The unlawful detainer action for possession would stop once a tenant is out. So technically it's not what most people consider an eviction, but you should clarify with an attorney.

What notice do I serve the tenant if they did not pay last month's rent and refuses to sign a new lease after having it for over 30 day? Tenant also received a letter by Certified and Priority mail requesting the tenant to sign the new lease and pay rent. Last lease was signed in 2004. I am a month to month tenant so I don’t technically owe back rent but I did receive a 3 day notice to pay rent or quit. The rent that’s owed is the rent for the current month. What happens if I choose to quit and move out by that 3rd day? Do I still owe money even though I don’t owe back rent and does that count as an eviction?

As a month-to-month renter, you're required to give a 30 day notice if you're moving out. If you move out because of the 3 day pay or quit, you'd still technically be on the hook for the rent for 30 days.

Hello, I received a 3 day Pay or quit from a neighbor who usually corresponds between the landlord and tenants but I don't believe they are an official associate. My question is, the letter is not an official form but more of a hand typed letter with all the required info as stated in your video. Is that still acceptable or does it need to be an official form? You probably have this figured out by now, but to start, did he pay your mom rent? If so is he paying you the rent that would have gone to your mom? He’s probably not paying you is my guess so you could start with a 3 Day Pay or Quit Notice. It should apply for the back rent due only, no penalties, nothing else except for rent owed. He probably won’t pay it so three days after he’s been served the notice and you haven’t been paid then you can file an “Illegal Detainer” notion with the court. This will authorize you to have the sheriff remove him and his belongings from the mobile home when the legal process is decided in your favor. This presumes you won’t get any reply from the guy, which can be typical in these things. You need to get started. Depending on your priorities of time and resources, you can usually do most of this stuff yourself if you take some time to carefully review the legal paperwork forms available. It can be intimidating at first as you will hear a lot of “consult a lawyer” stuff as you go along, like the guy in this presentation often says. They have to say this. Errors can be made, and some folks might be better having the whole eviction process done by “professionals”, but if you have the interest and time you will find that you can do it yourself. All the “maybe see a lawyer” cautions are in part due to the presenters (like this video) can’t have boatloads of do-it -yourselfers coming back on THEM in court saying “but he said if I did yadda yadda…”. You can probably do it yourself IMO. When it’s all said and done it’s actually pretty easy…..”.

@gabesmokeymartatom Thanks for the reply. To start, he was never paying rent and no rent amount was ever discussed. He freeloader off her for a couple years. I couldn't do a three day notice due to the fact that he couldn't pay and get current on something he wasn't behind on. I gave him a 60 day notice to vacate because he had been there over 2 years. I also had to continue paying all there bills. Gas, electric, trash because I was told if I shut them off I would be retaliating. They left alittle after 60 days and now I get to pay to have it fixed and haul everything to the dump they left. Landlord/Tennant laws need to change. People need to be held accountable for their actions. I wish I could sue but they have nothing.

And this is where my father was living before he passed cause he decided to rent out our house. That's attached to the same address as garage. The income from the front house and the backhouse pay for the mortgage and for the utilities and that was the agreement. With the tenant tenants that we share an address with my Uncle served me a 30 day to vacate. So he could sell property? I've lived here 40 years. I'm not very mobile at the moment. I have a medical Condit so I have no money. Absolutely zero in my bank account. What can I do? Or is there anything I can do and I'm not allowed to? Contest the trust but nowhere in the trust doesn't say that I have to leave the property for him to sell it

24 HOUR NOITCE: Please note I was only not able to pay rent starting in December 2021 and started renting May 21st 2021. My landlord has only 1 time in the entirety of me renting has ever given me a 24 hour notice. He has barged in my bedroom without knocking multiple times and has just walked in the house multiple times (I put multiple lightly as it has been 30% of the time). He has rang the doorbelll 30% of the time, told me he is on his way over (lives 20 minutes away) when he just left his home to come by mine , and those other times he has just walked in the damn door or knocked and barged in without notice. He and his wife have lied about dates trying to coax me to take my things of the door for a few days to do repairs that were not needed. They have also threatened me with animal control and sherrifs June 2nd, 2021.

When can the home purchasers expect the money back the the national association of realtors fraudulently stole from us? I saw that the other day and wondered why anybody would use a realtor. Ive purchase several homes and never found a need for a realtor or their 6% fees. Buy a home carried by owner and you can skip the scumbag banks too!!!

Peace To All, YAH1/ YSRAYL1! I & My Wife have been noticed on office stationary "3 day(s) to quit" on Sunday 02/26/23. The property we reside in is in probate, part of My Paternal Family's Estate through My GrandMother, to which I am an heir. It is our Family home & has been sold.
