This is soo unfair, our petition was approved in Dec 2009, nothing was stated on the website wrt concurrent filing...we had to return to our home country as our visa expired & didn't want the approved petition to be voided.

@GrayLaw TV, hope you are well. I filed everything concurrently I-140/i-485 concurrently along with the I-765 and I-131. The I-765 was received on August 2, 2021 and we did the fingerprints in October 2021. We have yet to receive anything back, is it normal that the I-765 take over 6 months? It's at the Lincoln Nebraska center, and there has been no additional notes on myuscis since the fingerprints were taken back in October. This is Employment Based Green Card (born in Canada) and currently on a TN Visa. Filed under C9

It is a separate process. if you get lucky however, they should waive your interview.

(USCIS) policy already generally allows for priority date retention, as long as the approved I-140 has not been revoked by the USCIS for fraud or misrepresentation.

@@GrayLawTV will the previous i140 pd be allowed to be retained in new employer's i140 petition it became current more than a year ago? This can happen if your new employer delays in filing perm/i140 for whatever reasons and your previous employer is no more interested in hiring you back that you cannot use his i140 in AOS. What to do in such situation. The whole system is designed to harass the employee and allows his exploitation at hands of employers.

Question. When you file concurrently and the i140 gets approved; how long until i485 gets approved too? Is it automatically approved too? And 1 more question. If concurrent filing and after a few months you decide to premium process your i140 what happens then with your i485. Is it worth it to speed things up?

generally it takes 2 years to get the i 485 approved. the i 140 may be approved before the 2 year period.

We filed our change of status, work permit, travel permit at the same time and paid the fees. We including everything they wanted in the package . About 2 months she got her Biometrics meeting. About 6 months she got her interview and they ask for a lot of the same paperwork over again. We gave them copies of the same paperwork and they said there is nothing wrong with our case. One and a half hours later they sent us an email requesting the same paperwork and more. At the interview we had pictures and they never asked for it now they want them. This is the same kind of harassment that we got on our K1 Visa with the embassy in Philippines. Our Visa Handler doesn't understand why their harassing us. We are currently putting together the third package they asked for. Is there anything we can do to prevent this harassment? Thanks for your time

Hi Marielou, it depends on what state she live in, but generally it has been taking 6 months to get the work permit and one year to get the green card.

hi, I filed I-130 petition for my wife on july, 2021, even after a year the petition didnt approve, so she appplied for tourist visa and was granted, then after she came to US we applied I-485 and I-765 on september, 2022, she did her biomterics on Oct, 2022, we received RFE for both I-130 and I-485 on Jan, 2023.... we are still waiting for her EAD, what shall we do?

"You may file your petition and application concurrently when there is a visa number immediately available at the time of filing" how can one know if there is a visa number available at the time of filing. and two adj of status can only be done concurently if the alien is in united states, but for this to be true then is it that the alien is residing in usa illegally? or there are other scenarios? just a little background on my scenario, my parent is us citizen, want to file for me and my husband and 3yr old but we live outside the US. i really dont want to wait 10 to 15yrs

@dr.cina, if you have the receipt of the i 130, include it with the mailed i 485 and you should be fine. You can also just mail a new i 130 with the i 485 if you want to be safe.

Because I am currently in the process of applying for an adjustment of status using Form I-485, based on marriage, and have already submitted Form I-130. I originally entered the United States under the Visa Waiver Program (ESTA), with a WT status on my I-94. Since then, my I-94 has expired. As I am preparing my concurrent filing for the I-485, I am uncertain about how to answer Part 1, Item 27, which asks about my current immigration status. Given that my I-130 is still pending, should I classify my status as 'out of status,' 'visa overstay,' or 'applicant for adjustment of status'? I appreciate your help, thank you.
