That happened to us in the summer of 2021 when we moved from Oregon to Tennessee. After two weeks of not getting the furniture I was unwilling to be still anymore and we flew all the way back to Oregon to Teresa steps. We found our stuff in a storage unit and it was all intact. We feel very fortunate. I also got my $10,000 back because I am relentless. I had pictures of the movers. I was in the moving business in the 80's through 2005. My family owned a moving company, I was a cross country mover and sold moving and storage services for years. My advice, take your jewelry, heirlooms and your computer in your car. sell the rest or give it away and get new stuff at your destination. The cost of relocating your possessions far exceeds the price of replacing them, plus you get new stuff.

The broker is required to carry a bond, by law. They will lose their authority (license) if they don't have the bond (insurance) active. It is regulated by the FMCSA, a Federal Agency. Movers are required to also, at least the one that operates the truck that the household goods are transported on. The people who are in a home packing/unpacking and loading/unloading furniture are not necessarily required to carry insurance. Unfortunately, the average consumer doesn't research to find out what they should be asking for, looking out for, and verifying, to make sure that they are hiring a legally licensed and bonded broker or mover. It doesn't really make sense for her to be in this position after such a long time, since it sounds like the brokerage, at least, was legitimate. A quick chat with an attorney about the issue should have resulted in her being made aware that the broker legally needs to have a bond that she can file a claim against. They have to carry a bond with a minimum value of $75,000. All she would need to do is file a claim against that bond for the value of the items listed on the move paperwork, along with the fees she paid to the brokerage. The company that issued the bond to the broker will pay her, as long as she has a legitimate contract and supporting documents, whether the broker likes it or not.
@louisliu5638 Жыл бұрын
They do, but under the Motor Carrier Act technically look at the contract. And that stuff is actually THEIRS until they unload. It's like so many contracts written one way: you're hooped. And what do you do about losing FAMILY PHOTOS that aren't replaceable??
@RealzFoSho Жыл бұрын
@@louisliu5638 A decision to leave small and important items, like family photos, with the rest of your household goods rather than taking them with you or sending them separately through a service like UPS, is an unfortunate one. This is irrelevant to the original comment, but I included the part about the average consumer (unfortunately) not doing research because of comments like yours. So much of the hardships and heartache with moving is a result of people not researching a major life change like a move before they just throw money at it and imagine it will all just magically be perfect. It is a hard lesson when you don't think, blindly trust, skip out on putting in any effort, and just throw money at the cheapest mover. I have empathy but it only extends so far. Regarding a deliver date, there is a legal requirement that the customer is provided with an Order of Service. It is a legal document and part of it is the requirement, not option, to include the pickup and delivery time period/dates. The Order of Service must have that information. If a customer was not provided with that document, then that in itself is a violation of the law. One thing I did forget to note is that I have been discussing this with an assumption that discussions are all related to Interstate as was in the video. Some of this may only apply for out-of-state/International moves, like the one in the video. Moves within single states can have separate laws and regulating authority, but must remain fully inside a single state during transport or it falls back to Federal. My experience is with Interstate and I won't pretend to know anything about how individual states regulate their in-state moves. The Motor Carrier Act, to my knowledge, had nothing to do with regulating the moving industry. It reduced regulation of the general trucking industry, making it more of an open market. I don't recall anything in the Motor Carrier Act that has anything to do with transferring ownership during transport. Do you have a resource that explains what you are referring to? The only thing I can think of would be if you are referring to assuming liability during transport. If so, that is not the same thing as ownership. If you did in fact mean actual ownership, then I would need more information as it is not ringing a bell. If I was misreading and you were referring to the Motor Carrier Act separately from the transferring of ownership, then that is something I would have to defer to an attorney on as I have never come across it and don't know the legality of transferring ownership to a mover through a contract, or what the purpose of that transfer of ownership would be designed to accomplish.

The truck was located in a neighborhood that same day, right next to a property next to the Southern border. The police showed up and the shipper's stuff was being unloaded from our truck into a house . The police went in and the house and outbuildings were packed to the gills with all kinds of contents from different households. A neighbor told the police that moving trucks were always coming and going at the place & people coming and going all the time. The neighborhood was older with dirt streets and large property ranch type and commercial use where buildings were some distance from each other which is probably why nobody was bothered by the traffic and never reported activity as suspicious. Sorry you went thru that. Don't take this the wrong way, but the fact that it cost $7000 to move your stuff should have been your first red flag. Just so you know, you can hire unskilled laborers from a day labor place to help you move. It would have cost you $1000 for the whole day to get it packed. You could have driven the truck to your new home yourself and then had unskilled laborers in your new town come and help you move your stuff into your home. They would have been more careful because they were working for you and would have been fired by you if they broke anything. That alone makes people be more careful. Day labor companies also have liability insurance so if they break anything or they get injured, the labor company has it covered. And finally, some things don't transport well and/or need special skill to be transported. For instance, I would not allow a moving company to move a grand piano. I would hire a company that specializes in that to do it.

This is a very common strategy with movers - you agree to a price for your move, you sign a contract, but once they pick up your stuff, they demand more money to give you your belongings back, and now they will add daily storage charges to further increase their profit. This fraud happens with legitimate moving companies all the time, it’s absolutely not limited to non-licensed movers. They will refuse to provide you their insurance companies information so you can never file a claim. No legal authority will get involved in your dispute because technically a crime hasn’t happened, they want you to work it out with the moving company. This is just one of the billion ways in which the average American is screwed over in this country.

Can't seem to trust anyone. If by chance you need to move I guess, rent a uhaul, and maybe hire some guys in front of home depot to help you lift the heavier items, then drive it yourself or ask a friend or family to ride along, since some of those drives can be pretty dull. Not great to drive while sleepy. If you really have no other option, don't let them touch any jewelry or documents, you have to move that stuff yourself. As for legislation passing, yeah we need it, which means, nothing will happen. Because let's just say half of elected officials want everyone to be angry without thinking. Deregulate everything and act surprised when everyone robs you blind, while asking you to pay for them to do it.

our CA to TX move resulted in a 60 day wait for our stuff. That's 60 business days. They moved it, trucked it, move it again, stored it .......who knows. But when we finally got our stuff, a lot of our furniture was broken as was a lot of glassware. But in the fine print is the compensation for broken stuff; $0.75/lb. Hardly worth fighting for. On top of that was an itinerary of over 450 pieces. We didn't get through all those pieces and boxes for months before we realized that stuff was missing. No idea where it was, what box it was in or where it went. $20,000 to move and it was a disaster. I guess folks will tell you it's the price to get out of California.

First off, no Texan wants a Californian in their state. I know this from personal experience. All of my mother's family are in Texas. No one wanted her back once she'd been living in California and they let you know why. Second, this woman was stupid. You don't entrust movers or anyone else with the expensive items. You put them into boxes or suitcases in your trunk and keep them with you. You have a better chance keeping your precious items with you than handing them over to strangers. Next, she should have done some digging on the company she chose to move her possessions, like calling the better business bureau before handing over everything to them. She needs to take some responsibility ffs and stop whining. Make sure you know who you're dealing with when you hand over your possessions. Always keep your expensive stuff with you and insist they follow you or you follow them...when they leave your house, you leave with them so they are never out of your sight. Set up rules, make contracts before you give them any money and only pay half when they leave with your stuff and the other half when it's delivered. Geez...it's your stuff and your money so it's your rules!
