I mean even if it were possible to reach these companies, it would take a LOT of time and effort to do anything and it still might not work, so it's obvious why Felix just doesn't bother. That's the unfortunate truth of copyright, like he said in the video, companies have absolute power over what happens and the creator can do nothing unless they devote their entire lives to getting a single video back.

Someone is impersonating Toei animation company, deleting all of the one-piece videos and secondary creations posted on KZbin as false copyright infringement reports and terminating one-piece related accounts. In particular, since the revenue from the number of views of the one-piece video uploaded on KZbin goes to the original copyright, Toei company, it is causing enormous damage to Toei company in terms of revenue as well as to one-piece fans. It is also preventing the influx of new fans due to these illegal activities. I have the evidence I've collected so far, can you help me?

Emplemon once got claimed for using Spongebob music on his Spongebob video, thing is they were copyrighting for 00:00 minutes of a song, it wasn't even used in the video. It could not have been detected by content ID because there is nothing to even detect, someone in Viacom or Nickleodeon had to see the video then just claim it because it was a video about spongebob. God I wish KZbin had a proper competitor, I would jump ship immediately

Not a lawyer but I'm sure it's called fraud in the dictionary. Which is theft by means of deceit (making a false claim) and trickery (convincing KZbin that your company has some legit role in this). The biggest flaw is that the current copyright laws set the bar for those things right on the floor in regards to KZbin's need for verification.

Nu no no. A "challenge" is a natural obstacle that CAN be overcome by sheer skill. This is an obstacle, sure, but it ain't something you can overrule, because it's a brick wall placed by other people ON PURPOSE, and intentionally nigh-impossible to solve. This should not be treated as an 'eventual positive', but an attack on the content creators we've been supporting for almost a literal decade.

If someone wrongfully claim your video, they should have to pay for all the inconveniences that this false claim cased. (Not just get the video back) There should be consequences for this type of copyright abuse, otherwise there is basically nothing to lose and they will keep trying. As soon as false claims are not profitable anymore, things would drastically change.

Removing dislikes is just another part of YT's stated goal of making the platform more "normie" friendly. Google wants YT to basically be the Internet equivalent of cable television, and as such they want a sterile walled garden where everything is as turnkey/hands-off as possible so they can attract the maximum number of advertisers.

Except KZbin doesn't do the arbitration... They let the claimant do the arbitration... Which is problematic on so many levels...

@@a_d3mon If they did, the claimant could then sue YT as well. There's a law that protects platforms like YT from being sued for content they did not directly make. They do interfere in some cases (I believe they even supported some creators in court), but the problem to me is not YT, but the companies that claim randomly and sue left and right. There are also different laws in different countries all over the world, I'm not even sure which would apply and who is right in these cases. There are also some ridiculors copyright claims out there in courts (I'm looking at the omegaverse shitshow), YT would be stuck in legal battels forever over petty things and companies wanting to get some money out of them.

If KZbin can make an automated system that allows creators to "cover" their clamed videos, then they can just as easily make a system where companies have to PROVE that the clip in question falls out of fair use law.

KZbin should have an "auto claim" feature where the CREATOR claims their OWN video and if it is not using fair use then the company in question should have to make a strong case for why it is not fair use. It seems that anyone can just randomly claim a video so if it is automatically claimed by the creator then I doubt any random "companies" would even try to claim it.

Issue with that is that creators would get sued thanks to current copyright law (in the US) AFAIK. All of it is really the fault of governments not being modern enough.

KZbin did this to avoid being sued by companies, I'm not sure if creators can even sue youtube for that. We really need a framework which would allow youtube to basically step out of the situation and force the company to either sue the individual or the video stays unclaimed. (Assuming the creator also disputed the company)

KZbin should bring in a fee for companies for every copyright claim they do, if their claim is proved correct, then the fee should be dropped. It would make at least some companies think twice before putting out a claim which has no evidence to back it up

Then you could take youtube to court, they can claim negligence for not being able to review every videos copyright strike due to the large volume(what they currently do), but they can't forge evidence and fake the result of a copyright review as that is a law that goes beyond KZbin terms and service

@@tomkeane4665 they can prove claims incorrect/correct, it's just that process nvr takes place because companies can spam copyright strike button and youtube doesn't have time to review the thousands of hrs of content that gets posted to the website everyday and has a copyright strike applied to it by a company, hence having a fee would reduce incentive for companies to spam copyright strike button

The problem, and this may seem blackpilled, is the record labels and Hollywood don't really care. MPAA and RIAA won't accept it, and sue KZbin/Google, pay off the judge in the case, or at least threaten to have him fired, and then go on the media to make KZbin look like the bad guy. In theory and on paper it sounds good, but the real world is often unforgiving. It's why I think a cryptocurrency/Blockchain based video sharing site might be a better alternative. Payment via cryptos, from a coin that you earn. To gain more traction, announce user friendly tools for all platforms and have apps for mobile devices.

From what I understand, it is what they are legally required to do. If they refuse the company's claim, they become liable for copyright themselves and can be then taken to court . Who do you think Toei animation would sue, the one youtuber or KZbin? Probably both. Taking into account Japan laws, they would also probably lose. Copyright on the internet is already in a weird place legally, so I really understand why there are so many cases where they just opt to remove the content. There are still things that could be improved, and they are, slowly. But there are very few cases where YT wil be able to just flat out refuse a company's copyright claim. There are cases where YT supported creators in court. But let's be real, they couldn't do this for everyone.

It's absolutely insane that there are no meaningful repercussions for repeated and _knowingly_ false accusations of copyright infringement; especially when the arbitrator between both sides is a private third-party corporation with a massive conflict of interest and absolute authority over the outcome.
