The plaintiffs rented an apartment from the defendant, but he won’t return their security deposit they say is rightfully owed, so the plaintiffs are suing. The defendant claims the plaintiffs cracked the bathroom sink and ruined the floors and walls, so he has every right to withhold the plaintiffs’ security deposit.

No renter will clean as clean as the landlord wants. I've been in charge of rentals. My attitude is, if you cleaned the place, vacuumed, wiped things down, etc I'm going to do an additional cleaning anyways. There is going to be some wear and tear, so I always planned on repainting walls, etc (white which was cheap and clean). If things aren't broken between dates, then it was what it was and I charged enough rent to cover wear and tear,etc. Now, when I rented personally, I went so far as to wipe down the mop boards along the floor, washed out frig, stove, you name it, because I wanted to give some back to the next person.

The defendant shouldn't be a landlord. He was expecting the plaintiffs to pay for items that weren't their responsibility or were the result of normal wear and tear. A landlord is going to have to repaint most of the time and perhaps replace some things that were the result of normal wear and tear after a tenant moves out.

Sadly, this happens a lot. Landlords try to keep deposits to pay to do basic renovations for their next tenant. I had a landlord try to get me to buy new carpet after leaving that he chose not to replace before i moved in because i had dogs. The carpet was just old. Not damaged by pets or anything. Same guy also tried not buying a new mailbox when the door fell off and then finally gave in and gave me $15 to buy one and install it myself. He also expected me to carry the old 60 gallon water heater that he replaced out of the basement by myself for disposal. He tried to threaten to come after me for more money until i sent him a bill for the mailbox labor, removal of the water heater, replacement of the bathtub faucet, and the 3 years of lawncare he had asked me to do for the upstairs neighbor (his other tenant). Didnt hear from him after that.

The defendant said he had a lot of receipts in there. True. But those receipts were for mostly for the renovations he made. Only a small portion was for the damage caused by the plaintiffs. Good for the plaintiffs for pursuing their security deposit. Maybe the defendant will think twice before trying to unlawfully keep his renters' security deposit again.

A landlord will always in one way or another try to keep a tenants deposit.. I've seen a landlord tell someone they scratched the hardwood floors and you can only see the scratches at about two thirty pm so meet him there at two and he will show you.

Just like there are problematic tenants, there are also problematic landlords. Some landlords wrongly believe that the law always favors them. I had a personal encounter where my landlord kept my security deposit citing carpet dents. I made them aware that carpet dents were considered normal wear and tear, as I required a bed to sleep on. Despite my pleas, they refused to return my security deposit and even laughed in my face. To cut a long story short, I chose to take them to court, presented evidence, and won three times the amount that was wrongfully withheld.
