how is the trailer working? is the lack of trailer suspension excessively harsh riding over bumps? (at speeds with such a relatively light load? )

The camera should be reading the free running clock for every frame and recording that data, not just the start and end frames. That's how how all my old DV and HDV cameras worked in time of day timecode mode. Very cool you made a script to fix it tho. Sucks for my OCD that on the bin level there is still a gap.

All insurance company should have 'Diminished Value' clause added in each insurance claim and should offer that value at the time of car repair itself....the way they offer rental car, they should also give 'diminished value' after their repair estimate.... Person who is at no fault, should not have to bare the 'diminished value' of their car, its unfair....and do not even have to struggle so much to get this amount....not everyone can go through this long fight....insurance companies are taking advantage here by not even discussing with the person who is at no fault also by not accepting the 'diminished claim' or not giving the fair amount.... It's universally known that if car gets hit, its resale value goes down...how come insurance companies donot believe in 'diminished value' when they are in this business, its totally insane...Society have created insurance company as not everyone is professional and aware of all the details, hence we give premium to them to know all this stuff....

Well, State Farm is there to make a profit. Most people would not go to your effort, or more likely, not be educated enough to figure out how to do it. Insurance companies know that. I suspect they figure that the number of people who sue versus the number who do not is such a disparity that they make more money by making you work and not having to payout on the ones who do not sue. Realize they do suffer with their insured but in most cases no one sues so they will accept the few disgruntled insured. The other thing is what you heard in court. Issues was liability and damages. (You are also lucky as even if they were subpoenaed to come to court the Florida Court could not force them to come to testify. They could issue a Writ of Body Attachment if they are ever stopped in your county but not likely) You could do Request for Admissions etc., and get the information in that way on liability but you probably would have thought after they were served they would come and maybe they would have. I don't think I would as you might give up. Now, State Farm, may well have hired local counsel to handle the case. That is not cheap. Easily figure $250 per hour (Although nothing to do with this case but since I dislike the profession that Doctors belong to I will digress to the following: Go to next double space if you want to miss this diatribe about Doctors and back to his issue. That amount is MUCH CHEAPER THAN A DOCTOR, THAT MAY HAVE FOUR BRAIN CELLS BUT KNOWS HOW TO WRITE REPORTS WHERE LAY PEOPLE AND ATTORNEYS NEED A DICTIONARY TO READ THE REPORT, WHO PUTS DOWN THEY SAW YOU FOR 30 MINUTES HA, HA, HA, AND ANOTHER HA. SEE WHAT THAT AMOUNT IS. PLUS, THE REPORT OR NOTES WILL ALMOST ALWAYS BE VAGUE OR WILL SAY YOUR CONDITION IS A CHRONIC CONDITION. OR NOT EVEN MENTION WHAT YOU TOLD THEM. JUST A DIG AT DOCTORS.) Seriously, A suggestion for everyone who sees Doctors is to one or more of the below: 1. take a written list of issues with you and keep a copy for yourself, and mail or scan the copy to a friend with instructions not to open the correspondence. 2. If your State allows to where only one party to a conversation needs to be aware of the conversation being recorded then put a tape recorder in your pocket and record your entire conversation. (I don't particularly care for that so I don't tell that normally). 3. If your State requires both parties to know of conversation being recorded then tell the Doctor that you would like to record to keep an accurate memory of what happened. 4. You could also, leave after the visit then immediately type yourself an email with a carbon copy to an email account you set up that you don't open, or to a friend you trust saying everything you told the Doctor. The Reason I feel the above is important is people in the USA already think that Doctors are just the cat's meow. So, if you told a Doctor for four years and you saw him/her twice a year of a problem you are having and he shrugs it off then after say four years another Doctor or him/her find out too bad, you are dying. Well, you may argue malpractice. Just remember Doctors' are the cat's meows to people who don't deal with them enough or just lucky and have no problems. Those people are going to be the Jury who hears your case. The Doctor's attorney will be sure to let the Jury know that there is nothing in his/her notes that you ever told him/her of your issue that you said you told him/her of every six months. Why would he lie. Well, he may not, he may just didn't put it in the dictaphone or it was not transcribed correctly, or he was thinking of the new car he was going to buy, etc., etc.. Now, it is convincing when he has notes written at or near the time you two met and you don't, along with him/her being the cat's meow (hopefully it meowed after eating something). BUT if you do one or all four of the above then you have at the time of the meeting 1. A written list of issues that you have a copy of and a friend of your's has a copy that has been mailed and unopened or an email that has been unopened, so it makes it difficult for the Doctor's notes if different from your notes that you left with him (for instance you had a list of complaints and his notes never mention them then it looks like he might not be believable), 2. The actual recording under 2 and 3 above, will have everything that was actually said. (Be aware, you should listen to it after you leave the Office to be sure you can hear it and if not then do 1 and or 4 above to cover yourself. 4. You as he does have contemporaneous notes from the visit done immediately after the visit then it puts you on more equal footing. Myself, I would do 1, 3, and 4. A headache for sure, however, I was looking at a video where a person stated he had started a business and got on tv and renewed for another season, as shooting started to my memory he was having issues with his stomach, he went to urgent care a number of times where nothing was too concerning to my memory when a friend eventually got him to go to the Emergency Room and found out horrible news. He finished filming his second season and died. Now the treatment he received may have been top of the line and no one did anything wrong. That is an issue with Urgent Care as they don't get to know you, and perhaps any Doctor would have done what they did. That is one reason you see a Family Doctor and not a PA and where you can get in within a week and not four months so they know you. The fact is if you do not look after yourself do not believe others will especially with Hospitals employing, I believe most Doctors, and may have conditions like you need to see X number of patients a day, like a factory, don't prescribe this or that or a number of other things they may or may not mandate. At one point a few years ago the World Health Organization, I believe, had the USA ranked 32nd as far as quality, which since their is I believe 20 industrialized nations in the world puts us behind 3rd world countries, 92nd as far as performance, and 13th in infant mortality yet we pay almost 3 times any other country does for health care. People do not realize that if you leave work and carry COBRA you have to pay what you have been paying plus what your company pays and another 2% for 18 months. Think about it, age discrimination is outlawed but it occurs as they do not want insurance rates to go up and you also in cases due to health care costs do not get PAY raises. Protect yourself when you see Doctors and in my opinion dump this health system as it pays Doctors to treat illness where in other countries Doctors are paid to keep people from getting sick. Now back on track to his question: Again, Insurance companies may be willing to pay a private attorney to an extent. one could argue that State Farm in order to discourage people from doing what you did will pay a private attorney, as likely they do not have staff attorneys there and, even then those people are are still paid.. However, there gets to be a time, when they know you are serious and they will not win on the liability issue and your damages are so minor it is much cheaper to pay it and dump it. My bet is you could have gotten more. Plus in many states if you lose in small claims court, where, depending on the State, a representative from their office could be there and not an attorney then not so bad economically either. Plus, in your case they had attorney but say you lost because the subpoenaed people did not show up and you did not do Request for Admissions so your could not prove liability, well, in many States you can then do what some call a "trial de novo " you get to retry the case all over again but again in many states you can represent yourself as plaintiff but you have to follow the legal procedures and the defendant can likewise do the same but they will have an insurance paid attorney there for their insured whereas you if you hired an attorney depending on the State you may well be stuck with his/her bill that they charge you and not get that as part of your damages. Sorry, I went off on Doctors, well not so much them, as their profession and hospitals owing them. In fact one time, I was at a Urologist and I noticed on his business cards he had his personal cell number. I immediately thought, assuming he was an employee of the hospital as how they would allow him to do that as they would not get money from a patient going to their urgent care doctor but said nothing except why do you have your cell number on your card? He said I cannot see someone going to Urgent Care and paying $400 when they can call me and I can call in a prescription. I then asked, Well, how does the hospital allow you to do that. He said he rented his office and was not an employee. Ask yourself if he was an employee would he have his cell number on the card or would he be allowed to. Many Doctors want to do good, the system does not allow it. The Judicial System has also become an assembly line in my opinion. A person I know was a Chief Assistant Prosecutor and Assistant Prosecutor for nearly three decades and he/she put his/her cell phone on her card and even told defendants, witnesses, and victims, they could call him/her 24/7 as if it was important for them it was important for him/her to listen. I understand h/she said just be sure I write it down. He/She has told me now its all about money and moving the case along. Not always, but too often.

Definitely your own hard work. I wouldn’t say that John had a hand in your final number. He may have submitted the documents but otherwise, I didn’t hear of anything he did that would contribute to the amount you wanted.

Which State are you in?

They knew you were NOT going away and you were 100% in the right. This was a matter of principle for justice more than the money in my view. The biggest and tallest buildings in just about every down town I have been to are insurance buildings and banks. They have so much money they can bully the average person in winning their case because of all their experience and lawyers. You my friend are a hero to me and you're very well spoken. You should have added additional expenses for loss of wages and your time and effort IMO.
