What sucks is that it’s different enough that they could deny any knowledge of your character. Whether that’s believable or not, I don’t think matters in court. There has to be solid proof they stole your idea. Like emails or something from within the company. Otherwise, I think the likeness isn’t close enough. Also, maybe check with a lawyer about copyrighting Pamela pumpkin, or whatever it is you do, to protect the likeness of something.

It happens a thousand times a day. You will get no where unless you have more money than them for lawyers. It happens even to big brands. I watch sharktank all the time snd they won't invest in a lot of things if it has a chance to be copied off of bigger brands. There are a few things they will invest in but that's because the Shark has a big business personally that they can tie it to. Even the Sharks don't always disclose that. The best thing is to like most say..just keep going. Pamela Pumkin is year around This Pumpkin won't even return for next year. It doesn't have the personality and Target is just trying it out from a smaller distributer. They may loose their ass on it Target can write it off but the smaller person may be losing a lot of money. It cost a lot of money to do what they are trying. In reality..it's not your loss as that's a lot of money to put out...lots.
