I am at a loss to understand why the bank would honor an obviously altered document and then fail to compensate the customer who was defrauded. An altered check is not negotiable but the bank treated the check as if it were negotiable and then made the customer pay for their decision. How is that okay on the banks part?

The bank honored an altered instrument and who's to say they are not running a scam after we've seen the business practices of Wells Fargo exposed in court. It just doesn't make sense to honor a fraudulent check.

@marc kuykendall I agree! Tellers are usually VERY insistent about identification, AND they also know that big corporations don't have representatives coming in with one check! They usually move them in small money bags with locks on them, and there are hundreds of them inside. A short investigation should have had this person in jail and the problem solved. Cameras 📷 EVERYWHERE!! They know the exact date and time to correlate with the surveillance cameras. Maybe this was some rich radicals kid or something. This math is not making any sense....

If this happens to you: 1) contact the Postal Inspector and report mail theft and fraud, 2) contact the FBI and report bank fraud. Once those agents start showing up, banks get a lot nicer.

I was even chastised for using an expired id as identity (which I said my face on the expired id matches all info needed, but still needed a supervisor for an ok),. Inside job pure & simple. @@lawrencebraun7616 The FDIC insures against loss due to bank failure, which has nothing to do with what happened here. The possible remedy is a lawsuit. I don’t know what the small claims limit is in his state, but it’s likely more than $5000 and he doesn’t need a lawyer. If the bank does not send a representative on the court date, he would get a default judgment against them and could then take other actions that would annoy them enough to pay him to go away.

So I used to work in an operations department of a bank and there are so many things that can be done by his bank to help him. They are liable for accepting the irregular endorsement, but they have a good case to pursue the bank of first deposit as well. However, if they don't want to take the time to do that they can easily mitigate their damages. Checks are valid for what is on the written line, not the number line. So they can perform a simple check adjustment to get the additional amounts the checks were altered for from the BOFD and then they only have to eat the amount the checks were originally written for. There is no reason this poor man should be having to wait for his money.

I’m betting that either they are hoping the customer doesn’t know and won’t follow through or they don’t know. Yep, we had a tidy sum in a credit union, and a thief INSIDE the bank withdrew money and transferred it into three other accounts of people who were just other members. They would transfer from our acct, deposit in other accts, and then eventually withdraw it from those accts to cover their crime. We didn't notice $20K being stolen, because we had made no deposits or withdrawals through the month on a savings acct. They knew we would not look until our statement came out at the end of the month. They were caught and fired, and we got our money back, but that was an inheritance from a relative for our son's college fund. Now I have alerts on the accts and check every other day!

I had to write a $9000 check recently for a local company as they would have added 3.5% if used a card and the only other option they gave was Zelle, which had limits on transaction amounts well below that number and honestly, felt extremely risky as the bank does not guarantee or take any responsibility for the recipient being legit. I told my wife I didn’t feel comfortable mailing it and I was going to drive it over (about an hour 1 way) and deliver it personally. She couldn’t figure why I would want to bother and this video is going right to her. This is crazy and there is no honor in the employees in these institutions. And screw this company for charging 3.5% with card use.

Next time you have a situation like this, get a certified ( not cashier) check from your bank. $10-15 is the average fee. The bank will add a stamp, signature or other unique marking to show that a check is certified. Difficult to fraudulently pass a certified check.

This happened to me but the crooks fished the mail out of a postal mailbox. I wouldn't be so quick to blame the post office. If you notice, there are less mailboxes and the ones that are still there, they're making the door to the mail slot only open a tiny amount. Still, I no longer put outgoing mail in mailboxes, but mail it inside the post office.

OMG! This happened to me 3 years ago. I mailed my rent check to my apartment manager. It was stolen and deposited and my credit Union, Meriwest, based in San Jose, paid the funds to whoever signed it. It took my credit Union weeks to return the money to me and I had to escalate twice, even though I had filed a police report. I tried to file a report at the post office and I actually got the run around on the proper way to file a report. It was if they either didn’t know or didn’t want to deal with it. A big pain. This is a nightmare. If this happens to you escalate fast, file reports and communicate with your bank by EMAIL to have a audit trail of who you talked to. Unbelievable how banks don’t want to protect their own customers.

This happened to my sister a few months ago. She mailed a check to her dentist. She put the envelope in the mailbox at her home like she has done for many years. The dentist didn't receive the check, but the check had been cashed. We live in a very small town (a rural community). A woman who lives close by in our county changed everything on the check, except for the signature. She cashed it at a local store using her real name and driver's license number. My sister did not follow up on criminal charges due to her severe anxiety. She was told the bank notified the sheriff, but we don't know that for sure. She was also told the deputies would not go looking for the woman, but her driver's license would be flagged and if/when she's ever stopped then she would be charged/arrested. And btw, my sister always prints all information on her checks in impeccable handwriting (for about 45 years). The check was changed to sloppy cursive. Yet no one at the bank noticed a thing.

this isn't a Mistake. this should be considered gross negligence and not only should the customer have money refunded IMMEDIATELY (but also any expenses associated with getting this rectified) AND the Banks should face hefty fines (and those fines need to come out of the Top Executives Paycheck/Bonus Compensenation, to ensure they just don't pass the fine off to customers as hidden fees).

If a bank fails to verify the one cashing a check is the true recipient of a check being cashed, like the power company, that loss should be on them, not the person who wrote the check! He should take it to court as gross negligence of job duties. I could see not being able to spot a washed check, but that was not this case.

The law UCC § 3-114 clearly states that the words take precedence over the digits, so the bank had no basis for paying ten times as much as the words stated.

I'm about the same age as this victim and I stopped using personal checks to pay bills about 20 years ago. The only check I write now is a monthly check to my landscaping service and I hand it to them personally. After seeing this, I may just start giving them cash and be done with checks altogether.

Lots of predatory lawyers willing to work for a chunk of the award to sue a bank. In this case they can sue TWO big national banks and really cash out, making him a lot more money after their cut. Lost cash, damages for mental anguish and suffering, damages for affecting a person's credit score, lots of damage claims to be made PLUS attorney's fees and court costs. And to avoid a jury trial which he could request the banks always settle because they lose to every jury.

All the banks I've dealt with dating back to the early 1990s all required you to have proof that you are the account owner when you made a deposit. You had to have a business license to have a business account to deposit a business check. Prior to those years you could deposit a check made out to somebody else in a personal account and most banks wouldn't that and i. But in 2023 I'm shocked that any bank would let such a gross error slip by.

To be honest, I'm surprised the banks even issue check books to customers anymore. Nowadays, it's all going digital. In any case, the bank should be held liable for failing to properly check the person cashing the check has any right to do so. The US Federal authorities involved in bank regulation should be contacted, and have the procedures the banks in question use audited and investigated thoroughly. There's more to it than "90 days has passed we're closing your claim".

Still need checks. I write a few checks a year. 2 for property tax and for car tab renewal. If you go in person to pay, they only accept cash or check. You can’t pay with debit or credit here

Banks are also getting regular checks stuck to larger autochecks in the autofeeder and they call it piggybacking. Your check can get charged for the amount you wrote, and then charged again for the amount of someone else's autopayment it got stuck on the front of! The bank that did this did not notice and neither did my bank when they honored my check twice for different amounts. Fortunately with the check photos they could tell I was telling the truth, but how could no one notice it happening and why is there no alarm for one check number getting cashed more than once?

If he hasn't already, he should contact the investigation unit of USPS. Stealing mail is a federal crime, and USPS has an entire unit dedicated to investigating them.

I understand your point but putting a check into a mailbox at the post office is considered a normal form of payment that's like saying don't carry cash so you can't be robbed you have the right to pay any normal method of payment not everybody wants to use cash app the employees at the bank should have done their job and if they made a mistake they should refund the money obviously they know who deposited the bank account of checks and they need to go after that individual for restitution your statement to me is like blaming the victim the equivalent of saying don't wear tight clothes if you don't want to get raped

Obviously, there is nothing wrong with putting it into a mailbox at the post office where random people can come open it and steal the mail or it’s much less likely to happen.

This happened to one of my customers, I told my bank about it and they said it happens multiple times a month at my bank branch . Only difference is the checks are cashed at a check cashing place not a bank .

If it a certain branch of Bank of America that cashed the checks, then there is someone inside that branch that is in on the scam and is taking a cut. That person should be fined and maybe criminally charged. Check fraud and check scams are a crime.

There is no way these checks would have gone through 20-30 years ago. With all of the electronic monitoring, the machine should have instantly kicked these out, if the teller didn't catch it. There is a reason why checks have a space for the Numerical amount, and the the amount written out long hand. I had a check rejected because the cent amount didn't look like it was the same. That wasn't even the bank, but the place I was just trying cash a check. The teller allowed these checks to go through should have to pay. Is this part of the plot to force everyone to go electronically on all of their transactions?

Yep, in my country to stop check fraud all the banks have closed all their clients check accounts a few years ago, and their clients now has to use their credit or debit cards. Most people in my country now use their debit card as payment, although many still carry cash around as not all businesses accept debit cards.

@@swmovan Well banks are pretty notorious for treating employees like crap, so I wouldn't be surprised if it was some teller that has just given up. Back when I worked for Wells Fargo, we weren't really trained to take care of the customer but more treat them like a sales target.

I am sorry to say this, but I really don’t feel bad for the people of Georgia. They do absolutely nothing when lawmakers make laws to treat criminals as innocent victims and release them to commit more crimes. People of the state as a whole, sit back and take it, the only type of marching they do is when they’re outraged that a criminal is being punished. If you don’t like this type of criminal state that they’re intentionally constructing, leave the state or stand up and fight for what’s right. Chase bank has an absolutely terrible reputation why anybody would continue to do business there is beyond me . This is the third scandal that they are embroiled in throughout the country.

This situation is definitely NOT true for ALL Bank of America branches. In January I received a personal check where my middle initial was incorrect, but everything else was correct and accurate. BofA declined to cash it. I then tried to deposit it through the ATM, and they caught the mistake again, and this time they charged me $18.00, but also refused to accept the check for payment a 2nd time. Finally, I had to return the check to woman who wrote it, and have her issue a new one. This happened in Anaheim Hills, California.
