Does 485 processing time differ for different categories? Like eb1 takes shorter time than eb2 based i485? If so , what is the hierarchy?

Hello great talk! for non concurrent cases, according to uscis regulations and my talk with my attorney, people can submit their 485 when 140/130 is pending. The only requirement is the priority date should be current on uscis website. May I ask where do you get the information we have to receive 140/130 approved before we can file 485? I personally just file 485 this year while 130 was filed last year and 130 is still pending.

You have to wait for I-140 approval in case you didn’t file concurrently. You are mentioning 1-130 which is family based petition. I was mentioning I-140 for Employment based green cards. Hope this helps. Happy to discuss more!

Dear Sunil, currently PD for EB-1 is Feb 2022 and based on VISA bulletin trends it seems it can take probably an year before it reaches December 2022. It is based on the assumption that there is no further retrogression in EB-1
