California’s initiative to allow college athletes to profit from their talent is a boon especially for women and competitors in sports without pro leagues.
An exuberant top-scoring floor routine by U.C.L.A.’s Katelyn Ohashi went viral this year, making her one of the most famous college gymnasts ever. But N.C.A.A rules prevented Ohashi from making any money from the performance. In this Video Op-Ed, Ohashi argues that college students should be given the ability to earn income from their athletic achievement.
Last week, Gov. Gavin Newsom of California signed a law to do just that. The Fair Pay to Play Act, would allow college athletes to strike endorsement deals, a move that would transform the entire business model of college sports. Changing the rules would be especially beneficial for women and athletes in sports that lack professional leagues.
But California’s changes aren’t scheduled to take effect until 2023, and that leaves the N.C.A.A. plenty of time to mount challenges to the law. If the law is upheld, the N.C.A.A. will have to decide whether to penalize California’s universities with fines, or even expel them from the association. For now, California is betting that the huge size of its college system, and its influence in college sports, will make that impossible.

@@curtisoneill926 They're paying it back with ticket sales, people actually paying upwards of $30 for autographs and pictures with the players and television deals etc. In football, teams can have up to 85 players; in 2 seasons, they make back the scholarship money with millions to spare. Answer me this, why do collage athletes have to sign away their commercial rights ?

Referring to NCAA athletes as "amateurs" is a misnomer. There's nothing "amateur" about college sports. It is a multi-billion dollar industry with rich television contracts, licensing deals and massive gate revenue. The students get little to nothing out of the deal, while NCAA executives get ridiculously rich by holding a gun to the heads of these young athletes.

Wadley Jred it is a multi billion dollar industry. And yes we get a scholarship but that does not equate to us repeatedly putting our bodies on the line and sometimes ending up with lasting physical issues as well as mental issues (concussions). At most schools we are barely given enough money to live off of. At my school we had to pay for parking to even go to practice. With school and sports full time there’s no time to obtain outside work. Even if you could many coaches prohibit it. The new bill is atrocious and doesn’t address the actual needs of students and how to correctly pay them a fair livable stipend. But at least it’s a step.

Colleges not paying athletes is one thing. These athletes are not even allowed to accept money from sponsors which is ridiculous. How is it even legal to ristrict livelihood in America.

@@doitrytebetaversion6295 just because you agree to follow the terms it doesn't mean you have to agree with or and aren't allowed to want to change them. These athletes aren't treating this as an after school extracurricular activity. The level of effort and commitment put into it makes it a job. They work 30 to 40 hrs a week on this, yet the student sitting on their but all day at the dorm front desk sees more benefit. Many students drop out of school early to join professional leagues to get paid. Maybe if they were paid while in school more would stay to graduate.

They received 100% tax free college tuition, room, and board. If they were to make money off of this, it all would be considered income and taxable. 4 years of college can be over 100K, most NCAA athletes are not worth that much. It is their choice to sign up or not.

@@studio3js196 Im just pointing out that it's not like they dont recieve any benefits. Additionally, it seems like a good idea in theory but it would create an uneven playing field where the rich schools will only get richer as the less funded schools lose out on recruitment. Not to mention the bidding wars that would occur, ultimately taking funds away from educational programs and allocating more to sports. HOWEVER, just because I don't agree with the universities pouring more and more money into athletes than they already do, if there is a way to lift the restrictions that NCAA has that they take partnership deals with Nike or whoever. If private investors want to pour in money to some athletes sure, but sucking up more university/taxpayer funds-- especially in schools who aren't even as well recognized in sports but would have to do so to try and keep up-- is a no for me.

I’ve had this problem with NCAA for decades. These schools makes millions off of these kids and just pocket all of it. Meanwhile tuitions are higher than ever.

@@crypticfable You might be right, but that is peanuts compared to the revenue the schools make of off them. Mens basketball for example, March madness brings in an estimated $700 million in ad and ticket revenue. Split 60/40 with the NCAA and that doesnt even begin to bring into account merchandise. Think of if you played college basketball, and you were really good, the school is going to sell YOUR name on the back of their jersey indefinitely - and you dont get ANY of it. They own you and your likeness to sell and make money off of as long as they can. It isnt fair!

@@TheseOpenRoads yeah I am not against allowing students to monetize and get money for their name, but covered tuition on top of that seems excessive to me especially with so many other students who will financially need it. Just feels like there needs to be a balance to me.

Most athletics programs lose money. And of the programs that do make money, it’s only one or two sports that are floating the rest. And of those schools, only a few players are responsible for the success of that particular sport.

@NonyaBusiness! And what makes it worse is that Katelyn will not get the recognition for that famous drop slit move she did. what I call the ohasi bounce. Simone Biles did that same move during this months world champs so it will probably be given Biles's name. Which is so NOT fair!!! And to make things worse, Simone has been on the team for well over 4 years and she STILL CANNOT do her routines perfectly!! I counted her stepping outside the lines 3 times iin ONE FX routine during this years world champs (just finished) and she still wins the gold medal. That is cheating and favouritism from the judges. I detest Simone biles for cheating, for still being unskilled, for stealing someone elses move and for that big FAKE smile she always has. Her eyes NEVER smile. When your mouth smiles but your eyes dont, then it is fake.

SereniaSaissa SereniaSaissa what an idiotic statement. I nearly laughed reading that. Simone may go out of bounds but her difficulty is ridiculously high and her technique is pretty good for elite level gymnastics. That’s why she scores so amazing. It has absolutely nothing to do with favoritism or “cheating”. Going out of bounds is a tenth of a point deduction. That’s no different then a small slip up on other events so to try to erase her reputation based on that says how little you actually know about elite gymnastics. And collegiate gymnasts are FAR from perfect. They aren’t scored to the same difficulty as elite gymnasts and their difficulty is the equivalent of level 10 gymnastics. It’s not elite level. There are 12 and 13 year olds all over the internet striving for to go elite and are already doing what these college gymnast are doing. So yes, Simone biles may not perform perfectly (no elite gymnast since the elimination of the 10 point system has ever gotten a perfect score. They don’t give out perfect scores in elite gymnastics) but she is at the top of her game due to her ability to throw difficult skills that were considered impossible only a few years ago and maintain her consistency while increasing in difficulty. Also, Simone biles never did the drop split “skill” at Worlds that Katelyn does. Not sure where you got that from. You seem to want to take shots at Simone and her talent while praising the ground Katelyn walks on

I can understand why the NCAA is against this for students who are on full scholarships but most athletes are not on full scholarships because the NCAA restricts the number of Full scholarships. Take women’s field hockey the NCAA only allows 12 Full Scholarships for a average of 23 girls per team (NCAA 1). Which means most of these girls are only getting partial scholarships. So either up the number of full scholarships to cover an entire sport team or let the players profit from their name!

Not to mention d3 who doesn’t get scholarships. My brother had to turn down an internship for his dream job as an analyst for the Baltimore ravens to be eligible to play football for mit. It sucked, he was so disappointed

Even if a student receives a full scholarship, it’s not like it was easy to achieve. And let’s be honest some of these breakout names in NCAA would be able to clear more than the scholarship would cost. I never played sports in school but it’s not fair that the board members sit at the top making their families wealthier for absolutely nothing at all.

No. Th only solutions are to either allow college players to profit off their likenesses or give them a piece of the pie that they help make. The NCAA generates BILLIONS and Mark Emmert's total compensation is over $2.4 MILLION as president of the NCAA which is SUPPOSED to be a Non-profit organization. There are several other NCAA members that compensation totals more than a million dollars. The commissioners of the five biggest conferences in the Country (SEC, ACC, Pac-12, Big 10, and the Big 12) are all making over a million dollars as well. The head coaches on these teams are almost always the highest paid public officials of their respective states. They're exploiting these kids by "forcing" them to attend school and prohibiting them from benefiting from their likenesses meanwhile they're negotiating multi-million/billion dollar deals with corporate sponsors, video game companies (that stopped due to the lawsuit levied against EA which they settled for $60 million which was a DROP IN THE BUCKET), cable companies, and other endorsements. This crap should be unconstitutional.

This young woman is amazing. I saw a video a while ago about how she stopped competing at the Olympic level because of the toxic body-shaming and competition-driven culture that she dealt with there. She joined college sports instead as a way of standing up for herself. And here she is standing up for herself (and other college athletes) as well. She is an empowering role model!

It's weird even from an American. It's not as if college sports are treated as extraccuriculars. It's basically a full time job. How are we not paying them or at least allowing them to profit off their popularity? Bizarre. But, honestly, I don't even understand how college sports became this big billion dollar industry. It's SCHOOL. I don't get it.

Thank you for speaking out on this and using your voice to help other athletes. It would be easy to say, "Well, this doesn't apply to me anymore, why put myself out there?" It's an honor to be able to look up to strong men and women who see a fight BEYOND themselves, a fight for other athletes in the future.

@Alice's Rabbit I couldn't agree with you more. Collegiate athletes are often restricted from income producing activities because of their full academic schedules and 4 to 6 hour athletic schedules. Where a student that has scholarships outside of athletics can still get a job at least. The only way to make people understand is for these athletes to tell their stories.

How do you think the exec's can afford those Summer vacation homes in the Hamptons and those Winter vacation cabins in Denver??? - How do they afford to pay those college football or Basketball coaches tens of millions of dollars in those Pac 10 programs??? - Trust, 90% of the money generated from college sports (football and basketball) goes directly to the pockets of those who run that bloodsuckin' racket called the NCAA! - The colleges and universities have very little jurisdiction or say so on how the NCAA divvy's up the profits.

@@AmadeoZeller But the NCAA doesn't pay coaching salaries. The school's athletic department does, and even then those exorbitant salaries you're referencing are usually funded by boosters, not the school itself. The NCAA did try to cap coaching salaries back in the 90s, but the U.S. court system ruled it illegal.

@Fred Flintstone considering she has made multiple guest appearances on shows after her viral video and she was in the running to be on the US Olympic team, but had to step down because of multiple injuries, with sponsorships (which she was offered) she could have made a lot of money. While it isnt easy making money off of KZbin, there is a market, and if you can invest correctly off of a viral video, it can way more money than someone can think of. Unfortunately she wasn't given that opportunity to market her own likeness and name, instead they did and DID make money off of that. More than likely making double over the amount that cost them and the school.

The coaches earn millions, the bug schools spend millions so they can pretend they don't turn profits, but the kid who has the equivalent of full time work, and full time school gets nothing. And when they get injured they lose their scholarships because they can't play anymore, meaning if they are halfway to a degree they lose two years of work. But yeah they get paid in an 'education'.

I remember I used to think student athletes were just arrogant for wanting compensation, but then a basketball fan asked me "If the student selling jerseys in the university store is getting paid by the university, why isn't the student whose name is on the back?"

I don’t even keep track of gymnastics but Katelyn Ohashi’s event was legendary. It’s crazy that despite her 134 million view video, awards, interviews, and multiple books she’s only worth $300,000. The NCAA are thieves.

I'm an NCAA DIII athlete. Even at this level, being a student athlete takes up so much time and energy and pain. If I was DI and famous I absolutely would want a cut of the money my name made.

NCAA appears to be platform. They regulate fairness and partners with the schools to deliver entertainment. What these athletes need is a new platform to self regulate and perform for the fans and other athletes.

She's still a relatively famous young woman and has a degree from a recognized top college. She's not going to be hurting for future opportunities. Frankly, gymnastics is not a sport one goes into (if one is smart) to become a professional athlete. Just like diving or rowing or, say, bobsledding.

NCAA will not be pulling out of california they'll lose money. I still feel college players should be getting paid! Players bring in millions for schools and get squat. Sure they get a full scholarship but it aint ish compared to the millions schools are getting

Hmmmmm.....is that really true? Elite athletes are not often elite students for a reason. Mainstream media perpetuates the idea of a dumb jock without any context. Some of these athletes practice an obscene amount of hours a day. There are only so many hours in a day. I remember when my high school was a contender for the basketball state championship, they grabbed a star athlete out of English class. No questions asked. Some students sustain debilitating or limiting physical injuries. It is more complicated then people realize

It's possible for student athletes to quit their college league or leave their school if they want to pursue a professional career. The NCAA is a mess, so it seems reasonable to walk away if you already have a career waiting for you.

What NCAA should not have is exclusive rights over a student's ability to profit from their sport. Its like if an art student went to school on a scholarship for art and then was not able to work on art for anyone else outside of school (internships included) for all 4 years. What makes it even worse is that athletes are in their prime during their college years.

I hear what she’s saying, but if you are good enough to profit off of your success then do that. I wouldn’t give up all that money (personally). Simone could have gone to UCLA but then she’d have to give up so much money. I don’t think the NCAA should pay athletes (Hold on before you drag me). UCLA’s tuition, board, dining, books, and athletic training- that’s a lot of money that is being spent on the athletes. Now if someone wants to endorse them, then that should be fine. She went viral from her competition video, so she gave up a lot of money to continue her education. But if it’s just a regular person who is on the team who isn’t offered anything, would we be talking about this?

Yeah, a college football player was doing KZbin and they found out he was making money from KZbin and gave him an ultimatum to quit football or quit KZbin. Basically he never went viral but his university wasn't making money off him so told him he couldn't make money then.

UCLA’s costs vary between 120k-240k for a 4 year education. Compare that with how much money some of these athletes COULD make if they could use their likenesses.

It’s hard to imagine college athletes all over the US collectively going on strike. The hinderance would be the droves of High School students ready and willing to take their place. As a Florida resident it’s surprising how many people support UF & FSU. Yet many have no connection to these institutions other than residing in the same state as them.

I fully support this: that being said - other students cannot profit in college off of their programming skills or scientific achievements, I had to sign away my rights at UCSD (this was 20 years ago... maybe things changed...). If I had cured cancer I would have had to drop out of college to profit off of it. It’s why so many tech entrepreneurs are college DROP OUTS. They had to protect their company from being stolen from their university. And sure this isn’t universally true, I’m sure someone here will say “not my college” but - yes, my college, and yes, MOST colleges and universities here in the US. So could we get these rights for ALL college students please?

You work for the NCAA, they pay your room, board, and tuition. Also, you pay no taxes. That was the deal and you signed up for it. The money you generate pays for others who are not popular. You knew the deal and happily agreed. Non athletes will graduate with huge debt, not you though, you are very privileged to be given a free ride in college.
