Hi Everyone ! Thanks so much for all the comments I will try and get to reply to them all but here are some bulk answers! Q. Why did you hand over so much up front..? A. We paid £34,000 over various stages throughout the process and the last payment when kitchen was being made, yes we were daft and made mistakes but it was a real shop in our village and we checked them out but yes that was our mistake along with not paying via credit card / car machine etc Q. What's the car display A Its a honda e our run around ev and its the kitt knight rider theme...I will change for next episode and may even make a Steve Wynne compilation Q. why did you give details over A I am just a normal uk citizen and I respect the police and have nothing to hide, I get that I could have said no etc but I wanted be helpful etc Q. Take him to court A. I dislike solicitors and others already have spent money and time doing this and got nowhere, why hand over another £10-15k to get nothing and essential cost me more and I still need to buy a kitchen he has nothing in his name Another victim took Steve to court and won, Steve then closed the bramhall branch and cleared it out and has NOTHING in his name so this poor victim spent £15k to essential be worse off even though he won and still has to but a kitchen! Q. You're rich you drive a £40k car and spent £34k on a kitchen get a solicitor rather than pester this guy who's going through a tough time... A. Sorry but what an as*hole comment and firstly the car was never £40k, I also recently bought it and its three years old and cost £14k, what exactly does this have to do with someone taking my money and running away? I couldn't care less if Steve is going through the worst time of his life, in fact that makes me all warm inside. He has done this intentionally and to many others, I am now getting calls daily off new victims so please don't think Steve is now the victim As I always say "Play with the bull and you'll get the horns" Steve has F*cked around and now found that guy who just wont give up and will do anything legal etc to make sure no one else gets screwed over

You have a £40,000 car and to you it's a "run around". You gave a scammer £35,000 for a kitchen. I'm sure you could spare a few thousand on a solicitor, or a few hundered to go to court yourself. I feel there is much more to this story that you haven't told us.

@@FatJoeFilmsOne of WKI victims here - as mentioned below there is way more to this story! I have instructed solicitors plus additional legal teams, with no luck. Unfortunately the law in this country is not designed to favour or protect consumers. My advise would be get all the people that are owed money or kitchens and taking him to court collectively. Court is the only way you are going to get any money back. Shop around for a decent solicitor or do it your self's. The solicitors that tried before and got no where are just as bad the kitchen seller guy, useless and just want money. Apart from not going back and knocking on his door, everything else the police said was crap. You are in dispute over a contract and have every right to contact him.

@misterchippie Yep plod were out of order, threatening the cammer. It certainly is not harassment, if peacefully visiting a property. To continue to regularly visit the property to see if there is someone to talk to is again not harassment. TV licencing do it all the time. Acting menacingly, or issuing threats (like wpc did) showing a continued pattern, could be considered harrasment. I would argue plod were harassing cammer, who had committed no offence and was merely trying to see if there was anybody at the address that he could talk to.

He also said as an employee if you irritate him he becomes aggressive and starts throwing threats of violence around also he doesn't like to pay his staff and has had a lot of run-ins with disgruntled employees! I knew who the person was and where they lived and the police said it was a civil matter and not to harass the thief. The police you spoke to clearly don’t have a clue because the small claims court will not cover the amount you are owed as I believe the maximum they deal with is £10k. You will have to go the expensive route and sew. These days the Police are absolutely no use at all, in fact they cause more problems. I have to believe this par for the course for British police. I was ‘taken’ for my business, worth in excess of £200,000 by a couple of con-artists. By the time I’d realised what was happening (and discovered they were ex-bankrupts) it was too late. I took them both to court three times and won each case - but got no money. I had evidence of conspiracy, fraud and theft - I also became aware they’d done this at least twice before and they’d gone on to con another business-owner. When I contacted the police a police officer came to my home, said “I know what’s been going on” then suggested I contact a solicitor - who, if they concluded I had proof of a crime, would advise the police. I posted details online and was promptly contacted by the police - and threatened with arrest if I didn’t take the post down. The perps had complained that I’d harassed them! Every time one of them applies for any form of credit or insurance they continue to break the law - saying they’ve never been bankrupt or had any County Court Judgements.

Knocking on the door like he did, should never be harassment, especially if that was his first visit. The thief in the house obviously knew why he was there, so refused to answer the door because he wants to keep the money. Also, a couple of emails asking for your money back, in a non-threatening way, should never be classed as harassment. The only law broken in this instance, should be the fact the scumbag stole that money. I think the thief is lucky that the guy isn’t actually harassing him, cause he deserves more than harassment. I once bought a car that had a number of things wrong with it. The ins and outs of why I drove away are irrelevant. I went to the Small Claims Court after the agreed repairs were bodged and won. That got me nowhere. I went back and instructed bailiffs to recover my losses and was told the dealer had ceased trading. Basically he closed the business and started a new one - same people, same location, same cars, just a different name, so I was told I could do nothing as it wasn't the same company. The legal system in the UK is flawed, people shouldn't be able to rip you off so easily.

He then waits for you to send some emails when your angry, he then stops all contact , so you pursuing at every means, the cost now sees you as the bully and he's the victim. The 9nly way is through a civil court. Eve. If he's found guilty he won't be given a date to refund the money back, dude don't purse him it makes it harder for you but easy way out for him

I'm not saying you are wrong, far from it, but prove that he was defrauded? There certainly seems to be a breach of contract - but that is a civil matter that should be brought before a civil court. Once the creditor has instructed a solicitor, that solicitor will decide if there is enough to justify a criminal charge, and then (in theory) further representation to the police could be made, or indeed a private criminal prosecution pursued. In practice, that is fantasy - the costs involved would probably escalate exponentially with no guarantee of a return. If the debtor is bankrupt he's probably a lost cause.

The threat of arrest for returning at any point is completely unwarranted and unlawful. If you have not had a restraining order issued by a court, this means nothing. Does the postman get arrested for harassment? Nope. You’re allowed to contact someone to ask them where your money. Telling you that you’ve taken matters into your own hands is ridiculous - you were asking him when he intended to deliver on his last communications to your wife. However, the police turned up so quickly because there was a marker on his house which shows that there had previously been some serious aggression and possibly violence by someone - which doesn’t surprise me if he owes them a sizeable sum of money. So it’s best to issue a claim immediately and get it logged - don’t waste time writing letters, just issue.

Just to add - I like to give a balanced view and be fair. I ordered a kitchen off this company about 4 years ago and the service was terrible, they took a large deposit off us and took 3-4 months time wasting on the design. We took the view to cancel and go elsewhere. On that occasion, we received a refund within 5 days of cancelling. We were lucky in that respect but I didn’t get the impression they would take it. The shop has been there a while too so I can only let assume that problems have occurred over the last 6-12 months which have messed up their finances. I hope you get the money back and I’m sure if he can, he will pay you back. But you need to issue a claim asap and you’ll see quicker results.

I don't think the limit for a small claims court is as high as £30K. However, there are still legal actions which can be taken to recover the money owed. Good advice. A bit of digging at Companies House (some info is freely available) might shed some light on the situation. My guess is he won't risk being a sole trader or a partnership, as that would leave him legally liable for the debt, which isn't the case if he's a limited company. I ran a company which occasionally did work for which we never got paid, so I can see the other side of the argument here. However, we never asked anybody for pro forma (payment up front) terms of amount anything like £34K. We once had some clown wanting us to supply 8 tonnes of antifreeze to a job in Oxford, cost supplied to us was around £8K plus VAT. We told him it was pro forma (payment up front), we never heard from him again.

Because in this instance he has been accused of harassment - that is the "crime" they are investigating. The creditor could have been arrested, and it would have been a lawful arrest, and processed down at the station. That was not deemed necessary because the creditor was compliant and explained his actions in a reasonable manner. The officers responded by accepting his explanation as to why he was there, then gave advice as to why he was wrong to be there (personally IMO I think he was more than justified to be there). Remember, the complaint was made by the debtor HE was the one who claimed harassment. Is knocking on someone's door harassment? It is if the law says it is. Should it be? That's for our elected representatives to decide. Suitable advice was given.
