I did eventually get the copyright claim released from the video. I announced it with a community post but I guess not a lot of people saw that so I'll announce it here too. I really appreciate how supportive you guys were throughout this whole ordeal. It's kinda funny how Disney copyrighted the video, upheld their decision, and then let my appeal sit in isolation for 26 days without a word and then suddenly right after I made a video recommending the Moon Knight show, they released the claim. It's most likely unrelated but still kinda funny.

Honestly I’m surprised that KZbin Creators have not started a class action suit against KZbin and business’ like Disney and CBS with claims of endlessly violating Fair Use with a request to the judge to limit copyright claims and to force KZbin to have punishments and make Double Jeopardy claims end with the claimant’s account being banned from the site if found false. @@shibasarecute What would be more realistic (not very) would be to appeal to legislators and ask for better protection laws for copyright and content creation. All media does fall under art and a lot of these videos fall under education use. The problem with that is we have these restrictive and one sided laws in the first place from corporations having governments in their pockets and lobbying. The other option is for a mass exodus and give youtube competition. Unfortunately that’s not realistic because we’ve locked ourselves in a monopoly (also unregulated). Governments and largely consumers really haven’t caught on to the traps digital platforms become as a monopoly. Google has no competition because the technology required for a search engine to get better requires for more people to use it. Google is currently the best because of this (and good decisions in early days) and people don’t want to switch to worse ones on the promise they’ll eventually match google if they do. Its similar for KZbin. There too much content that’s only on there. Alternatives aren’t even readily known and what we do have tends to be more narrow/specialized than KZbin. Even if we had the perfect other platform, everyone would have to move at once for anyone to. Content creators aren’t moving because their audience is on KZbin. Viewers aren’t moving because their content is on KZbin. Even if some do, there will always be that large segment on KZbin only. And because of them content creators would upload on both, keeping KZbin afloat. Its not like other social media where its just quick posts or tweets people forget about anyway. KZbin is basically a streaming service where by design almost all their content ends up being exclusive.

Here's what you should try next: 1.Reddit - Make a post detailing your issue in a few subs , if the post get popular , you can get help when people share contact info of someone working in KZbin. 2. Twitter- Make a detailed tweet about your problem and tag KZbin in it. Ask your fellow creators and your audience to retweet it. If the tweet get enough traction , someone from KZbin will reply and your issue will be resolved. And yes , don't forget to add screenshots of their wonderful chat help service.(in both cases)

KZbin lifehack, if multiple parties have a claim on a video, the profits are divided evenly between everyone except the channel, so you can commission a piece of music, make sure you own the full rights to it, then you put it in all of your videos. This way nobody can take more than half.

"Fun" story about the copyright abuse. I was subbed to a guy called Rooseboozje (Probably spelling that wrong. he's not done anything in years). He put up ORIGINAL songs HE made. Several got hit. HIS songs were hit by claims.

The shitty thing about youtubes so called "copyright system" is that apparently anybody can claim something. It doesn't even have to be an actual company that does it. There was a channel I followed a few years ago and they got a claim on one of their videos. Turned out it was somebody POSING AS A COMPANY trying to claim the music he used (which again wasn't claimable because it was original music from a friend of his that's in a band) and youtube let it go through. it's complete bs. The only time they do something is when somebody like Markiplier makes a stink about getting a single claim and he complains in a video and all of a sudden it's gone cause of who he is. KZbin doesn't give a flying fuck about the smaller creators. They only care about the big time people

I've had friends and family work at Call Centers that handled multiple companies' customer service phone-in. They've confirmed to me that across the board, customer service people have to read and follow directions from a script. And if they deviate from it, they get punished for it. Just a tip for chatting to customer service people, ALWAYS ask for some way to keep track of what they’re doing. Ask for a ticket number, to be CC’d or BCC’s on the email, or your account number that they’re documenting the interaction on. They’re more likely to do their jobs if they know they’re going to get grilled on it in a day. Worst case, just screen shot everything for Twitter and say “I’m reviewing my legal options.” That usually gets attention.

@@anna-flora999 pay attention. I said 'breach of contract.' Meaning that he'd go after KZbin for breaking the legally binding contract that they both have to uphold. KZbin HAS to abide by the terms of service, otherwise they open themselves up to lawsuits. Just like they can sue us for violation of the terms of service, we can sue them for the same. Whether or not the contract between him and KZbin is lawful or not isn't on the table. It's both legal and enforceable. On both sides. I'm suggesting that he takes KZbin to court over the fact that they have violated the legally binding contract that they were legally supposed to follow to the letter, just as we are. KZbin may be big, but even they have to obey the law. And the fact that they are so big means that a successful lawsuit will cost them BIG time. It'll be incentive to uphold their end of the contract in the future...especially if he makes it a class action lawsuit. A class action lawsuit can cost KZbin millions if they lose. So there are ways to go after KZbin, I've made very clear.

So under that scenario, he'd go try to sue KZbin under that part of the agreement, the court says "hang on, that part is unlawful", and declares that part null and void. The fact that anyone can copyright claim a video without proof that they own or are even affiliated with the company or content they claim to be a part of is a huge flaw that needs to be fixed. This flaw just allows the copyright system to be used as a weapon by anyone with no consequences. This may never change because why would KZbin care or put forth the effort to fix this for the little channels? I'm more than sure bigger channels don't have as much trouble because they are the money makers. The only solution I can see is KZbin needs more competition so they have no choice but to care or lose money. At the end of the day the only way to make big companies care is to hit them in the wallet because most if not all companies claim to care about you but in reality they only care about your money.

I know that all Disney films are not in the public domain except the 1930's mickey mouse cartoons (maybe). Anyways, I do know that if those who ask creators to use these films under fair use for reviews or something, but it seems hard that KZbin copyright strike things that are made from filmmakers and not themselves. Only movies up to 1924 are in public domain. All those realized after that year fall into public domain almost always by mistake, because the copyright holders forgot to renew the rights (of course, sometimes they don't renew them on purpose, but it's very rare). Needless to say, Disney has less than 10 films post-1924 in public domain, only three of which featuring Mickey and just one of these three is in color... In fact, Disney has been the main culprit in delaying public domain access to numerous works.

Having worked as a support agent in chat systems I will give a bit of insight here. (I don't work as a chat agent anymore) Asking for someone in charge will almost never get you anywhere for one simple reason, the management is there to manage the employees not do what they do, so they can't help more than the employee can. If there is something that needs approval above the employees level they will be reaching out to the correct department for help. Now to be fair I can't speak for how KZbin support works, and not trying to defend it, just giving some insight on the background.

We are at a point in society, where that so many people are in charge of things that they are unqualified for, that stuff like this happens due to laziness and/or shuting down those with differing opinions that aren't theirs. I sometimes overhear stuff like this with HR departments, where people that are qualified for a job won't get it because HR have entirely different requirements for employees then Management wants/needs. Not sure where i was going with this but... Maybe someone at KZbin needs to be Slapped? Hope this gets resolved soon.

That would require their own server for their own site to host all the videos they would make, which gets expensive and requires maintenance to make sure the site doesn't lag or crash from all the traffic. It's easier said than done. If they simply use a site like Wix, they would have to pay a hefty amount for Wix or Squarespace for that required server space.

TLDR: the laws the systems are based on come from a time when people uploading content online where either cooperations with legal teams, or private people uploading without a profit motive. (I highly recommend Tom Scotts video "KZbins copyright system isn't broken. The world's is" on that topic) Because of the laws in the US. Sure, there's probably some things KZbin could do to improve their system. But overall? It's the least bad system we're going to get under the current laws. ("current" because they're currently on the books, but they're pretty old) Here's the problem: if Disney goes to KZbin and says "this guy is breaking our copyright. Now, we don't want to sue anyone, or have the video taken down. We're fine with one person having their silly little pet project (note: I know it's not just a silly little project, but that's basically what the laws and systems are designed for). But we want the ad revenue from it," then KZbin has two options: Say "ok, we'll do that", and in theory, everyone would be happy. Disney gets paid, and Noone gets sued. Because again, in theory, the system is designed to protect very small people. Like, if you upload a video you made at your daughter's wedding and there's copyrighted music in the background, ContendID takes care of it. so the small private person (presumed under law and systems to not be a professional creator) doesn't get sued by Disney, and neither does KZbin. If KZbin says no, then Disney could do "alright, then we'll issue a DMCA takedown notice." that's basically Disney saying "hey, you're hosting content that breaks or copyright. take it down or else." KZbin can again say Aye or Nay. Aye, they follow the notice, take the content down, and, and that's an important part, then they're completely free of any legal responsibility. Afaik, the way the dmca works, KZbin (or any other hosting service) doesn't really have to investigate if the claim has merit. And therefore if they comply with the notice, the creator who got their video claimed can't sue KZbin. And neither can the company that issued the claim. If KZbin says no here again, they make themselves responsible for the content. Meaning Disney, or every other big media company, can then just sue KZbin. They might win, they might lose, they might not even sue because its a bluff. But I can't blame KZbin for not wanting to risk it with someone like Disney.

I’ve seen other creators that I follow talk about this for a while now, and I think this could have a chance of helping you in the future. (I know this is an old video but I wanted to say something anyway.) So, instead of any footage from something that can get you a copyright, you could try still frames of the film/show and also still frames from any promotional stuff: Trailers, TV spots, etc. I hope it helps, stay mythological brother!

Right now YT has a stranglehold on video social media, which means they don't care because they don't need to. They think they will be on top forever because they got there first and no competitor has been able to topple them, but sooner or later they will damage the user base to the point where they will loose it. The're either going to erode over time, or self destruct in one fell swoop.
