Well, we have an entire political party that believes corporations are our gods, that places like the FAA/NTSB/OSHA should be completely dismantled and that are actively trying to get important safety laws off the books. It doesn’t surprise me, a former campaign manager, because this is the way they want it.. I’m sure conservatives viewing this story believe that the woman is at fault for parking her car in her own driveway.

Should be mandatory that an equal or better vehicle replaces the totaled 1. Because they value your car at wholesale and lower but you need to pay inflated retail. Thousands difference.

@@shannonp4037 personally I think they should be required to replace what was damaged with an identical car. I can't drive a check to work, and I'd be hard pressed to find a 2006 Saturn Ion in the same condition as mine. My 1991 Honda CRX would be even harder to replace.

That is 100% correct, even if they are at fault. A student hit our truck at a high school parking lot, it was on the schools camera. I had to file a police report. I was told to bring it to a claims office - GEICO, and thought they would hand me a check like some others were getting. I did not. Anyway, found out the students parents died, so that's why the insurance was fighting super hard not to pay out, but 2 freaking years later, they finally paid. Seriously they don't want to pay if they can get away with it. Also, I will never use GEICO for that reason.

The fact that she didn't sued Amazon for this yet mean she's still had trust in Amazon and their insurance. Hopefully they made things right for her and get her a new vehicle asap so she could get back on to work again.

That is because she knows it isn’t a case to be brought to court. There is a process to this and it requires multiple layers and parties including insurances, adjusters, auto shops, etc.

Most insurance companies just settle at the value of the car. They won't pay extra for repairs, when the value of the vehicle is less. For example, if the cost of repairs is $13,000.00 and the vehicle value is $10,000.00; the settlement check is usually $10,000.00. What she should be doing is contacting her own insurance company; because she handed over the keys and title to them. Her insurance company should be giving her a check for the value of vehicle; and then her insurance company can go after Amazon's insurance for reimbursement.

It never surprises me anymore when this stuff happens. Its just "amazing" how quickly the company "steps up" to fix this once you go to the media, Trust me if the owner didn't get the media involved she'd prolly have to go to court to get her money.

Doubt she'd have to go to the media to get this resolved if she had immediately involved her own insurance company and filed a claim. Her INS company would have gone after amazon and Amazon's insurance. Meanwhile, she would have already been shopping for a replacement car.

An Amazon driver backed his truck up into my neighbor's vehicle. I happened to be outside when it occurred. The sound from the collision was so loud. The vehicle he hit bounced with the force of the hit. He got out of his truck, checked the vehicle he hit, and made a phone call. The vehicle was parked in a community parking area, so he had no idea who it belonged to. I waited for him to write a note, but he took off in his truck without do so. Thankfully, while I'd hoped he would do the right thing, I fully expected that he may not and had been recording him. When he drove off to finish his route, I left a note on the vehicle letting the owner know what happened and that I had recorded everything. It turns out there was 3K+ worth of damage he would have been stuck with had I not gotten proof. It's disgusting that someone would hit a vehicle and walk away. Not everyone has that kind of money laying around, and they depend on an operable vehicle to be able to get to work and run errands.

That's the kind of thing Amazon actually would like to know about. They fire people for less all the time and they actually do go pretty far out of their way to promote safety in the things their workers do. They're not perfect, as anyone who's worked there will tell you, but they definitely try very hard compared to some places. Also, they'd very likely be able to instantly pull up who the driver is by looking at when and where it happened. Their vehicles all have GPS so the delivery service providers can monitor their drivers. I'd be very curious to find out who he called, though, because if it was his DSP and they told him to just leave the crash and go on his route like nothing happened, they'd be in the same world of shit as the driver.

I love this so much. We need more of these type news pieces all across the country. It’s exhausting how many issues come up in our day to day and most often times the organization ends up winning because what normal human has all that extra time to spend trying to fix things.

Same thing happened to me. Im still waiting to get paid after NINE MONTHS. Luckily I went thru my own Insurance Co. so my car got fixed. However Amazon still owes me my deductible and they havent paid Geico like 9 grand. DONT EVER LET AMAZON USE THEIR OWN COMPANY FOR REPAIRS TO YOUR CAR. THEY WILL SCREW YOU LIKE THEY DID TO THIS LADY.

I've never even heard of a $9000 deductible. I mean $500 to $1000 sounds normal. The higher the deductible, the lower your monthly payments. That's crazy. You must have super low monthly payments.

The way she JUST paid it off literally days before is devastating. If this happened to me, the emotional stress would be so overwhelming. Her *first* car she ever fully owned, to have to deal with this right after that kind of accomplishment is such a gut punch! Two months is crazy too. They better buy her a brand new car at this point. 🙄

The drivers aren’t even allowed to pull into driveway’s. At least that’s what we were told when a driver drove straight into front of our house few years back. There was no issues getting Amazon to pay for all repairs. I hope this lady gets resolution soon.

The Sprinter vans they use have an electric Emergency brake. For whatever reason, some drivers slip the truck into neutral and activate the Emergency brake. Roll away accidents, company wide in Amazon are second only to low over head damage (tree limbs etc)

That's probably not a blanket rule. It makes sense in a normal subdivision but I live on 6 acres and all my neighbors have between 3 and 10+ acres so they always pull in the driveway. In all the years they've been delivering to me as well as ups and FedEx it's never been a problem. A few times I've seen them back into an oak tree but they didn't do any damage to it. If anything they damaged their own vehicle a little bit.

Depends on the cost of the repairs, the value of the car and the costs involved in needing to rent a car. If your car is totaled, most states will force you to get a Salvage title. Salvage titled cars cannot be insured for collision. They may also be found unsafe, depending on the repairs done to make them drivable, which could cause you a ton of grief if you're at fault in an accident.

In some states the says if repairs aren't completed within 6 months the vehicle is automatically totalled.

Speaking as a former attorney, there would probably be no money in it for the attorney. My office would handle an auto property damage claim for a client, but only if it involved a personal injury claim; it was basically a courtesy to the client. PD claims could really be a time-consuming hassle sometimes. I mean, does that lady in the video look like she would pay an attorney 2 to 3k (at least) for an attorney to pursue a property damage claim against Amazon worth 12 to 15k. It just wouldn't be worth it for the client. In this case, considering the amount involved, she would be better off filing a complaint on her own. It's not hard to do. For small claims and special civil, courts usually provide self-help forms and directions on how to file.

I'm from RI and Amazon also backed into my car causing damage! It took them almost six months to finally write me a settlement check (for less than a quarter of my original appraisal) after they refused to answer me for months when I demanded answers. One day they emailed me and asked if my car had been repaired and I went off on them saying no because I wasn't paying out of pocket for damages I didn't cause. That's when they sent out their own private appraiser and wrote me a pathetic check.

And you should NEVER have accepted the settlement. You should have filed a claim with your own insurance. Your insurance would take care of you, because you are their customer. They then go after the other party for damages, and they will be far more successful than you. This is also, why you avoid fly by night insurance companies and go with a name brand.

They destroyed the wooden walkway into my mom's house and they refused to do anything. She would have had to sue which just isn't worth the headache, plus no guarantee of winning since there was no direct witness or video. She knows they did it because they were just pulling out of her driveway when she got to the door, no one else was there. I'm going to be installing an eight-camera surveillance system for her this summer.

Makes all the difference. An Amazon van knocked down part of a wall at my house. Had it on the doorbell camera and we let the driver know that we had it. Got it fixed and Amazon sent a check.

@@cvn6555 You were lucky...an Amazon driver crashed into my garage door. A neighbor witnessed it and we made out a police report. Got a new door installed quickly going through my insurance. After supplying all the claim information, pictures, police report to Amazon they completely ignored us and our insurance company, we eventually gave up on getting our $1,000 deductible back.

I got cameras on the front of my house after someone stole my paver sand. (At least they left me a used needle.) Just avoid dome cameras if you can, they work fine in the day but at night the IR reflects off any dust and all you see is glare. Bullet cameras don't have that issue. So if you don't need the protection to the camera that the dome gives avoid them or you'll be blind at night. Also check your view angle/lens size so it fits the location your using it on. You'd be surprised how hard it is to get plates if they aren't setup right. Especially at night. Motion lights can help so you don't "need" the IR. They also act as something to look for when checking hours of night recordings.

It's not the severity of the damage, but the cost of repairs vs the value of the car. The old definition; but still usable today; is when the cost of is either repairs equal to the value of the car, or greater than value of the car; the car is totaled. It's not because of the damage difficulty or ease of it. The new definition of a totaled vehicle, is when the cost of repairs is 70 to 75 percent of the value of the vehicle; because there maybe additional costs, similar to her vehicle after they stripped the damaged parts.

There’s a body shop down the street from my shop and they have at least half a dozen Amazon vans with damage all the time. I the five years I have been there they have always had Amazon vans in their parking lot, they put anybody behind the wheel.

perhaps you have failed to take notice that "body-shops" do more than repair damage to the body of a vehicle - huge Amazon warehouse back home same thing always a few Amazon trucks sitting at the local body-shop & yet most are not having "damage" repaired, they're being painted etc

Once an insurance agrees to repair the car and a body shop starts repairs they are committed to repair it regardless if the repairs exceed the value. I worked with them for over 30 years in a body shop and never was told to stop the repair once started. That car is not totaled I can tell by looking at it.

_Totaled_ just means the repairs will cost more than the current cash value of the vehicle. Which makes sense, if they quoted less for repairs, and then found more damages once they started the repairs. But I agree, the at-fault insurance is still on the hook. There's no point in trying to total a vehicle out once the repairs have already started -- because the at-fault insurance would now be paying for a partial repair bill _on top of_ the value of the car. But perhaps that's still a better deal, if the total cost of paying for partial repairs and writing a check is less than completing the repairs at a higher overall cost.

For those that may have missed one VERY VERY IMPORTANT DETAIL in this story, it came towards the end when the reporter stated that according to the auto body shop, the lady's car was "released to the insurance company" according to the paperwork so..........THAT MEANS..........THAT THE LADY NO LONGER OWNS THIS CAR. And as such, she's going to have to fight with her insurance company to get this resolved because this is an insurance claim situation. The reporter pointed this out so if you just listen to the video, you will hear that if what the body shop stated is accurate, then this lady's insurance company now owns the car AND AS SUCH, this is something she's going to have to fight with her insurance company about. Just as an FYI, if you get into an accident and your car is totaled or there is a claim, DO NOT "release" your car to your insurance company BEFORE you get a check because if you do that, you will have nothing. So, you need to keep ownership of your car UNTIL you receive a payment that you accept. And don't just agree to "release" ownership once you receive the check, YOU NEED TO MAKE SURE THAT THE FUNDS WILL CLEAR YOUR BANK AND THEIRS. So.........THAT MEANS that you need to either go directly to the bank that the check is drawn from such as the insurance company's bank (which is likely that it will not be in the same town as you) OR........you will have to deposit the check and wait the 5 to 10 business days for it to clear not only your bank BUT ALSO clear the bank that it is drawn from. Just because you receive a check DOES NOT MEAN that the check is "free and clear" or that funds are available. So, you may get a check from the insurance company and immediately decide to "release" the ownership (title or registration of the vehicle) to the insurance company. At this point, you no longer own the vehicle. But, if you take that check to your bank and try to cash it or deposit it and there is an issue 5 to 10 days later because it didn't clear THEIR BANK AS WELL.....guess what...........the "guess what" is that you will be left without ownership of your car and no money either so you're screwed. You have to be careful about all of this. If an insurance company tries to force you to sign over ownership of your vehicle BEFORE receiving a check or at the very least receiving documentation that they will pay you a specific amount contingent upon you "releasing" ownership to the insurance company, then DO NOT sign over your ownership to them. I don't care how much they complain. If you give them your vehicle before getting money, then you can get screwed. In this situation, I will assume that Amazon will now step up and take care of this issue but really, this should be embarrassing for Amazon that it had to come to this. There is picture evidence that the Amazon driver was at fault so there should have been no question who should be responsible to pay for the damages. And as such, this should have been taken care of within days and not weeks or months. This was a simple straight forward insurance claim and for Amazon's insurance department to drag this out and leave this lady like this is unacceptable and unreasonable. Shame on Amazon for doing this. But really, shame on Jeff Bezos for allowing his company to do things like this. I realize that he is no longer the CEO in charge of Amazon but I believe he is still the main owner of the company. And as such, he is still ultimately responsible for how the company operates overall. If I'm wrong on this assumption then I'll retract some of my thoughts about his part in the situation. If he no longer has a majority stake in the company and doesn't have any "say" in what happens, then I guess he isn't the one to blame. But really, it started as Jeff's company so won't it always be HIS company? In fairness though, not only should Amazon be embarrassed by this but her insurance company should also be embarrassed as well for how they are handling this that it had to come to a news station to get the ball rolling faster. The whole point of paying insurance companies is so they will take care of things when this stuff happens. But if they are just going to make things difficult, then what's the point of paying them? This is one of those things where the insurance company should have just totaled out the car and paid her whatever the amount needed to be that was "fair market value" or whatever it would cost to replace the car with one of at least in as good of condition or better than hers and move on. Instead, they forced one of their policy holders to go through this which shouldn't happen. This all boils down to the driver made a simple mistake that was likely unintentional. Yes, it sucks for Amazon that they were at fault for what happened based on the actions of one of their employees but mistakes happen. It doesn't have to be a big deal even if it is a bit costly like in this case. Why make more out of this than it is? Just take care of this person and move on. Instead, now, you have more eyes on you for the unreasonable way that this was handled which doesn't look good for Amazon. Will they go under for this? Of course not. But it still doesn't make it right. One other thing that I didn't really think was appropriate for the reporters to comment on was how much money Amazon has and whether or not "Amazon has the money to fix this lady's car so they can get her a settlement check". Look, Amazon may be worth close to or now above 1 trillion dollars but that doesn't mean that they should be expected to just go writing settlement checks like it's no big deal like the reporter was essentially implying towards the end. There still has to be some investigating or research done to determine what needs to be done to take care of this issue. In this case, it should have been handled within a few days so I will say that it's BS that Amazon didn't just "pay up". But, if this reporter wants to pay this lady herself, then she can do so. But since that's likely not happening, I don't think she needs to go saying to just "get her a settlement check" like it's no big deal. Anyway..........next.

What's the downside to this? She got her car hit, they took responsibility, she has a rental car (WHICH IS BEING PAID BY OTHERS) that's newer and better than her car, and the longer this plays out the less in price of a replacement car since car prices are continuing to drop. I'd personally run this out till the end of summer.

This is one reason to have comprehensive insurance, you can file with your insurance company and have them handle it with you only put your deductible initially and have them duke it out with the other insurance on your behalf and get reimbursed through subrogation and a check for your deductible sent to you. It's a lot easier than trying to fight the other insurance company yourself.

Most states have very vague wording that insurance companies have a 'reasonable amount of time to act'... I suspect the Florida Office of Insurance Regulations would be a good next step... NO company ever wants to get a call from them... It's right up there with getting a call from the IRS.

Look any time that any insurance is covering the cost of your rental, keep quiet and continue to add wear and tear and miles on someone else vehicle until you eventually get a yours fixed or a new one, an added bonus is if you make nice with the rental agency you can often trade in the rental and try out new vehicles. I must have had five or six rentals the last time my car got wrecked I loved it and that's two less months of miles on my car so its a win win.

This is why you go through your own insurance company. If you have full coverage, you go through your own and pay the deductible to get it fixed. Then your insurance company will go after Amazon's insurance for reimbursement since they were 100% at fault. It will not affect her rates because it was not her fault. Once it is settled your insurance company will return your deductible to you.

with my insurance company if the total cost to repair the vehicle is over 75% of what the vehicle is worth it is automatically totaled and they will not fix it. In my opinion if the damage is not repairable then it should be totaled but if its fixable the insurance company should pay to fix it.

Yeah that’s a total loss. Once the frame has been damaged the insurance company will automatically total it out and give it a salvaged title. It can be fixed but you’ll have a salvaged car. I worked in a auto restoration shop and we had a lot of custom and insurance jobs, when the repair totals up to more then what the vehicle is worth.

Does insurance work differently in FL? In CA I call my insurance company and they do all of the work by providing a rental and determining if it's totalled or if I should have it repaired. I only had to talk to the other person's insurance during a deposition when I had to explain my side when the person who crashed took out 4 cars.

It would be interesting what kind of crappy insurance she has.... either that or she doesn't have comprehensive coverage (not collision) which i believe would cover that as the car was parked. Her insurance company should take the lead, pay her off, and go after Amazon. That's why you have insurance to begin with. As far as it being "totaled" or not.... it's a unibody car. If the shock tower is screwed up and the body is twisted, it will never be *right* again. The body shop would be married to that forever. They don't want to fix it...... for future liability reasons. A rebuilder might, but it would then have a rebuilt title, greatly affecting it's value and insurability.

I once had my car totaled. It was worth 26 grand when I first got it and it was bought in bulk. It was from a car accident when the lady didn’t yield to see that I was coming in. She had a stop sign while I did not. As a result, we both got into a car accident and luckily, they took the full blame. As a result, five days later, we got news that the insurance company will send us a check to cover the car’s costs. Then, a week later, we got a check for 32 grand, which was more than the car was worth when we first bought it.

Just remember that not all of those Amazon vehicles are operated by Amazon but rather third party companies. I think what is going on behind the scenes is that there is a argument between Amazon and the third party company on liability. No other reason to dance around the subject really. Just some good 'ol infighting.

The damage on the car was not that bad. My body guy could have that fixed in about 3 weeks

I guess since you know a guy, you know everything he knows? Do you actually understand how unibody structure works? That looks like it goes through two walls. You can't fix that without cutting the body apart. That's not a "pull a dent" situation.

@@dquan731 Given the high cost of parts, it looks like a total loss. That's not a bumper, that's unibody damage. That would require an intact donor, of a body style that isn't old enough to have a lot of "junk" vehicles (salvage due to drivetrain failure instead of body damage).

@@10-AMPM-01 just my opinion. I was an auto appraiser for 5 years and have done countless estimates and repairs. This does not look like any serious frame damage. Sure, the quarter panel and the areas around it looks really bad, but it looks repairable.

A few months back I was home and an Amazon Prime van slammed the side door while driving past a stone wall we have on our driveway, we heard and felt the impact.. the driver left parts on the driveway, the side door guard or something the vans have and drove off without knocking on our door. I reported it to Amazon and they asked me to upload video of the incident, it was super complicated and the system kept saying file too large.. I kept asking why do I need to have proof when the vans have dash cams now and they record everything.. they just play stupid obviously. I told them i want someone to come look at the damage in my mind i assumed they were going to do everything at their expense, their first response was call someone yourself to evaluate the damage and let us know, so basically i pay a stone wall expert and then contact Amazon back not guaranteed that they're even going to take responsibility.. unfortunately i do have video but it doesn't start recording until after the impact so what proof do i have.. i ended up giving up because they play stupid and i know they had the dashcam and delivery van drivers id... not to mention he arrived with a damage van to their lot so you see how Amazon isn't honest with their customers. Their insurance company is ARC. I wish I could have done something but without video i felt like a liar and i was just getting the run around.

@Tristan it would have been a waste of time since the seconds it happened didn't record. The video is like 10 seconds 1.30mb that's nothing, they clearly just set it up in a way to make people give up.

I’m in a similar situation I needed a repair guy to come out and replace some plumbing behind. Some drywall guy came out and informed me it was going to be $150 over the next four hours to remove the drywall. So when he went out to his truck, I removed the drywall myself since it’s my home he then informed me that he can no longer do the job because he did not start it About 40 days ago and these pipes were for my washing machine that cannot be installed because I will void the warranty so now I have a washing machine that I cannot use

What the heck does this lady want, Jeff Bezos to write her a personal check? Welcome to the club lady. Now a days vehicle insurance claims are taking longer to process and body shops are low on inventory of many parts as people more decide to hold unto their used vehicles. Sometimes the body shop has difficulty deciding on wether or not to declare totaled vs the time and cost it’d take to repair. Best be grateful rental is still being paid because many times insurance companies have a cap on a rental. Shame on this channel for “tackling” this situation just because the Amazon name is tied to it. Had it been any other driver/vehicle this would’ve never made the news and it would’ve been business as usual. Just shameful.

I would be fine with it. I mean she's riding around in a rental, putting miles on that thing. I'd be out in it doordashing. Its costing them more money messing around paying that bill. I'm surprised they be haven't gotten on it by now because of that bill.

NEVER "settle". Only ever take them to court for ACTUAL DAMAGES. Take it to court immediately and demand replacement value for like/like. They will only offer your deductible.

Dealing with the customer is often code for we're going to try getting out of our responsibility. These big companies would rather pay lawyers, over settlement of insurance claims.

The first thing you should do in any situation involving damage to your vehicle is contact your own insurance company. It doesn't matter if you were driving when it happened or not. Your insurance company can file a claim with the other insurance company on your behalf, and they will fight for you. Filing a claim for an accident you were not at fault for will not affect your rates. In some cases, they will pay for your damages and them go after the other company to get their money back. When insurance companies know you're handling it yourself, they will always try to get over on you.

That's what I was thinking. If she just paid it off, she might still have full coverage on the car. At that point her insurance company would pay her (minus deductible), then go after the other insurance company to get the money back from them. If they do, she might even get that deductible (I know I did).

Once a car it totaled that’s it. It can technically be fixed but that “Totaled” never comes off the report no matter what you do. A totaled car sells for almost nothing, insurance companies can charge higher prices for coverage if they will at all, and in some cases they can’t even be legally driven. Plus other issues can show up; meaning even more costs to fix. If I was in that woman shoes I would not expect anything less than compensation for the worth of the car once it was listed at “Totaled.”

OMG she'd just paid it off. UGH. Heartbreaking. DO NOT GO THROUGH INSURANCE COMPANIES, GET A LAWYER PRONTO!!! Companies like Amazon DO NOT PLAY FAIR, and they will drag their feet over everything. LAWYERS are good for this. It's truly the only way you can get compensated in most cases.

It blows my mind that anyone would have issues getting the car fixed or replaced with insurance. Who cares that Amazon hit it, file the claim with your insurance company, and let your insurance company go after amazon. Your insurance company will get it estimated, and repaired or they will total the car and cut you a check. Then, your insurance company will take Amazon to court. The only downside to filing a claim with your insurance is that you will have to pay your own deductible. However, when your insurance company go's after Amazon, they will also make sure Amazon pays for the damages, and those damages will include the amount you paid into deductible.

An Amazon driver backed into my car in my driveway as well! Caused $7k of damage. Luckily I was home and everything was taken care of fairly quick. I hope this woman gets her check soon!
