guy even admits in this interview that he had a conflict of interest and that he couldn’t say much during the meetings about the law. But clearly he put his two sense in, so that wholesaling could be outlawed in SC. Because “wholesaling is a dirty word” and is a problem. Now he can make money with his real estate installment program because wholesaling “isn’t the best mechanism” for real estate. Ugh!!! 😩 why do people have to be greedy and selfish.

Again you’ll put all the information on the internet and they use it to fight against it. These guys want to take the money out of your pockets and put it back in their pockets. He clearly on the side of the people that stress fighting the wholesalers. I can quit watching all of you now. Good old boy system still at work in America and they wonder who people are leaving. Wholesaling, often involve contracts that are governed by common law principles. This means that the rights and obligations of the parties involved are determined by the terms of their agreement and established legal precedent rather than specific real estate regulations as it is in the Real Estate Industry. In the United States, the Supreme Court has recognized the right to contract as a fundamental right under the 14th Amendment to the Constitution under the Due Process Clause and the Contract Clause. If a State interferes with the peoples right to contract the law should and would likely be struck down. This attorney is full of it. If everyone knew the truth the Real Estate Industry would fall on it's face and wholesaling would be all that's left.

Seems like the safest answer is to buy with seller financing (sub-to, carry-back, cash, etc.) and then re-sell as the owner of record.

Jerry ready to lend his money to make money off of the newbies and he and this attorney probably got a special training or class coming out soon together. LOL If I agree to sell my house and the buyer is okay with my price. Why the heck do I need to have someone tell me, I need to give this broker my money who has done nothing. This entire podcast got Jerry paid on views and comments at the end of the day. LOL They wholesale everything else but real estate is an issue. They all are full of it and now they will capitalise on it together. Good Old Boys.

It appears to me, since they are losing Agents left and right, this is way for them to force people to either stay a realtor or become new ones. Its about existing.

The guy said, “they have no jurisdiction over you so they want you to get license so they can have jurisdiction over you to control.” And, so how will homeowners get rid of their house if Realtors aren’t performing code of conducts to protect the interest of the sellers but yet you have sellers loosing their house due to foreclosure due to Realtors not performing as promised. Realtors lie a lot in regards they can sell your house but in the end leave you dry because they can not perform. I believe if I was a seller and a realtor wants to perform as my agent he/she should place EMD so if they do not perform they should loose the EMD for not performing. Realtors has no recourse for the lies they say to a seller, Realtor should have a skin in the game too. My two cents.

I agree totally. Realtors tell home owners I can sell your home for 200k when it’s only worth 150k so the home sits on the market and never sells. What’s being done about that?

He's boasting about illegally roping Wholesalers into being an agent if they want to be able to wholesale understanding beforehand that it's actually something deemed illegal or forbidden after becoming a licensed agent. All parties are doing tings to further advance their own agenda. The only difference is they are the law.

I know of one wholesaler who currently has a seller under contract who is in pre-foreclosure. It's a bad deal, and he can't sell it. He's just extending the contract and stringing the seller along. This is why the laws are changing. Many wholesalers back out the day of closing. I think it's disgusting. You reap what you sow.

Great video! Does the wholesaling law in SC apply if the wholesaler has an active real estate license? I think Alabama passed a similar law requiring a wholesaler to be licensed if they want to market the property/contract.

A ton of horrible realtors butt hurt because they're getting out worked by wholesalers. Most realtors only care about commissions and looks and not the seller. Most are glad to let a seller bring money to closing or just break even as long as they collect their commission. 95% of realtors are trash and lie. 5% are unicorns and great in my opinion.

It's the Realtor Association that should be sued for trying to corner the market on who can sale real estate without having to pay realtor dues to and having join some "controled" group. Where is the American Freedom where two people can agree on something in writing or the shaking of hands, do business without the State getting involved in a private practice?

So in effect : 1) Realtor associations he says want to eliminate wholesaling. 2.).There was no jurisdiction to legally out law it. 3). So they add a law that to wholesale one is required to have a real estate license.4) once you have a RE license, they the powers that be, eg, commissioner can regulate what a RE can do, & with intent they say & regulate new law that as an RE licensee, you cannot wholesale - wholesale is now not legal. Gotcha. Essentially this is a back door created to outlaw an industry of wholesale currently not regulated, not required to pay fees & dues for local, level, state level, & national dues & fees , etc. Wholesaling is being backdoored to come under control of the big corporate Blackstones- what do you think? I see it as a power grab

So what you're doing is giving into the NAR, because you can afford to do so; and hanging a huge number of beginners or anyone at any stage in the game that can't afford to do it your (the NAR's way), out to dry. You're a traitor to the business, and have switched sides because you can afford to do so. And just to show how ridiculous this whole situation is, think about this. It used to be that you could use the end buyers money to fund a transaction. But the NAR, in their ever vigilant fight against wholesaling (even though wholesalers and agents make great partners; what do you think that's about, maybe control and all the money the NAR makes off their agents), had legislation passed to outlaw that way of operating. But in a transaction facilitated by an agent between a buyer (in wholesaling, the 'end buyer'), and the seller, the buyer is bringing the money to the table to make the transaction happen. So the hypocritical NAR is stopping a wholesaler from doing exactly what they're doing with every transaction.

Don't "market" the property that you have under contract. Ask your "investment partners" if they're interested in partnering on an investment opportunity. Then just double close

This is my thought. I bring most of my deals to my cash buyers for a finders fee, in the end I don't have to sign a contract. This will just weed out the weak.

45:33 Perfect strategy Jerry! 👏 ... Something we're doing now too is ... (1) Buy the property with nothing down creative financing ... (2) Clean it out and clean it up ... (3) Resell on the MLS or to a cash buyer ... With the ideal turn around time being less than 90 days start to finish ... Ultimately, it ... ✅Allow you to buy the house and get into the deal for close to nothing (lowering the barrier to entry) ... ✅Avoids you having to do big fix and flips that take time and require a lot of money ... and ... ✅The seller doesn't have to wait long to get paid on the back end (and neither do you 😉) ... Ron Legrand does the same type of thing with fixer upper types of properties what he calls his sweat equity program. Does it as a lease Purchase just with a distressed property.. or would you prefer to do something like a sandwich lease option?

Jerry, Gary talks about doing a contract for deed and then sell after its been repaired. Could you do a novation with a flipper and have them pay for the rehab, then they get their profit on the sale and the "wholesaler" or Contract for deed investor get their spilt in the middle? Do you think this would make sense and work? One other thing, what about the property that has a mortgage on it? Would you need to do a wrap or a sub 2 to be able to get the property to the point where you can do what I said above? Hope that makes sense.

A deal is a deal regardless. If a property is a deal, get proper funding (hard money, family, borrow 401L, etc) and then market and sell the property.

How would a lease option work with this new law? Would you have established equitable interest during the lease period and be able to find a buyer during this period?

Also, what If I as the investor use say, your cash to buy the property in SC, and then sell it to an end buyer. So the best thing to do would be to JV the deal? Basically work for your cash buyer as an employee and get paid as if it were a commission that way there’s no BC contract?

These the same kind of people that know little about anything who make laws that claim to protect people. Until you see it doesn't protect the citizens from anything. Its true intentions, in this case, is to protect the agency. You heard how the Association had been fine millions. Where do you think they need to recover those losses. By getting wholesalers out of the way. What agency been in the halls of power trying "create" laws to , so-call, "protect the pubic?"

Thanks for sharing this, however I wish more time was spent on explaining the actual "solution" or "alternative" to wholesaling... How exactly do installment contracts work? It seems there is very little differentiation to the wholesaling method, with the exception that you're putting a very small down payment "$1,000" to get on the title/or deed??? Then afterwards, you legally can market the "installment contract"... that's hardly a big change, unless I'm missing something. The attorney sounded like it was so different from wholesaling when it's not... Jerry can you do a separate video going in depth on installment method? Unless you already did one... and I missed it. The difference is that YOU are actually TAKING TITLE / OWNERSHIP of the property. That is the one and only prerequisite to being able to market and sell the home.

Just get your license and represent your buyers on the deal. Charge them whatever % commission you want. Problem solved. No risk. No jumping through hoops.

So should we just get our real estate license and then wholesale the contract of homes? Bc I don’t want to just list the property and just wait for a buyer just to get 3% fee. Even with a license, that’s not good enough for me. What is the solution? I just can’t think of a real solution…..

You don’t even need to do that check out the flip with rick guys they exposed this law and how gurus are taking advantage of this to mislead wholesalers into thinking its banned🤦‍♂️ even if this law were to pass you can still wholesale in SC but you cant advertise or market the property as if you own it.

How about option contracts? What if we are honest with our sellers and let them know hey I’m not the end buyer but i know we can get “X” price done and I can introduce you to my friend who would like to buy the house. Or something along these lines? Then have a referral fee with your friend or end buying investor. This all has to do with ethics and honesty with wholesalers and sellers. Just. Be. Honest.

It's been coming a long time. I was talking to someone in CA about 10 days ago who was pitching a course, and I told him that the hammer was coming down here and nationwide. I have funded wholesaling and rehab transactions, and I pulled out of it 3 years ago. It was inevitable, but now, if the governor signs the bill (which he will because he is effectively a Democrat with an R beside his name), it will become law here. This law could set a national precedent, unlike what is happening on the West Coast USA.

What about co-ownership agreements where your not put on the title or loan and your co-investor (who you bring into the deal) has the option to buy you out at anytime.

That's an approach that could have some merit. Sounds like it should work, provided the seller gets full disclosure about the process to follow upon his signing of the contract; which probably should contain language that calls on the seller to uphold his decision to sell this way, in case the state gets involved and tries to derail the deal under this new law.

@GaryPickren How about putting the the property in a land trust and afterwards assigning the beneficial rights to the land trust to you the wholesaler. Then you can assign your beneficial rights to the end buyer or even sell it to him since you will hold title as trustee.

Flippin Genius, I still don’t understand how this is supposed to protect the seller where they have agreed to a wholesalers price and terms (the agreement). Especially IF😂 they’ve already hired a realtor and the realtor was derelict in their duties by not getting it sold. Please ask the attorney to explain how this law protects the seller. Now, in property damage claim cases where an assignment can be abused by charging more than customary contractor fees and where there is a one-way fee statute whereby the contractor can have his attorney fees and costs paid by the insurance company (if they prevail) even if the contractors charges are outrageous, I would understand. But in the wholesale scenario, I just don’t get it!

Trust me just how Illinois passed it and they didn’t enforce it. South Carolina is the same way and I have a close relationship with my closing attorney you can hear it in the guys voice that he knows it’s still going to continue to happen. I’ve been doing business in South Carolina for four years & counting & They’re not going to enforce that, keep doing your deals stay optimistic and go crush it!

installment contract (contract for deed, land contract etc)is very reasonable. no problem with me. but private assignment of contract is protected under historical contractual law, protected by the constitution and with historical precedent since the magna carta. i dont need to be a licenced agent under your jurisdiction at all. nar and sc has no right to outlaw assignment of contract. assignment of contract (ie; "wholesaling") is constitutionally protected. your invented statutes are not constitutional law. i can market my contracts any time i want. its protected constitutionally. it is not under your fabricated jurisdiction

What's going to be interesting, how a distressed home owner sell there property when banks won't fund the deal. And this will effect the realtors income also, and not to mention all the walk aways and abandon homes how will these home be purchased & rehabbed. Alot of lay offs in our industry. So what about seller finance, falls under the term installment method.

Not to sound like im making excuses but the installment method may work in some situations but what happens when a good wholesaler wants to use his super powers like getting an owner out of a desperate situation when the seller has literally less than a week before shit hits the fan. There has to be another way for the quick transactions to happen because we know realtors cant do it expediently like we can🤔
