Showing you how to complete the DMV release of liability online and why you should always file it online. It is easier to file online than by paper. Filing the form online takes up to 24hrs to transfer, while by paper it can take up to 2 weeks. Also, asI have experienced personally, your release of liability can be lost by the DMV. This is a major headache to deal with that will cost you unnecessary time and money. File reg. form 138 online to cover your butt.

I was on the wrong page that required me to have the certificate of title (even though I gave the title to the new owner). I always thought that i needed the new owner's information to release liability, I got a letter in the mail notice of intent to suspend vehicle registration after 1 month of selling the car because it didn't have insurance. you just need to prove that you sold the vehicle with a bill of sale or a copy/picture of the release of liability and you should be in the clear👍

@@beamerclub99 if you have already sold the vehicle and the person has not registered the vehicle into their name or has taken the vehicle out of state is most likely why you are getting the letter. or the registration was outdated before you sold the vehicle. I would get in contact with the dmv to find out more about your particular situation you are having. hope this helps 👌

Thanks. Right, I sold one of my cars to one of my son's friends. I turned in this form and the title transfer at the DMV. I assumed the family friend would do his part and go to the DMV but he didn't. Six months later I get a notice of unpaid parking tickets, in my name. Then several months after that I get a notice from and tow company requesting $700.00 for towing and storage fees. Both times I had to send proof that I no longer owned the vehicle. One thing I HADN'T done was to go through the on-line process. I am giving another car to my nephew tomorrow...I'll be on-line as soon as I hand the car over.

I had the same situation, when I sold my car 22 years ago in California. I believe DMV wasn't even equipped with Web site. Buyer didn't register ownership, I got a ticket Red camera violation with photo of somebody passing on Red with car I sold. I come in their court (I believe it was long time ago) where this paper came from showed them this photo and asked to take a look at me. They said: if you know who passed on red give us a name and Driver license number, I contacted with person to whom I sold the car, she said it was her uncle, she gave me his name and driver license. I returned to that court with this information and it was all settled. Never heard from them again.

So you're saying there's no legal requirement at all for entering the buyer's information (name, address etc.) on the form, even on the physical form 138, if handing in to the DMV? Also, if the info. is entered on-line, is there still a need to also supply the physical form 138 to the DMV? That form has a line for sellers signature. Can't do that on-line. --Thanks

We both signed the void sale but he kept the pink slip I had signed previously and sold it to someone else who registered the car with DMV. Now has been 2 years and a collection agency is after me for a car I don't own. first, i would call the company to make sure that you arent in collections with them over the car. if that's the case, re file the release of liability online with your state and try and negotiate with them on the situation. I had the same thing happen to me recently and I was in collections over a vehicle I sold almost 2 years ago. the problem was they had no proof I had done a release of liability because I ALWAYS file it online and had no printed or photo proof to provide to them. make sure to print or take a photo of any release of liability you file

From the DMV site. "Submitting an NRL to the DMV does not constitute a transfer of ownership. The vehicle record is not permanently transferred out of your name until the DMV receives a completed application for transfer of ownership and payment of appropriate fees from the new owner." What is the seller's protection in the meantime? The seller does not even have a signed declaration by the buyer that he bought it on that date and time. If the car is involved in a serious accident right after the sale and the buyer denies buying the car. The buyer can always get rid of that "Certificate of Title" if he already signed it.

I read online that it cannot be completed by the applicant and must be completed by a third party not directly involved . There is no age restrictions, as far as I know on buying car, or accepting it as a gift. You may not drive it without a DL but you may own it.

The answers to your questions are at the website. "How long will it take for the sale to be complete? When you give the buyer all the required documentation and DMV receives your completed REG 138, the seller’s part of the transaction is complete. Once the buyer has provided DMV with all the proper documents and fees, the vehicle record is updated to reflect the change of ownership, and a registration card is issued. A new title is issued within 60 calendar days. Will I have to pay for anything after I have sold my vehicle? All of the transfer fees are the responsibility of the buyer. Should I keep any papers after the vehicle is transferred? Keep a copy of the completed REG 138. Do I owe taxes on the money I receive for the sale of my vehicle? Contact your tax advisor."

Brian Walker IMO you can put unknown for all name ,address and date for DMV system At least they know that you released liability already.

@@walkerskii imo You can put UNKNOWN for name and address of the buyer and date and other information on DMV online so they know you have sold and release all liability. Call your auto insurance as well and remove the car as of midnight of the sold date. I also write up BILL OF SALE with a buyer too. Avoid car flipper and float title. Good luck

ya I would put the date as to when you sold the vehicle. it should hopefully stop that from happening. you are obviously no longer liable for registration

What if you want to transfer the title from one owner (your name) to two owners (your spouse name and your name)?

All you need to do is write both of your names and info on the back of the title. When you turn it in they will send the new title with both of your names on it. You also need to check the box for and/or on the back

Not required but maybe for your records. Good to have seller and buyer fill out and sign bill of sale and keep one copy for each. The pink slip will or should all buyer and seller info, odometer reading, address. Be ware of flipper who will NOT fill out. Demand that a buyer must be a true buyer not flipper. Happened to me once but nothing bad happened. I found his name online and did this online release of liability.

So I did all that but I am still getting otra sin the mail and the guy I sold it to got a ticket and it came under my name so what do I do now I called and I need a copy of that release of liability

Keep copies of EVERYTHING even if online -- take picture and print out if you have to.

always fill out the release of liability online as I have shown in the video. the release of liability is the white portion at the top of the title that the seller turns in to the dmv or filed online after selling their vehicle. always file it online!!
