Judge usually doesn’t allow dismissed cases to be part of evidence by the state, all depends on the judge. I don’t think the DA cares about that case either. The jury might even be instructed by the judge to not use that dismissed case to deliberate what he’s on trial for now. This is just the lawyer posturing that his client didn’t do not en! And if evidence is lost, I believe that was to benefit Lil Jeff, I really believe in my opinion someone did that as a favor for Jeffrey, but now the lawyer wants to say and have us believe it’s because the department is incompetent. Not so fast.
