I like your number one. I don't recall any actual declaration that he was dead. He was down and passed on command of the ship. He made the recording before the whole debacle even occurred. But did anyone declare him to be dead? He and many other Starfleet officers were likely badly injured during the Borg uprising. They had so many dead and near-dead that they needed to keep things moving while people recovered. Maybe Seven did put Shaw in some kind of stasis but he was so badly injured that it took months to recover. He was not able to take the command of his ship back in a timely manner, so they gave it to Seven.

Cool ideas. I would enjoy seeing the new version from the Mirror Universe, but I think that ultimately defeats the purpose of bringing back the actual Shaw. My idea was based on the nanoprobes as well (but filtered through a convoluted need to tie it into the Section 31 movie). Basically they would use modified nanoprobes to bring him back as a "test run" of the project phoenix idea without sacrificing a substantial asset like Kirk. This would also allow Shaw the added depth of someone so tied to Borg trauma now being resurrected by the very thing he hates most etc.

I say they go the Beerfest route. "Hi guys, I'm Liam Shaw's twin brother, Will Shaw. I'll be your new crewmate. It would be the biggest honor if you could call me by my brother's name and never mention his death ever again. Ever." I'd be perfectly ok with that.

I really hope they don't; star wars already has enough of a problem with fake-out deaths nowadays, I don't want it leaking over into star trek.

There is only ONE way Shaw could return... BADLY. Contrived bullshit to rewrite something you only just wrote, just to please fans, is the worst sort of writing. YES it would have made more sense for a new show to have launched with Shaw as Captain, Seven as First Officer and Rafi in rehab somewhere far away from important decision making. With Jack doing something he wants rather than living out the Fanboy dream of "Another Picard in Starfleet". But Picard Series 3 wasn't about setting up a new show. It was about giving fanboys and girls a happy ending. Shaw HAD to die so that Seven could get her flowers at the end.
