The judge is only trying and wishing that the mother can prove the allegation. She knows how such laws work. There is no need going there if you cannot prove it. Courts are not places for making a case without evidence. Please note this does not mean the mother or the children is lying.

I am really sorry about what you have been through.. it's a tough situation to be in. But the signs were there from the onset and you still went on to keep giving birth for an irresponsible man. The first and second should have been enough for you to stop. Learn to also love yourself more.. if you had, you wouldn't have gone back to him in the first place.. unfortunately, Nigeria isnt a country that where people get justice. Another thing to do is to write to his place of work!! They may compel him to pay or better still deduct a certain amount from his salary. The ministry of women affairs in Lagos is also there, maybe they can be of help. God strengthen you.

To begin with there is a lot of deception around this program. This is NOT a court of law but Alternative Dispute Resolution which can be compared to a Council of Elders resolving a dispute in the village. Parties to a dispute must agree to partake in this process and the enforcement mechanisms are generally very weak. It seems that this is hardly truly explained to the parties, who are surprised with how the enforcement can become challenging and frustrating once the " judgment is passed.

Why does it look like the Judge was speaking on behalf of the man????? The Judge outrightly cut the lady off when she was trying to narrate what the man did to their daughter!!! With or without proof, one should be able to speak up, it's left for the authorities involved to carry out their investigations. Why not allow him speak for himself? And why's another lawyer present, is the lawyer going to speak for the man or what? Everything in this episode screams unfairness and bias.

Such a sensitive case belong to criminal court and not civil court. The plaintiff can sue him to criminal court on the allegation and be ready to prove it. She made a mistake of not reporting the case to the police immediately it happened, now it will seem as a motive just to defame him cos afterwards, she still got pregnant for d 3rd child to a child molester.

For the first time in years of watching this show, I am highly disappointed in how the judge handled this case, I don’t know if it’s because there was a lawyer present but her words and actions are questionable; why would she even recommend that the woman give access of her children after identifying what the man has allegedly done; surely she should be advising a thorough investigation and ensuring he is financially looking after his children without physical contact. It seems the judge has the Nigerian mentality of “the man is the man” and any other person is secondary. Totally disgusted and disappointed; even when she threatened the lady with the reminder of “defamation of character” and “I have seen people false accuse their partner after a break up”…..it seemed like she was trying to hush her out even when she said her daughter was a witness, she challenged that thought with “is it thesame daughter that they don’t get along”. I can go on and on but, I am highly disgusted at this proceeding. What I would’ve liked to seen happen; advice her to seek thorough investigation and keep that man behind bars, don’t shut her up…..the world needs to be free from alleged pedo’s like him if he is indeed one becos that’s not a normal behaviour, it’s a psychological disorder.

Stop being emotional. You haven't heard the man's side of the story. Judge funmi would definitely will ask the man of it's true but already the woman doesn't have sufficient proof to back that accusation. Judges don't use emotions to judge, the use proof. JF even noted that many women have the tendency of trying to implicate their partners due to bitterness which is true, I've seen it severally in many episodes. You also did not understand that the judge was actually advising her. She's simply saying if you have a more damning accusation that goes beyond a civil case, you better have evidence. Judge funmi was simply advising her to make sure she has proof if she's going to also accuse him of child sexual abuse because it's a CAPITAL OFFENSE. This court is only for civil matters. If the woman could present proof, judge funmi would swiftly transfer the case to a court that has jurisdiction to try a capital offense. Nigerians are too emotional sha. Judge funmi was 100% spot on jare, listen to her very well.

We all know these things that she is alleging happens in the dark or when no one is around. I truly don't think she was lying. It was to many details in that part of the story. I don’t blame the defendant at all, I blame the woman who went back and ended up being used because it was obvious he came back because he couldn’t bare a child with his wife. As for the allegations, while Judge Funmi is right about false allegations, I still believe the matter should be looked into because there will be access and those girls are still underage.

I don't think that is the case here, although she has lots of blame her reason for going back to him seems valid, wanting to have one father for all her children instead of different fathers, however, she should have seen the red light and walk away and since the first is a girl, she should have just walked away from him and start on a different profile with another man.

I have been watching this series for a while and I had been enjoying some of the episodes a lot. Although some civil cases seem to be handled fairly there seem to be a pattern of Judge Funmi dismissing women's report of either violence, assault or molestation. This is the most serious one. If it was a matter of allegation of payments with no evidence Judge Funmi would offer advise for future reference or a chance to adjourn the hearing, but it is obvious that in cases of violence, assault or molestation her stance is difference with immediate dismissal and intimidation with the defamation of character card. Everything can be defamation of character: people go to court alleging violations! As ADR, if criminal offenses are not within your jurisdiction just be transparent and say that! Screen your candidates and reject the criminal cases. Don't intimidate or discourage the plaintiff from seeking justice. This is about kids! There's already a serious risk they have been violated, this has to be taken seriously, so signpost them. I am so disappointed in the her patriarchal bias. And the laughs and shaming towards the plaintiff when looking for a comfortable apartment for her kids. I hope part 2 is a recovery from this outrageous behaviour.

No judge acts on story. Judge Funmi has been educating you people that criminal matters MUST be reported to the Police for investigation before it is charged to the court, that is the procedure. None of you is encouraging others to follow due process but you are castigating the judge for asking for evidence before making judgement. Judgement is not based on emotion but on evidence. I watch many ladies will come to court for civil matter (child support) and start to narrate criminal story. Judge cannot help such ladies. Encourage peolpe to follow due process to get justice.

Although i have only listen to your submission through the posted video, i hope your babies father response and defense will be posted soon. My candid advise is that you should go and report the matter of Child molestation at the Police station, you don't need a lawyer to do that. When Police is through with their investigation, the matter will be charged to the court by the Police. That is the right process for criminal matter. Judge Funmi was trying to educate you so that you don't expose yourself to litigation on defamation of Character. If you want the baby daddy to be paying child support and school fees without seeing his children, you will have to get court injunction to prohibit him from seeing them if what you are alleging is established by the court. You will need to follow all these very well to get justice. There are lots of emotional comments here that you made and many people on this platform show sympathy, but what all those will earn you is just pity party but what you need is justice. I will have to listen to your baby daddy's side of the story when it is posted to know if he is the victim or the guilty.

I find it hard to believe this woman made up such a story. But let me reserve my comments on that till I hear from the man. What I want to say though is that he’s a sadistic person. He has no iota of love for her. She knows it, but yet stvpidly went back to him. A man who abandoned you when you needed him, abandoned your child, another man stood in as a father for. AS A WOMAN YOU SHOULD NEVER HAVE GONE BACK TO SUCH A MAN! Because he not only doesn’t love you, he’s cruel to you too. I’m waiting for his response to what was said. However I strongly believe this court should investigate the allegations of sexual abuse. Don’t just dismiss it. Many children get raped AND HAVE NO PROOF. It will be extremely hard to compel that man for child support because as you and l know, anything goes in Nigeria and we do not have a proper child and welfare support system to hold accountable men that impregnated and abandoned women. It would have been easier if you married him legally then you can seek for divorce in a proper law court and have him pay for child support and maintenance . Sadly this is not the case.

I don't like that judge Funmi trivialized the molestation accusation. I don't understand why a father would want to see his 13year old daughter naked for any reason. The defendant was even reading his reply from a script, that means his lawyer even wrote it for him. People don't go this far unless they are hiding something. It will cost him more to pay the lawyer than one year's worth of upkeep for his children. Shame that Judge Funmi allowed this in her court.

It will be irresponsible to allow anyone come on National TV to destroy another person with criminal allegation that was not reported to the Police and investigated. Put yourself in the position of the man. As the Judge you need to balance the matter. Criminal matters MUST be reported to the Police for investigation, you cannot bring it through back door into the court. No judge will allow it. Especially when what you filled before the court is civil matter: Child Support, the procedure is different. I guess you made your comment because you don't know how the court system works.

Very Ignorant remark. No judge will allow you destroy someone else on National TV with ordinary story that can be false. That is why all criminal allegations must first be reported to the police and be investigated before they are charged to the court. You cannot bring a child support case which is civil matter to the court and begin to make unreported criminal allegation in the middle of that. If you have a criminal case, go to the Police and report it. The Judge is very wise in her counsel to the Plaintiff. You need to learn from this too.

The lady did not file a criminal case if you listened to the matter. She cannot in the middle of civil matter start alleging criminal offence. The procedures are different. Imagine the defendant is your blood brother, would you encourage his accuser to carry on with accusation on social media and national TV without any proof. Criminal matters MUST be reported to the Police and investigated before it is charged to court. There is a reason for that procedure. If you are not married yet and you're here please take all the lessons seriously. Prevention is better than cure. Choosing a partner is a serious decision that goes beyond all the butterfly feelings or the trends on the society. Be very intentional and don't date for fun. If you're in the university, you don't have to date someone there just because everyone is doing it or because you think you are of age. After all, what you really want is a blissful marriage eventually and not the ephemeral "fun" in school. Dating, sex, marriage and having children and serious decision that needs to be taken with adequate information. By all means avoid all forms of complications in your life by taking your time and being intentional in taking an informed decision. We can pity this woman all we want but the fact remains, she has a whole 3 children with a man she can't trust and she'll have to deal with him all her life. This could have been avoided by not dating this guy in the first place if she was informed enough. This is my two cents. Thank you

Someone tells you they saw an adult man with a hardon messing with a child and you just cut it short with nir evidence move on, sorry not good enough at all. This is the same with domestic abuse, many many cases where even the husband has admitted beating his wife and she just says counselling and that's it. And that's how many people are shut down in Nigeria and things swept under the carpet. Such an accusation must be investigated by the right authrotire, she can't just say oh you don't have evidence and pretend she didn't hear it. That's now how it should work.

Nobody moderating a TV program will allow someone to come on TV to allege a criminal offence without evidence. It is not fair on the defendant. Imagine you or your dad is the defendant and a lady just go on National TV to allege a rape case, not reported to the Police, no evidence and more especially when the case she brought to court is not about the rape. I am sure if what she originally filed in her case is on Child Molestation, she would have been well guided on the procedure for criminal matter. It is an ARBITRATION Justice Court. It lacks jurisdiction to entertain such issues outside the scope allowed it. Rules of professional conduct demands she caution you on your rights and liabilities, of which she did. In the Nigerian legal system, MATRIMONIAL CAUSES, CRIMINAL OFFENCES, CHILD CUSTODY etc, are not Arbitrable for now. If you want the court to entertain the claims and allegations you raised, kindly take the matter to a COURT OF COMPETENT JURISDICTION.. where rules of Evidence shall apply. I understand your Emotions and sentiments, but unfortunately LAW HAS NO NEXUS WITH EMOTION and SENTIMENTS. I wish you well.

I was mnolested as a child and was afraid to talk, for this 13 year old to speak out to her Mom is laudable. He lawyered up because he is a criminal. and wore dark glasses so no one can recognize him but his day will come. His neighbors & family members better watch their children around him. He is sick, why would you want to see the nakedness of a 13 year old, especially insisting on it. One thing is that lawyers always support each other. When you file a civil case you stick to the civil case, if you have a criminal allegation, that needs to be reported to the Police, they will investigate and charge it to court. That is how it works. The procedure for civil and criminal matters are different. The plaintiff's claim which is Child Support is purely civil but on National TV she started alleging criminal matters that she claimed occurred years back, which she did not report to the police, to me that sounds like a hurting lady that just wants to use media to destroy the man. It is not fair on the defendant. There is a procedure on criminal matters. The judge cannot make judgement on the story she was telling without any proof. That is why Police is involved on all criminal matters.

Have we asked the child to find out the truth? Why was he not in good terms with his daughter? JUDGE Fumi - ma, you did a very poor job in this case? The case was rigged probably because of the presence of a defence lawyer. An investigation should have ordered into the case of sexual abuse of a minor..... What I see here is espírit the corp... The lady is clearly not sensible and the man understand for a fact that she can be easily manipulated. She deserves to be protected including that little girl too.

As long as there is an allegation of child molestation, custody should not be granted to the man over the children. He can be made to visit to see them either at the woman's place, neutral ground or at the court premises. The police should also be brought in to investigate the allegation and if found culpable, the man should be charged for child molestation. Meanwhile, he should be made to provide monthly up keep for the children in addition to paying their school fees. The complainant shouldn't be made to feel abandoning the allegation of molestation due to the presence of the lawyer over fear of defamation of character because she doesn't have concrete evidence other than the testimony of the daughter.

Judge funmi should be interrogated. This is not acceptable. This was a sad watch. I think after watching this, it’s about time Nigeria establishes an agency that advocates for children, like CPS. The judge trying to muzzle her from speaking. If the court can’t handle such cases, then I’d suggest during inquiries, the clerk should transfer such cases. Most sex crimes I never spoken of and when spoken might be just said once. She might never bring this up again thinking she has to be her own lawyer to prove behind a reasonable doubt the man was guilty of the allegations, let her be directed to a lawyer who would advice her on evidence gathering and proper investigations. Absolutely agree. This was a sad watch. How do you "prove" such things? Is it when the child becomes pregnant or the molester is caught in the act??? Either way (if the allegations are true) immeasurable psychological damage would have been visited on the child. And when the child's begins to act this out, the very same society that had this swept under the carpet would roundly condemn her. It is a shame.....

This my favourite judge totally messed this up. My grouse with the judge are as follows: 1. An allegation of sexual molestation on a minor was made, I felt the right thing for the judge to do was to simply ask the lady if she had reported to the police or she may want to advise her to do so if not done already. But she went on brazenly to silence the lady by misinforming her that she had to provide proof of molestation-what proof exactly? video evidence? I see why people remain silence when they get molested. Seeing a video like this where a judge is practically suppressing the accuser and asking her to bear the burden of proof-so what is the job of the police if she has to be the one to go gather evidence. Well, I am not a lawyer but there are basic laws that guide living in a sane society. When such allegations like sexual assault (especially against minors) are made, it becomes a matter for the state, the burden to prove lies on the state not the victim. The defendant has the burden to proof that he is innocent by employing lawyers who will help argue the case in his favour. It is not a civil matter but a criminal one. Asking the lady for proof is actually untrue-it is the duty of the law enforcement to gather evidence by a lot of means available to them. The law enforcement agents will definitely interview the accuser and the accused. Judge Funmi messed this up. I am so sad.

You truly did not hear the Judge ask if the matter was reported? Watch the video again. Criminal matters must be reported to the Police for investigation and the burden of proof is on the lady, she needs to make the evidence available to the police during their investigation so that the police can charge the matter to court. The Judge's caution to the lady is appropriate because making unsubstantiated criminal allegation on national TV can earn her a deformation of character charge from the defendant.

The burden of proof in an alleged sexual assault lies with the prosecution and in this case it lies with the state (law enforcement) not that the lady should not make accusation because she can’t prove it. How else do you expect her to prove it? The only thing she has to do is to report the alleged crime to the police. There’s a witness who also happens to be a minor that had almost similar experience. It is statements like this that makes it difficult for people to actually present their case.

No TV program anchor will allow you to freely make criminal allegation on other people on TV without proofs. I believe the lady landed her story anyway because we all understand what she was talking about. I believe what she said if not true is still very damaging and unfair to the defendant (that can be you tomorrow). The judge did the right thing by throwing in that word of caution. Any criminal allegation not already reported to the Police and investigated SHOULD not be allowed to be allowed on air. The lady's case and claim, which is Child Support is civil, i beleive if her claim is criminal she would have been advised on the procedure to that but she got on air and started telling story on criminal matters, that MUST be reported to the Police.

Marriage isn't compulsory, the lady is educated... She should have moved on after the first child, but she just clearly wants to be married by all means. I need to tag FIDA to follow up this case, as I suspect some sort of bias towards the plaintiff, and the judge’s attitude and body language is not encouraging the plaintiff to make her case regarding the alleged sexual molestation of the children. It’s worthy to note that most sexual predators usually exhibit some tendencies and as a mother I can never take it lightly. Even if the defendant is granted access, it must be a supervised access. Wether or not the plaintiff is able to prove this weighty allegation 😢

This judge needs to be very objective and should not rule out the possibility of the molestation especially when kids are involved. Why not investigate and call those kids to private investigator to be sure such did not happen. Don't silence people when they are telling their stories, you can never tell for a lot is happening in the world today!

I wonder what kind of proof the judge needs to see for an acusation like this? The man standing naked next to the child? Not every accusation needs concrete proof. The mother of the child raising concerns about her children should be good enough. if you don't believe her just be quiet. She shouldn't have tried to silence her.

So that story from the woman is sufficient to send that man to jail. If that is how it works do you know how many men will be in jail today on the account of false accusation from aggrieved wife? If the defendant was your father or brother i am sure you will be keen on hearing his own side of the story. Put emotion aside and put on sound reasoning.

Shame! This is what you get in a deeply patriarchal society. This man molested his children, the older one could speak up and told the mom. Her family contributed and got her accommodation away from him. She is open to giving visitation access but must be supervised, yet the judge is trying to silence her instead of telling her to report it to the police and ensure she has credible evidence.

Y'all are being so emotional that you aren't using your head. First she hasn't judged the case yet. Imagine I go around telling people that you're a thief and police just come and jail you without investigation or questioning. She still has to hear the man and because she said he did something does it mean he did? If he comes and say another story different from what she says y'all will say he's lying because you've heard a touching story from her. Think with your head and not your heart. If the judge let her continue on that allegation part it can ruin the family for good even money for upkeep that she want from him now will be gone for good

I do NOT play with child molestation AT ALL!! This case should nof be taken lightly at all and more investigation should be done. And if it is found that he is guilty, SEND HIS ASS TO JAIL AND THROW THE KEYS AWAY!! Also, I'm mad at this mom, how could she not report this to the police?? I also don't really like Judge Funmi's stance at the moment

You have no idea of the law and you are biased towards the man. A woman says something and you have concluded on it. The 13 year old hasn't said anything yet. Then tomorrow you people will say there is no justice in Nigeria. You can never I repeat never convict anyone without proof. The Judge did nothing wrong.

I appreciate that you were able to see the light and critical concerns about this matter. I am the mother of the 3children. The manipulations, emotional traumas, mental tortures that this man put me and my kids through,and still going through is beyond words. Many was edited out of the video,the talk in the courtroom took more than two hours. It been six months after the court and not a penny still from him to the children,no upkeep ,no sch fees, absolutely zero. When the children school contact him,he told the sch owner to chase the children away from school that he will not pay the school. I have an audio backup for that. It was quite obvious that there was also some kind of manipulations he and the sister did with the lawyers, because even after the judgement,the results were still manipulated right in my front. I am happy, people just watch the small video and still see it.there was just a lot of struggles,I have no doubt that he paid them behind. I called the lawyers back for next steps and they are not even picking my calls anymore,they told me not to come to their office,also not to call them anymore. I have stop calling them. No justice in Nigeria. many offenders like him knows they can get away with whatever crimes. I wanted to get justice and especially child support upkeep for the children. I can not afford a lawyer or children lawyer, in this terrible economy in Nigeria. Day to day expenses with 3kids alone is tight,not to mention sch fees,house rent,medicals,but God has been faithful.

I just hope the Judge will read the feedbacks from this case and adjust accordingly in the next hearing and that is if whe didn't deliver judgement on that same day. That complainant appears alresdy intimidated and may be compelled to limit her prayer to the welfare of the children. If the Judge's concern is about the man going to jail and wont have the opportunity of working and providing for the upkeep of the children, then he must be under strict surveillance and caution from the Court. The woman is afraid that if he has access to those children unchecked, he will keep molesting them. But it will be very wicked of her if she was making up the story to ensure full custody even after their teen ages.

Folks like you into the same shit stories to destroy others would call the judge biased. If the story makes sense to you, then you need to get checked. The judge has been super neutral because if it goes to trial, you won't lose the outcome. I've seen plenty of your types thinking this story would fly.

The judge was too early in warning her about defamation. She should have waited to hear from the man before doing so. Dont draw conclusion before listening to the other side. Is the judge prepared to entrust that 13 year old or any child into the care of that man. She should have ordered a further investigation into that matter and not total ignored it.
