That is up to the EEOC to decide as they conduct their investigation. The employee will receive notice on if the EEOC will be taking their case or if a right to sue letter will be issued. Employees should have as much documentation as possible including copies of emails, a history of dates, times, and conversations of when things occurred. If possible and you are able depending on the laws in your state, also having audio recordings is helpful. What if you already have an attorney and they file charges against the company for retaliation and wrongful termination.

What happens when you file dual charges with DFEH and EEOC. do they both investigate.

Hi! So sorry for the delay. The Department of Fair Employment and Housing (DFEH) is the institutional centerpiece of California's broad anti-discrimination and hate crimes policy. The Equal Employment Opportunity Commission (EEOC) is responsible for enforcing federal laws that make it illegal to discriminate against a job applicant or an employee. Because they are different agencies, they would investigate claims separately. I would encourage you to speak to your investigator with each agency and confirm this. Hope this helps!
